My house..and the empty lot next door.

I am in negotiations with the owner to purchase the empty lot.

However...it would appear that in 2011 I pissed off a fellow down the
street over a dog issue..that my dog wasnt even involved in. So he
made a complaint with the county. I was notified by the inspector of
it in 2011..and told to keep it cleaned up etc and nothing more was
said.

Suddenly..on May 10..I get a 7 day warning from the county. New lady
inspector..who has little empathy. She claims that cargo containers
are a "no no" here in the unencorporated part of the county (dispite
them being all over the place) . So I had 7 days to pull it out. So I
mowed, cleaned the lot again, removed a boat and a trailer and put it
as the photos show.

She said I was "illegally dumping"..despite having the owners
permission. So this morning..she shows up with 2 deputies and advises
me that I have until 2pm Wed afternoon (24 hrs) to clean the lot off
else Id be cited for "illegally dumping" and the county would clean
off the lot.

Im scrambling to find a place to put the cargo container...but the
forklift is still down, Ive got ZERO money to move it or to fix the
forklift.

I called and left a message with the supervisor and one with her that
Im working on it..but need 30 days.

Now what are my options?

California of course.

In a dying area where there are more empty lots with for sale then
Carter has pills. The last photo is of a typical lot in the area.

When you talk to the supervisor, if they aren't agreeable to 30 days,
request they cite the section of the municipal code you are supposedly
violating. Actually, ask they cite it anyway, so that you can make sure you
don't violate it again.

In reality, if they can't cite it, they can't enforce it.

Also, see if there's a way you can get a permit for it.

If none of that works, you may be able to file a complaint for selective
enforcement. You can take snapshots of the neighborhood, as well as
printouts of Google Maps, to support your claim.

You really don't want to go to war with the county. You will lose.
However, government worker types tend to be a bit paranoid about their jobs,
and if their boss gets annoyed over their actions, those actions will stop.
After all, they're pretty much just there for a paycheck, and don't care one
wit about your container. The last thing they want to do is more work.

Last resort, go to court and file a request for a stay of action. It
shouldn't be too much trouble requesting a fee waiver.

Second last resort, cover it with tarps and call it an RV. If they come on
to your property and look under the tarps without your permission, you'll
have cause for a civil rights lawsuit, after which you can buy half the
county.

Good luck!

The code they gave me was "dumping trash"..and its obviously not
trash. They use it evidently as a catch all.

Its an unencorporated county area...."nominally" zoned R-1..but has
had many construction companies and oil field maint companies so on

I may have to do that. She (inspector) claims to have 300+ issues for
those around the area...backlogged and trying to look good for her
boss. Ive tried to work nicely with her and have been eversohelpful.

You mean you have some sucker willing to "sell" you a lot without a down
payment, without two nickels to rub together to pay any closing costs?
Someone with no money to pay an appraisal fee or title transfer fee?

No, gummer - no one believes you have any means of buying that
shit-strewn lot. Of course, you would immediately default on the taxes
for it, too.

No, not suddenly. Just typical slow as molasses county workers. Maybe
they could afford to hire more energetic people if deadbeats like you

Maybe she looked up your name in their records, and found out about
all the liens her employer has been slapping on you, and how few
you've paid over the last 3 decades.

Maybe she Googled your name. http://tinyurl.com/op5nlcz And found out

Bwahahahaha! Aren't these the deputies you claim to be on great terms
with, used to be one of for 8 years, have over for dinner all the
time, etc, and who you've repeatedly insisted will be pitching in on

First off, stop freaking out. The worst they can do is fine you,

I am not sure how the procedure is in your neck of the woods, but once they
write you a citation, you get a court date.

Do what you can, if anything requires a permit put in an application right
now.
You have to make some real progress. Call a scrapper and sell by the pound.

When the court date comes have plenty of evidence that shows real progress,
and ask for an extension.
But take two warnings. Do not try to bullshit them, everyone tries and they
expect it. They are more receptive to a straight answer. And realize that
they will make you do it eventually. The fines keep adding up until the
liens on your property is more than it is worth.

Oh, and clean up your neighbors lot first.
Permission or not, your junk has put him in a trick bag.

Looks like they gotcha over a barrel unless you move that container
overnight. Did they serve you with any paperwork? Here in nevada
they have to serve you with an official notice stating the ordenance
number you violated in wrighting stating you have xx days to clean
up the property. If you don't comply the cleaning crew shows up
and does its thing, then they put a lein on the property to make shure
they collect with interest.

It's a fucking dump. Shitty looking double wides. Trashy looking
trailers and storage containers. Crappy looking, collapsing fences.
Trashed empty lots. Not a bit of green grass anywhere. Definately a
lower class neighborhood. Definately a shit hole.

Worthless stuff? Cites? Be specific. What is your estimate of a
5x10 Brunswick "Admiral" snooker table, with new felt, new pockets,
snooker and 8 ball sets, etc etc?

Tig welder? Airco 250 Squarewave, on a custom cart, with Bernard
water chiller, new WP 120 torch and all the accessories? How much is
it worth? Lets see if you know anything.

220/440 3ph transformers...45kva What are they worth?

Victor copy of the Hardinge DV-59, complete and tuned. Turret, cross
slide, coolant and 100 lbs ot tooling for it? Nice paint too. How
much?

Oster pipe threader on cart, with all dies from 1/4-20 -3" pipe? Gimme
your best price estimate.

Airco PhaseArch 350 Mig, complete and ready to go, in nice cosmetic
condition...but its 3ph. Whats it worth? Hummm?

All that and more are in that container. Along with a years supply of
oats/rice/dried beans, 250 lbs of canned salt, 20 lbs of pepper etc
etc ...all in #10 cans from an LDS cannery. Probably 150 cans in
crates. Best estimate is? Do try your best jizzlips. Please.

Taft might be a "shithole" but from the pictures, Gunner's little

It isn't. I've driven by it. It really is a shithole - dead vehicles
in the front yard, a leaky boat that hasn't been moved in years, weeds.
Don't forget the inch-wide cracks in the street up and down the block.

Gunner, if you do not know the law and cannot afford lawyers, you
cannot fight this. I suggest to comply. I would move what I can to my
property, and call in scrappers and get as much scrap value as
possible in exchange for speedy removal.

Scrappers, like vultures, like those forced divestiture situations.

The cracks in the street are not his doing or his problem. That's
just Taft. And I'll bet from the far side of the continent, there are
not many better maintained homes/buildings on the block, or for
several blocks in either direction. It IS Taft. Could likely buy half
of the properties in the town for back taxes, or less.

No, they weren't. These two separate bills:

http://www.kcttc.co.kern.ca.us/Payment/ATNDetails.aspx?NUMBER=03930304002&NUM_TYPE=AT&YR=C

show that a total of $610.58 was due and - miraculously - paid since
December. Of course, one payment for $124.31 was six days late.

Why did you lie and say your property taxes are only $250 per year when
public records clearly show that they're more than twice that amount,

Being a pack rat myself (though you have me beat on that by a mile), I feel your pain. so here's some serious advice from someone who has had a LOT of experience dealing with the local and county government (though not about my junk collection):

1) Phone messages are completely useless in a case like this. Any communication you have with the department should be by certified mail, return receipt requested. It only costs a couple of bucks, but it makes sure that your piece of paper gets into someone's hands. For an additional fee, you can add "deliver to addressee only" which makes sure it gets into your "target's" hands and not into some file clerk's. There are links on the usps.gov web site to https://click2mail.com/?USPS=1 (a usps contractor) where you can actually type and mail the letter online and you actually get a bulk discount on the postage.

2) If you're on reasonable good terms with most of the neighbors, circulate a petition having them ask the authorities to give you the extra time you need.

3) Get involved. If you live in an R-1 zone and you think it should be zoned differently, do something about it. Again, if your neighbors are in favor, it makes a big difference if you show up at a council / freeholders/ whatever they call it there meeting with a well-reasoned and well-documented plan. This may be easier or harder than you think, Talk to elected officials and see what advice they can give. But always remember, Democracy is NOT a spectator sport. We all know you have your opinions, but what do you actually do, other than preach to the choir in rcm? Go to meetings, run for office, volunteer your time to help with some civic project (I just saved my town $40,000 in electronics repairs). DO something.

So, while they do have the law on their side (the zoning is what the zoning has always been), you can have public opinion on your side, and except in the case of the most corrupt politicians, public opinion = votes = their paycheck and you'd be surprised at just how much power a few people can muster. If all else fails, there is always armed insurrection ;-)

When I bought my house in 1984, I asked my lawyer (who was then also my mayor and later my congressman) if there was any problem with me running my business from my house. He said that even though it violates the zoning regulations, there wouldn't be a problem unless a neighbor complained. 29 years later, and I'm still here. Of course, I suppose, if I pissed off the wrong people enough, I could have a problem. But 29 years, same location.

Nobody working for his county is going to give a rat's ass about
complaints from someone with Gunner's record of thumbing his nose at
tax bills.

>2) If you're on reasonable good terms with most of the neighbors, circulate a petition having
> them ask the authorities to give you the extra time you need.

He has something like 8 dogs living outdoors in cages. Somebody who
visited him reported that the barking is severe. Therefore, it's
highly unlikely that Gunner's neighbors support him, and in fact, his
current problem started with a neighbor's complaint about Gunner's
dogs.

Don’t do the selective enforcement deal.
All that will accomplish is getting a bunch of people that weren’t
dicks into the same bind that gunner got into by being a dick.

I’m surprised that they didn’t just take the entire place over back
taxes.

As to moving stuff out of a conex with a back hoe, it is the only way
we did it on a job.
We had back hoes and didn’t rent a fork lift for just one day to pull
pallets.
Hook a chain to the pallet, threw the holes and onto a bar, pipe, or
bean running across the back of the pallet so that you pull the beam
with the chain and the pallet slides along the floor down the ramp you
build out of the crap you have and out the door.

As to buying when broke, that is just standard thinking with gunner.
Don’t pay your bills, just buy more stuff that you don’t need.

As far as the leans on the property being more then they are worth,
they already are with the back taxes.
This will likely end in jail time if he doesn’t pay or play right.
And being broke we know that pay and play right are both out of reach.

As far as getting the news involved, that will likely back fire
considering the way the place looks and the reputation that he has.
It will likely make the LEO pissed off at him for trying a end run
around and the news guys will likely report it as him cleaning up his
meth house is a good thing.

As far as the taxes being paid now, it doesn’t put one in good
standing when the refuse to pay any property taxes at all until they
put a lean on the place.
Any future involvement will be tainted by the previous total lack of
cooperation without being forced.

Looks like there is gonna be more paperwork heading your way.
As Paul Dickman said just ask for and extension, and get it done.

Did you check how much the daily fine is?

Get the back hoe out dig a hole. Push container into the hole.
Cover the container with dirt. Build an entrance, call it a storm
shelter. Out of sight, out of mind when it comes to inspectors.
Make shure its on your property.

No one goes to jail for delinquent property taxes. The property might
be seized and sold at auction, though.

Someday, some way, gummer will end up in jail, but it will have to be
for something else.

I do like that idea, especially in light of this week's tornadoes. One thing I would add is that Gunner could get an "emergency" building permit for the shelter, just to keep it on the up & up. Tell the permit people he's worried that global warming will bring tornadoes to his neck of the desert.

Cut ports (doors ) in the top of the container, then later use chains & bars to hook up the backhoe and lift the pallets out.

What about unpaid fines due to failing to clean up his place?
Won’t that eventually put one in jail for failing to pay a ticket?

Gunner:

I'm sorry, I must have misunderstood. I thought you were under severe time constraints to move the container off the vacant lot. I figured you could go to the back of some markets and get a bunch of cardboard boxes, tape them closed, and use them as sort of like packing material for the items inside the container, then just move the container over to your own property. That should give you some breathing room to dispose of the items IN the container, and the container itself.
A motor home, even with a non-functioning transmission, is an easier item to move.

Bullshit. You haven't had the money to make payments, and the site is
kept current.

But yesterday, you said you were "nearly current" on your taxes:

Funny..Im nearly current on my taxes.

http://groups.google.com/group/rec.crafts.metalworking/msg/4e32e074b464eb84?hl=en

By your own (false) admission, you still owe more than half of what that
Kern County Tax Collector site shows. That's hardly being "nearly current."

Once again, you lied, and once again - as always - you got caught.

Actually he wrote "She claims that cargo containers
are a "no no" here in the unencorporated part of the county (dispite
them being all over the place) . So I had 7 days to pull it out. "

1. containers are a no no
2. 7 days to pull "it" out.

"It" can not refer to anything but the containers. From the counties
point of view, if the problem is the container, what do they care
what's in it?

Yup. And he's making another shitty choice right now. Instead of
scrapping his hoard of crap as Ig advised, Gunner will probably keep
procrastinating. First there will be fines at a per day rate. Then the
county will haul the container to an impound yard, and the rent clock
will start running. Gunner will whine up a pity storm, swear he's
working on raising bail, but in the end the county will liquidate the
crap and send Gunner a huge bill for fines, fees, hauling and storage.
Basically a replay of the unpaid taxes scenario from '94 onward - very
small bills that cost less than smoking, yet Gunner made the shitty
decision not to pay. Instead he now owes an average of a grand per
year, which keeps rising.
