This is on the top of the fact that Ponting has signed a statement
saying that there was no racial abuse, Clarke refused to stand by his
earlier contention since this time he was under oath, and Hayden has
now openly admitted - under oath - that he did not hear Harbhajan at
all.
To me the most damaging statement was he following from Mr. Hansen:
"This is a little surprising in the context where there was a
reasonably prolonged heated exchange. Indeed Mr. Clarke went so far as
to say that he did not hear Mr. Symonds say anything. Given Mr.
Symonds' own acceptance that he initiated the exchange and was abusive
towards Mr. Singh, that is surprising."
I understand the Aussies want to support their team, I actually think
it's admirable. However, such blatant lying should supersede any
patriotism, IMO. I can understand semi-educated losers like W_S and C-
double-Zero keeping that stance, but I am disappointed that some of
the better Aussie posters do not find this apparent deceit
unacceptable.

I don't see anywhere in the text of Justice Hansen's decision where
anyone was sworn in under oath. I was under the impression from his
initial public statement prior to the hearing that witnesses would not
be "sworn in".

I have quoted the entire paragraph below because I think your edit and
your follow on assertion of "blatent lying" by the Aussies needs to be
considered in the context of what the judge said.

Justice Hansen's decision is legalistic in its orientation though
always clearly explained in a manner understandable by laymen (oh that
all things to do with finding of facts could be so well explained). He
makes a point of always walking a path that avoids even the hint of
hyperbole. From reading the complete decision I find no suggestion
anywhere that there was "blatent lying". Am I misunderstanding you?
Are you asserting malice on the part of the Symonds, Hayden and
Clarke, where Justice Hansen found none? Or are you asserting malice
on the part of Aussie rsc fans?

Having no "my-team" interests at stake in the result of the hearing, I
can be a bit more dispassionate about things. (Catch me on something
to do with England and that may be much harder to do). What I see
unfold as I read the decision (several times now) is the uncovering of
a really unfortunate (and preventable) blowup in which Symonds heard
what he *expected* to hear from Singh (given past form and their
personal run-in) aggravated by Hayden and Clarke pitching in also
believing that what they heard in the midst of a tirade in Singh's
native language was the deal-breaking "big monkey" racial insult. I

as to what was said by Mr Singh is completely at odds. Mr Tendulkar
said there was offensive words in Mr Singh's native tongue and he also
heard abusive language in English between the two. Mr Hayden says he
heard the words "big monkey" but could not recall for the court any
other words that were said by either party. I remind myself that an
honest witness remains a witness who may be mistaken. In my view there
remains the possibility of a misunderstanding in this heated
situation. As well it is not without significance that the Australian
players maintain other than Mr Symonds that they did not hear any
other words spoken only the ones that are said to be of significance
to this hearing. This is a little surprising in the context where
there was a reasonably prolonged heated exchange. Indeed Mr Clarke

Very impressive. Justice Hensen clearly has a razor-sharp mind and is
able to cut to the heart of things. No disrespect meant to Mike
Procter but IMO had this level of rigour been applied to questioning
the witnesses at the initial hearing there probably wouldn't have been
an appeal hearing. As long as the Australian players were adamant
about what was said with no possibility embraced that they heard what
they expected (even wanted) to hear, the MR was going to impose a 2-4
match suspension for a level 3.3 offense. This was were the process
derailed. But once the needed level of rigour was applied Symonds,
Hayden and Clarke couldn't sustain being adamant about what they heard
and H. Singh got a sentence for a lesser charge.
In the end the process worked and a just result was reached, but
serious problems in implementing the process were exposed. We learned
that the ICC can't let a MR adjudicate a racial abuse hearing. The
very reason Procter found Symonds, Hayden and Clarke to be credible
(the assertion that they absolutely had heard "monkey" instead of the
Singh/Tendulkar assertion it was the "maaki" insult at Symonds mother)
proved to the heart of be the reason Justice Hansen found them not
credible, though sincere in their belief about what they thought they
had heard.
This is exactly why the ICC will have to give all future racial abuse
(and probably all abuse charges when I stop and think about it) to an
independent council like Justice Hansen. And do it at round one so it
becomes less likely that cricket will have to endure further partisan
ill-will, and minimize the likelihood of needing to go to an appeal.
And of course reduce the likelihood of further chartered airplane/team
is coming home/no we really weren't going to do that shenanigans.

Repeating a lie doesn't make it true...

counsel for the appellant, as to what he stated in the hearing before
Mr Procter. There it was recorded that he stated he heard “something
like big monkey”. However, his evidence to me was not that this was
the use of something similar to “big monkey”. Rather he maintained
that what he told Mr Procter was that he heard things being said that
he did not hear or comprehend which he referred to as “something
something something” but then he heard the words “big monkey”.

the exchange, or it might be that Symonds said something and Harbi
shouted something (you've got to be a bit heated to try and abuse an

Yes, the above statement was damaging to Michael Clarke. However there are
several statements in your post that are potentially damaging to your
reputation. Indeed I find it extraordinary you should make pronouncements

Evidence at the appeal was not given under oath. Judge Hansen made a point

I'm not asserting anything, simply reading what Mr. Hansen wrote.
When Hansen wrote, "Given Mr. Symonds' own acceptance that he
initiated the exchange and was abusive towards Mr. Singh, that is
surprising", he is obviously being very gentlemanly ornate;
'surprising' is simply a euphemism for "we know he lied". Hayden
probably realized after the fact that he did not hear Harbhajan use
the M word; he only heard Symonds assert that Harbhajan used the
word. OTOH, Clarke is simply being deceitful and he is so often wont
to.

Again, agreed entirely. IMO - and I don't think I've read this on
this forum - Proctor comes off looking worst in this sordid saga. For
someone who supposedly had no dog in this race, he either comes off as

I agree. If Procter had simply followed the precedent and acquitted
Harby on the basis of lack of evidence, I don't think anyone would've
been unhappy. Not even the accusers, I'd guess. Before the Sydney
hearing, I think that's how most RSCers thought the verdict would go
as well.
Not that a match-referee should do whatever makes people happy, or
follow the majority opinion. But in this case, the majority *was*
right - there was little evidence, and the precedent had been, no
evidence, no conviction.
Procter himself would have come away with his reputation intact.
Instead a reputed judge has made a mockery of his refereeing
abilities. He didn't cross-question the Aussies and find some of their
testimony less-than-credible. He deemed SRT's testimony irrelevant,
when in reality it was crucial. And he simply made no effort to lay
all the facts of the case bare, before pronouncing his judgement.

so it's fine that it doesn't happen in cricket as well? By being a
competent arbiter, and documenting his verdict, Judge Hansen has
violated ICC norms and should be penalized under the ICC Code of
Conduct for bringing the game into repute.

is a good thing. Basing convictions on lesser evidence is not one of
