Subject: Update on Carl
I had a frustrating day in Greeley trying to get Carl's money released
to me to put it in his jail account and to get his glasses to him.
Both items were seized when he was arrested. The Sheriff's department
admitted they should not have done it this way. I was told as much
several times over the past 2 weeks. Yesterday I was assured by a
Commander Lemley that I could take care of this today by stopping by
the jail to get a letter signed by Carl to be taken to the evidence
holding facility to take possession of his glasses and money. That
did not happen. After lots of hell raising I finally got the glasses
to Carl but the DA wants to hold the money for some reason. They also
changed the time of Carl's hearing from 3 o'clock to 1 o'clock so I
missed that too. Here is a summary of his upcoming court dates which
I got from his public defender Jacob (Jake) Goldstein.
On October 15 at 11 there will be a hearing to determine if they will
release his money so that it can go in his jail account. It should
provide some insight into why they are holding it, uncounted, in a
storage locker. Lots of opportunity for theft to take place.
On November 6 there will be a pretrial conference. Not sure of the time.
On November 10 there will be a readiness hearing, pretrial motions etc.
December 9 and 10 are set aside for a jury trial.
All of these court dates are set for Weld County Courthouse. No hint
of federal interest in the case. Of course all of this is subject to
change as things unfold.
I spent from 9 in the morning until 4:30 in the afternoon not getting
anything done. Lots of double talk and stonewalling. I am not
actually sure that they will give Carl his glasses. One person told
me they would only give him the glasses if they were "prescription"
Will check on that when Carl calls. I tried to see the Sheriff to
make a complaint but of course "he wasn't in". Stay tuned.
