Here is some information on Carl Kabat's case as of November 11:
*The Air Force maintains that the the damage was $300.
*The judge ruled that a "choice of evils" defense could not be
presented at trial as an affirmative defense.
*The judge wants briefs and further argument before deciding on
international law and freedom of conscience defenses.
*Prosecution and defense attorneys will arrange to visit the site and
photograph the crime scene from outside the fence. Carl will not be
allowed to accompany them.
*The judge ruled out the prosecution's attempt to enter evidence of
Carl's two earlier actions at MM III silos in Colorado.
*Carl will be permitted to get his clerical garb released from jail
custody for the purposes of having it cleaned and will be able to wear
it at trial.
There will be a readiness hearing on December 7 at 11 o'clock. There
will also be some resolution of other trial issues at that time. (see
above}
The trial is scheduled for Dec 21-22.
The prosecution has until November 23 to get the Air Force to release
their report of Carl's detainment.
Carl seems in good spirits and sends his love to everybody.
