  I did a video visit with Carl Kabat yesterday and then met for about
45 minutes with one of his public defender lawyers.  He seems in good
spirits.  He is in a new ward which is better heated.  He continues to
get lots of mail but he said at least 40 pieces of mail of various
kinds have been rejected.  He gets a slip each time.  Often it is
because someone has not put on a return address.  Other times it is
because some
material is deemed to violate jail rules, such as newspaper or
magazine articles.


  I left a book with his lawyer Jeri Shepherd to be given to him for
reading for trial.  It is a new biography of Bernard Schriever
sometimes described as the father of the ICBM.  It glorifies Schriever
but has a lot of factual information which makes it a good read in my
opinion. Nowhere is there any reflection on the morality or legality
of nuclear weapons.  Mainstream thinking from start to finish.


  Jeri Shepherd and Jake Goldstein, his public defenders,  seem eager
to help Carl in court.  They have filed several motions to be
considered at the November 6 hearing.  There is an option for a
November 10 hearing
date if there are leftover arguments from the first hearing.  We are
trying to get a good turnout.


    They will pursue choice of evils, international law, freedom of
conscience and a couple of others that make mention of the Colorado
State constitution.  Carl does not appear to be very enthusiastic
about any of it but is going along.  They are putting together a
possible witness list including John Laforge, Tom Rauch from Denver,
Ved Nanda and myself.


  I once again explored the question of a possible delay of the trial
date because of its proximity to Christmas.  Jeri and Jake seem to
think the date will hold.  They will not pursue any further delays.
They cannot speak for the prosecution.  Colorado speedy trial statutes
are not in play.  The law here is 6 months not 90 days as it is in
federal system.


   It turns out that the judge hearing the case worked at the public
defender's office until a few years ago.  Not sure how that will play
out.
