Hello friends, I figured I'd ask the great braintrust that is the Riv list for a little assistance.

Today I took a peek at Portland's bike section on Craigslist, as I am wont to do from time to time. And I noticed this ad:
BROOKS LEATHER SADDLE MINT CONDITION WOMANS - $50 (Downtown)
I have a woman's brooks leather saddle in EXCELLENT condition .. Asking 50 firm. Please email thank you . Still posted ?? That means I still have it . (When I saw the listing earlier in the day, it included a phone number, but it's no longer there.)

Now an EXCELLENT condition Brooks for $50 seems a bit low, especially in Portland. But what really grabbed me was the pic. The Brooks Flyer, the Carradice Lowsaddle bag, the ugly turquoise garage door in the background...why does it seem so...familiar?

Oh yeah, because the photo is mine.
It's a pic of my ex-gf's 1961 Raleigh Sports. (And to be noted because I'm anal: the Brooks saddle in my pic is actually a "regular" Champion Flyer, not the "womans" version.)

Has this happened to anyone before? What would you do in my shoes? Ignore it? Report it to CL (if that would do anything?) Contact the seller? Send said seller a bill for using my image?

I'm flummoxed.

Shawn,

Nice saddle.  I would definitely ask more than $50 for it.  :^)

I think you can flag it.  And it would be easy enough to have a few others do the same.  That would get it removed from CL at least.  I know for certain that this kind of thing (stealing someone else's photos) is not allowed on ebay - goes against their terms of service.  I would imaging CL has a similar policy... but I'm too lazy to check that right now.

I wonder if the seller actually does have a Brooks and they just didn't have a picture so they snagged your pic.  But if they can snag it from Flickr, then it seems they should be able to contact you to ask permission though, right?

Sending the seller a bill might be an interesting way to contact the seller.

I don't think you should ignore it.  Its not a huge deal in context of the world's problems, but its still not cool of a guy/gal to do, and probably against CL terms of service (I'm still too lazy to check).

That's my opinion on the matter.  Good luck!

I would contact her and say it's not kosher to use your photo.

But not before buying the saddle.  $50 is a great price.  :)

You do, after all, retain the copyright (unless you released it with a
permissive license) and this surely constitutes unapproved commercial use.

A few years back I sold a vintage amplifier on Craigs.  Quick sale good price, I was happy.

Sometime later I noticed a listing for the same model.  I took a look because the model is not so common.  Sure enough the ad had a picture showing my amp, on my rack, with my other stereo equipment and wall art in the background.

I flagged the ad then posted my own warning would be buyers that something odd was going on.

I suppose it could be the case the poster actually had such an amp but did not have a camera.  Sure seemed fishy though.

This is the first thing that came to my mind.  If you bought her that saddle, and she doesn't want it, she should just give it back, damn it.   ;-)

Re: My ex-girlfriend selling it. I contacted her when I first saw it, and no, she isn't. (And you'd also figure I'd recognize her phone number. ;-) )

Speaking for myself, it's not so much that somebody would use my pic without permission but what it says about such a person. In other words, maybe they're perpetrating a scam on an unsuspecting buyer, or worse. So I'd flag it at least. I'm not sure I'd contact them directly though. If you want me to flag it as well, let me know and state how to do so. I think numbers matter in such a scenario.

Thanks folks for the responses. I haven't had the time to do anything with it in the past couple days, but when I just checked the CL listing, it is gone. (Deleted by author, is what it says.) Wonder if the poster actually sold a Brooks saddle? We'll probably never know.
