A 75-year-old Catholic priest who was arrested in August for breaking
into a nuclear missile silo in northwest Weld County will likely stay
in jail through the end of his trial.
Even though a Weld County Court judge reduced Carl Kabat's bond to
$2,500, his personal conviction to protest nuclear armament will
likely keep him where he is, said his public defenders, Jeri Shepherd
and Jacob Goldstein.
“She just read off a litany of charges, and it's easy to listen to
that and think” he should stay in jail, Goldstein said Monday
afternoon after listening to Deputy District Attorney Jennifer
Schneider read off 17 similar convictions in the past 30 years against
Kabat. “He's been protesting something for 30 years that he believes
is evil. He's a hero for that.”
Kabat has been in jail since Aug. 6, when he entered the N7 missile
silo premises off of Weld County Road 113, about 40 miles northeast of
Greeley, to protest nuclear weapons. He had traveled from St. Louis
for the trip, knowing he'd be arrested, even granting an interview
with the St. Louis Post Dispatch that warned authorities he was on his
way.
Authorities say Kabat, dressed in a clown suit atop his clerical garb,
cut a hole in a fence to get in, but he did not enter the actual silo.
It was his second time at that particular missile silo site since
2004, and his third such arrest locally. He had trespassed at another
Weld silo in 2000.
Kabat's been charged with misdemeanor criminal mischief and
trespassing. His criminal history dates to 1978, Schneider argued.
While most of the cases have been destruction of government property
and trespassing, Kabat also had one conviction for unlawfully entering
the White House in 1981, Schneider said.
While arguing to lower Kabat's bond, Shepherd said he had local people
to stay with if he chose to leave jail under a lowered bond. She said
she was not aware of any effort to raise money to release him from
jail, and she didn't think he'd like the idea.
According to the St. Louis newspaper, Kabat served less than 10 years
in prison for taking a jackhammer to a silo in 1984, and he was given
a 15-month sentence in 2006 for attacking a silo in North Dakota.
What's next: Carl Kabat will return to court for a jury trial on Dec.
21-22. If convicted, he could face from three to 12 months in the Weld
County Jail.
