Anti-Iran Hawks Win Partial Victory in Congress

WASHINGTON, Sep 27 (IPS) - Amid growing speculation about prospects
for U.S. military action against Iran, neo-conservatives and other
hawks won a significant -- if somewhat incomplete --

victory in rallying the Democratic-led Congress to its side.
---
In a 76-22 vote Wednesday, senators approved a non-binding amendment
to the 2008 defence authorisation bill that:
---
called for the administration of President George W. Bush to designate
Iran's Revolutionary Guard Corps (IRGC) "a foreign terrorist
organisation".
----
Among those voting for the measure was
**********************************************
the Democratic front-runner for the 2008
**********************************************
presidential election, Sen. Hillary Clinton.
*********************************************

At the same time, the House of Representatives voted nearly
unanimously -- 408-6 -- for another measure,
---
"the Iran Sanctions Enabling Act",

which would force Bush to impose sweeping sanctions against foreign
companies that invest more than 20 million dollars in Iran's energy
sector.

That bill, which is opposed by the Bush administration itself "due to
strong pressure" from Washington's European and Asian allies and key
U.S. multinational companies,

is considered likely to stall in the Senate through the remainder of
this year.

But its huge margin of approval,

which some observers said was
boosted by this week's controversial visit to New York by Iranian
President Mahmoud Ahmadinejad,

helped demonstrate once again
how responsive members of both major parties

are to the so-called "Israel Lobby",

which has made the sanctions bill

"its top legislative priority this year."

Both votes took place amid an intensifying struggle within the
administration over control of Iran policy, with hawks, led by Vice
President Dick Cheney and his neo-conservative advisers, pitted
against the State Department and Pentagon chief Robert Gates and his
top military brass.

The State Department, while never ruling out military action, has
consistently argued for continuing diplomatic efforts to address both
alleged Iranian backing for anti-U.S. Shia militias in Iraq and Iran's
rejection of U.N. Security Council demands that it freeze its uranium-
enrichment programme.
----
For the past two months -- since the last time the U.S. and Iranian
ambassadors met in Baghdad -- the struggle appears to have reached an
impasse.

In late July, Bush agreed in principle to a proposal by Cheney for
cross-border military strikes against IRGC targets that have allegedly
been involved in training and supplying Iraqi Shia militias, according
to Philip Giraldi, a former military intelligence and CIA officer,
writing recently in The American Conservative.
---
But the Pentagon brass, which has become increasingly outspoken about
the overextension of U.S. ground forces in Iraq and the uncertainty
about how Iran would react, countered with a more cautious strategy of
building a new military base and extending patrolling along suspected
smuggling routes, according to knowledgeable sources.
----
Similarly, the diplomatic dialogue between the U.S. and Iranian
ambassadors in Baghdad over stabilising Iraq -- originally launched
last May -- has not resumed since their second and last meeting in
late July when Amb. Ryan Crocker publicly complained about Tehran's
alleged increase in support, via the IRGC, for Shia militias that were
attacking U.S. troops.

In testimony here two weeks ago, Crocker said he "found no readiness
on the Iranians' side at all to engage seriously on these issues,"
while Gen. David Petraeus, Washington's top military commander in
Iraq, charged that Tehran was engaged in a "proxy war" against the
U.S. in Iraq.

Last month, the Washington Post reported that the administration had
decided in principle to designate the IRGC, which, in addition to its
military role, controls a number of large businesses that could be
subject to sanctions, but had yet to determine whether it would name
the entire organisation or only its elite unit, the Quds Force.
----
That no announcement has yet been made is indicative of the continuing
infighting around Bush.
----
The continuing paralysis, however, appears to have favoured the hawks,
who have pressed their campaign for cross-border military action
against Iran in the opinion pages of such neo-conservative
publications as the Weekly Standard, the National Review, and the Wall
Street Journal.

Their calls for action became so intense that the commander of the
U.S. Central Command and Petraeus' superior, Adm. William Fallon, who
has been trying to get authorisation to negotiate an "incidents at
sea" agreement with Iran, complained publicly that "this constant
drumbeat of conflict is ...not helpful and not useful.

"It is not a good idea to be in a state of war.

We ought to try and to do our utmost to create different conditions,"
he told al-Jazeera.

In fact, the first call for cross-border attacks on Iranian targets
was made by:

Joseph Lieberman, who is regarded as particularly close to the
powerful American Israel Public Affairs Committee (AIPAC).

As introduced, the amendment, which, according to several Capitol Hill

"interpreted as authorising war against Iran."

Among other provisions, it called for the U.S. to "combat, contain and
roll back the violent activities and destabilising influence inside
Iraq of the Government of the Islamic Republic of Iran...and its
indigenous Iraqi proxies...and "the prudent and calibrated use of all
instruments of United States national power in Iraq,
including...military instruments, in support of (that) policy?"

But those paragraphs were deleted after Democratic Sen. Jim Webb
delivered a passionate speech in which he charged that the amendment:

"is Dick Cheney's fondest pipe dream" and

In a further softening, the drafters changed one policy statement that
claimed it was a "vital (U.S.) national interest" to prevent Iran from
turning Shia militias in Iraq into its proxies to a "critical national
interest."

The previous wording generally connotes an interest over which the
U.S. would be prepared to go to war.

Still, the fact that the amendment was approved by a significant
margin -- and
with the support of key Democrats,

HOUSTON (AP) ? BP PLC is taking a multimillion dollar broom to sweep
away a slew of federal charges linked to energy price fixing, a deadly
refinery blast and pipeline leaks and focus on its energy business.

The more than $373 million in settlements announced Thursday are part
of the company's attempt to get rid of the problems left over from the
stewardship of former chief executive John Browne and move ahead with
the recently announced restructuring of Europe's second-largest oil
company.
---
On top of the fines and restitution, four former BP employees were
indicted by a federal grand jury in Chicago on 20 counts of mail and
wire fraud connected to a scheme to manipulate energy markets.
---
The bulk of the fines ? $303.5 million ? aim to punish BP for
conspiring to fix propane prices in 2003 and 2004.
---
London-based BP also agreed to pay a $50 million fine and plead guilty
to a felony for its role in a 2005 explosion at its Texas City
refinery that killed 15 employees and injured more than 170 others.
---
Additionally, it will pay $20 million in criminal fines and
restitution to Alaska and the National Fish and Wildlife Foundation
for pipeline leaks and spills at Alaska's Prudhoe Bay, the nation's
largest oil field.

The settlements were made public at U.S. Justice Department news
conferences in Washington and Houston.

"These agreements are an admission that, in these instances, our
operations failed to meet our own standards and the requirements of
the law," Bob Malone, president and chairman of Houston-based BP
America, said in a statement. "For that, we apologize."

Gary Adams, vice chairman of oil and gas for Deloitte & Touche USA
LLP, said it makes perfect sense for a global energy company like BP
to want to refocus efforts on its core business ? finding, producing
and refining oil and natural gas.

The global energy business is difficult enough these days, Adams said,
as access to new reserves becomes increasingly difficult and costs for
materials and services continue to rise.

"In order for international oil companies to compete, it makes sense

The Supreme Court agreed Monday to decide whether Exxon Mobil Corp.
should pay $2.5 billion in punitive damages to victims of the huge
Exxon Valdez oil spill that fouled more than 1,200 miles of Alaskan
coastline in 1989.

The high court stepped into the long-running battle over the damages
that Exxon Mobil owes from the supertanker accident in Prince William
Sound that was the worst oil spill in U.S. history.
---
The Exxon Valdez ran aground on a reef, cracking its hull and spilling
11 million gallons of oil.
---
Hundreds of thousands of seabirds and marine animals died as a result.
---
It is a case filled with superlatives. The award, even after it was
cut in half by a federal appeals court in December, would be the
largest punitive damages judgment ever.
---
A jury in Alaska awarded $5 billion in damages in 1994 and the company
has been appealing the verdict ever since.
---
Irving, Texas-based Exxon Mobil is the world's largest publicly traded
oil company and last year posted the largest annual profit by a U.S.
company ? $39.5 billion.
---
That result topped the previous record, also by Exxon Mobil, of $36.13
billion set in 2005.
---
Arguing against Supreme Court review, lawyers for the plaintiffs, some
of whom are deceased, said the damages award is "barely more than
three weeks of Exxon's net profits."
---
The plaintiffs still living include about 33,000 commercial fishermen,
cannery workers, landowners, Native Alaskans, local governments and
businesses.
---
They urged the court to turn down the company's appeal, saying, "After
more than 18 years, it is time for this protracted litigation to end."
---
But the justices said they would consider whether the company should
have to pay damages at all under the Clean Water Act and centuries-old
laws governing shipping.
---
The court has frequently sided with business interests in punitive
damages and other cases of corporate liability.
---
Exxon said that even if the court finds some money is due, it should
rule that the $2.5 billion award violates the Constitution because it
is too large.
---
The justices said they would not consider that argument when they hear
the case early next year.
---
Justice Samuel Alito, who owns between $100,000 and $250,000 in Exxon
stock, did not take part in the decision to accept the appeal.

The court's last ruling on punitive damages, in February, set aside a
nearly $80 million judgment against Altria Group Inc.'s Philip Morris
USA. The money was awarded to the widow of a smoker in Oregon.

Exxon said it already has paid $3.4 billion in cleanup costs and other
penalties resulting from the oil spill.
---
"This case has never been about compensating people for actual
damages," company spokesman Tony Cudmore said in a statement. ---
"Rather it is about whether further punishment is warranted...We do
not believe any punitive damages are warranted in this case."

The company marshaled more than a dozen organizations ranging from
groups of shippers to the U.S. Chamber of Commerce, to support its bid
for Supreme Court review.

The company argued it should not be held responsible for the mistakes
of the ship's captain, Captain Joseph Hazelwood, who violated clear
company rules when the Exxon Valdez ran aground with 53 million
gallons of crude oil in its hold on March 23, 1989.

The plaintiffs said Exxon knew Hazelwood had sought treatment for
drinking, but had begun drinking again.

"Exxon placed a relapsed alcoholic, who it knew was drinking aboard
its ships, in command of an enormous vessel carrying toxic cargo
across treacherous and resource-rich waters," they said.

JEDDAH, Saudi Arabia (Reuters) - The rulers of six Gulf Arab oil
producers will decide in December whether they can meet a 2010
deadline for monetary union, the Saudi central bank governor said on
Saturday after meeting regional policymakers.

Investors were watching the meeting in the Saudi Red Sea port city of
Jeddah for any signs of a rift on currency policy, which could renew
market bets on the demise of a regional exchange-rate regime pegged to
the tumbling U.S. dollar.
----
"There was agreement that there is no need to change the current
foreign exchange policy with consensus from all member states," Hamad
Saud al-Sayyari, governor of the Saudi Arabian Monetary Agency told
reporters after the talks.
----
Gulf currencies strengthened again on Friday, with the Qatari riyal
gaining to its strongest since 2003, as investors bet delays to
monetary union plan would prompt central banks to let exchange rates
appreciate.

"We did not discuss setting a new date," Sayyari said.
---
Finance ministers and central bankers would pass on their assessment
of the currency union plan to Gulf Arab rulers, who would decide the
issue when they meet in Qatar in December.

All six states agree the 2010 deadline will be difficult, if not
impossible, to meet. United Arab Emirates Central Bank Governor Sultan
Nasser al-Suweidi told a magazine this month that the timetable could
slip beyond 2015.

The International Monetary Fund said Gulf monetary policy needed to be
consistent with dollar pegs, after the six states broke ranks on their
response to a U.S. interest rate cut last month, raising speculation
about currency revaluations.

"I think the relationship with the dollar is one alternative," IMF
Managing Director Rodrigo Rato told reporters after meeting Gulf Arab
officials in Jeddah.

"That alternative requires following monetary policy that is coherent
with that alternative," he said.

When the U.S. Federal Reserve cut rates on September 18, Saudi Arabia,
Oman and Bahrain declined to follow, choosing to ride out pressure on
their currencies to appreciate, rather than stoke inflation at home.

Qatar and the United Arab Emirates cut some key rates along with
Kuwait, the only Gulf Arab state that does not peg its currency to the
U.S. dollar.

Investors drove the Saudi riyal to a 21-year high after the Fed cut,
taking divergence on monetary policy as another sign that the deadline

The monetary union deadline began slipping when Oman opted last year
not to join by 2010, saying it did not want to meet the spending curbs

Then there is the matter of the Democrats in
Congress.

After their costly fumble on Iraq, the
opposition Party should make it very constitutionally
clear, as recommended by former New York
Governor, Mario Cuomo in a recent op-ed, that

there can be no funded attacks on any country without a Congressional
declaration of war, as explicitly
required by the framers of our Constitution.

But the Democrats are too busy surrendering to
other Bush demands, whether

unconstitutional,

above the law or

just plain marinated in corporate greed.

Some of this obeisance was all too clear in the Democrats questioning
of Bush's nominee for
Attorney General, Michael B. Mukasey.

After the two days of hearings, no Democrat has yet announced a vote
against Mukasey, even after he evaded questions on torture and

argued for the
inherent power of the President to act contrary to the laws of the
land if he unilaterally believes he has the inherent constitutional
authority to do so.

This position aligns Mukasey with the imperial views of Bush, Cheney,
Ashcroft and Gonzales on the

Every law student promptly learns the national ideal that our country
is governed by:

"the rule of law,"

Today, the rule of

law is under attack. ********************
Such activities have become a big business and, not surprisingly, they
have involved big business.

On October 25th, Secretary Condoleeza Rice officially recognized
before a House Oversight Committee that, remarkably,
---
"there was no law" covering the misbehavior of Blackwater Corporation
and their private police in Iraq.
---
Any crimes of violence committed by Blackwater and other armed
contractors commissioned by the Defense and State Departments to
perform guard duty and other tasks,
--
"fell into a gap between Iraqi law, from which
---
"they have been exempted by the U.S." military occupation and the laws
of the United States.
---
Since the United States government is "ruled by lawless men in the
White House" who have violated countless laws and treaties, Bush and
Cheney clearly had no interest in placing giant corporate contractors
operating inside Iraqi jurisdiction under either the military justice
system or the criminal laws of the United States.
---
Presidential power has accumulated over the years to levels that would
have alarmed the founding fathers whose constitutional framework never
envisioned such raw unilateral power at the top of the Executive
branch.
---
Accordingly, they only provided for the "impeachment sanction."
---
They neither gave citizens legal standing to go to court and hold the
Presidency accountable, or
---
to prevent the two other branches from surrendering their explicit
constitutional authority-such as the war-making power-to the Executive
branch.
---
The federal courts over time have refused to adjudicate cases they
deem "political conflicts" between the Legislative and Executive
branches or,
---
in general, most foreign policy questions.
---
Being above the law's reach, Bush and Cheney can and do use the law in
ways that inflict injustice on innocent people.
---
Politicizing the offices of the U.S. Attorneys by the Justice
Department, demonstrated by Congressional hearings, is one consequence
of such Presidential license.
---
Political law enforcement, using laws such as the so-called PATRIOT
Act, is another widespread pattern that has drag netted thousands of
innocent people into arrests and imprisonment without charges or
adequate legal representation.
---
Or the Bush regime's use of coercive plea bargains against defendants
who can't afford leading, skilled attorneys.
---
Books and law journal articles have been written about times when
government violates the laws.
---
They are long on examples but short on practical remedies of what to
do about it.
---
Corporations and their large corporate law firms have many ways to
avoid the laws.
---
First, they make sure that when Congress writes legislation, the bills
advance corporate interests. ---
For example, numerous consumer safety laws have no criminal penalties
for the violations, or only the most nominal fines.
---
The regulatory agencies often have very weak subpoena powers or
authority to set urgent and mandatory safety standards without
suffering years or even decades of corporate-induced delays.
---
If the laws prove troublesome, the corporations make sure that
enforcement budgets are ridiculously tiny, with only a few federal
cops on the beat.
---
The total number of Justice Department attorneys prosecuting the
corporate crime wave of the past decade, running investors, pensioners
and workers into trillions of dollars of losses and damaging the
health and safety of many patients and other consumers, is smaller
than just one of the top five largest corporate law firms.
---
Out in the marketplace, environment and the workplace, the
corporations have many tools forged out of their unbridled power to
block aggrieved people from having their day in court or getting
agencies or legislatures to stand up for the common folk.
---
Companies can wear down or deter plaintiffs from obtaining justice by
costly motions and other delaying tactics.
---
When people get into court and obtain some justice, the companies move
toward the legislature to restrict access to the courts.
---
This is grotesquely called "tort reform"-- which takes away the rights
of harmed individuals but not the corporations' rights to have their
day in court.
---
Lush amounts of campaign dollars grease the way for corporations in
the legislatures in the fifty states and on Capitol Hill.
---
As if that power to pass their own laws is not enough, large
corporations become their own private legislatures.
---
You've been confronted with those fine-print standard form agreements
asking you to sign on the dotted line if you wish to secure insurance,
tenancy, credit, bank services, hospital treatment, or just a job.
---
Those pages of fine print are corporations regulating you!
---
You can't cross any of them out.
---
You can't go across the street to a competitor- say from Geico to
State Farm, or from Citibank to the Bank of America, because there is
no competition over these fine-print contracts, with their dotted
signature lines.
---
Unless, that is, they compete over how fast they require you to give
up your rights to go to court or to object to their unilaterally
changing the terms of the agreement, such as in changing the terms of
your frequent flier agreement on already accumulated miles
Oh, for the law schools that provide courses on the rule of men over
the rule of law.
---
Oh, for the time when there when there will be many public interest
law firms working just on these portentous dominations of concentrated
power to deny open and impartial uses of the laws to achieve justice
and accountability.

Interestingly, according to the GOPers, when no law applies - it's supposed
to be treated as terrorism.

Question of the day- who and what is determining the price of oil and
your gasoline and home heating bills?
---
Don't ask Uncle Sam, because George W. Bush and Dick Cheney are
running a regime marinated in oil that does not issue reports which
explain the real determinants of petroleum pricing beyond the
conventional supply-demand curves.
---
First, let us create a historical framework to provide some
background.
---
In the good 'ole oil days, before the producer-countries' cartel in
the Third World gained pricing power, there were seven giant oil
companies called the 'seven sisters' led by Standard Oil (now Exxon)
and Shell.
---
As chronicled in Robert Engler's classic book, _The Brotherhood of
Oil_, they were able to affect pricing through extra-market means.
---
Economists called them a tight oligopoly.
---
OPEC later took their place at the table in the mid to late Seventies
and set the price of crude oil at highly publicized meetings of the
various member countries representatives from the Middle East, South
America and Africa.
---
Adjusting, 'seven sisters' concentrated their pricing and supply power
downstream at the refining, pipeline and marketing levels.
---
Pricing power was never total but it was always complex, occurring in
the interstices of an industry few outsiders understood, and fewer
regulators could affect.
---
Besides, natural gas was de-regulated between 1978 and 1993, after
which its prices really took off.
---
Today, a third party has moved to the table?the New York Mercantile
Exchange, a similar operates in London and a new one in Dubai.
---
There, boisterous traders buy and sell futures contracts on the
delivery of oil. ---
But as Ben Mezrich, the author of the new book _Rigg_ed said recently,
the dollar amounts of these futures contracts are far far larger than
the actual oil deliveries they represent as they turn over and over at
the Mercantile Exchange.
---
So now the critical resource of oil is driven by speculation at ever
higher abstract electronic levels of futures trading.
---
Increasingly, the distance becomes greater and greater between this
abstract trading (fueled by rumors of storms in the Gulf of Mexico, or
some possible political turmoil in a region of the world, or some
other frightful excuse for bidding up) and the physical supply and
demand for oil and its refined products.
---
These oil gamblers in New York and London try to justify their
frenetic daily bidding by saying that these futures markets provide
liquidity, and a clear price for oil. ---
Alright, but who benefits when, how and where?
---
Certainly, the strain between physical supply and demand in recent
years does not explain such extreme volatility.
---
With OPEC countries down to supplying only 40 percent of the world
production, Chinese demand for oil growing fast, and the expansion of
production by Saudi Arabia and others to meet this demand, crude oil
supplies are not tight enough to explain such pricing behavior.
---
Old factors like inadequate oil company investment in refinery
capacity, longer down times for repairs than some observers believe
necessary, and the slumping dollar are factors that western
governments, especially the Bush regime, have not wanted to
investigate.
---
After all, with consumers paying sky-high prices for these fuels, free
market theorists are supposed to expect expanded supplies from
recoverable reserves to grow.
---
But, of course, the global market for oil is anything but a free
market from the producers- both corporate and governmental- toward the
downstream companies to the consumers.
---
In recent days, the price of crude oil escalated to over $90 a barrel,
fluctuating up to a high of $96 a barrel.
---
Yet the average price of gasoline in the United States?around $3.00
per gallon?is about what it was earlier this year when the price of
crude oil was around $60 a barrel.
---
Why the disconnect?
"It's a big gambling hall," _The Washington Post_ quotes Fadel Gheit,
an oil analyst at Oppenheimer.
---
"This time it's just speculation," Peter C. Fusaro, chairman of Global
Change Associates, told the _Post_, adding,
---
"There's a large bet out there that prices will continue to trend
higher. But it's detached from fundamentals because there's no
shortage of oil."
---
Meanwhile, the government of Big Oil runs Washington, D.C.
---
It thumbed its nose at pleas from then Chairman of the powerful
Finance Committee, Senator Charles Grassley (R-Iowa) who asked the
major companies, swimming in massive profits, to contribute some
charitable dollars to help the poor pay for their winter home heating
bills, and has smugly watched the major Presidential candidates avoid
the subject in their debates and declarations.

Oil companies seem to spend more executive effort looking for oil by
merging with other companies (note the unchallenged merger of Exxon
and Mobil under the Clinton administration) than with developing
efficient oil-producing and consuming technology or expanding their
solar energy subsidiaries.
---
So long as the price of crude oil is set by speculators on trading
floors, so long as the oil-indentured politicians are not challenged
by new candidates standing tall for people and environments, so long
as we do not protest for change and press ourselves to prevent
wasteful habits and uses, get ready for higher oil prices.

The US didn't LEAVE the country because the US wasn't there in
