One of the serious presidential candidates that is leading the pack is
Billionaire on Paper Donald Trump who is ranting and raving about a
birth certificate that Obama has produced for the public. In other
parts of the party they are ranting and raving about providing
contraceptive devices for women that are sexually active, this would
actually reduce abortions. Some of the radical republicans also want to
do away with biology and evolution then teach school children some wild
tale that God created Adam & Eve in the Garden of Eden, then were
talked into eating some forbidden fruit by a talking serpent and
ruining it all for the rest of his. I guess Jehovah was into welfare as
long as you lived by his rules.
In Florida they have passed some drug law testing requirement so
single women with kids have to pay $75 to get $50 worth of food stamps.
It won't be long before the State will require all licensed drivers to
do the same drugs test yearly for the privilege to have a drivers
license.
In Wisconsin despite the fact that the financial woes are caused by
Medicaid and education costs Republicans are against employees having
collective bargaining rights, the freedom of association is wrong in
the Republican eyes.

Live Birth" and NOT a photocopy of an original "Certificate of Live Birth."

The latter is acceptable, the former is NOT.

The former may get you a driver license (even illegals can get 'em), but
it is NOT good enough for the public servant office of president.

So each person decides for himself what he wants the constitution to
mean? That is beyond silly. "Your honor, in my mind the right to

But "original meaning" is fraught with problems - not the least of which
is -whose- original meaning. The original constitution was authored and
approved by fifty-some delegates to the constitutional convention and
ratified by a thousand or so delegates to the conventions in the various
states. The various amendments were authored and approved by even
greater numbers in the congress and in the various state legislatures
and conventions*.

When the constitution speaks to "unreasonable searches and seizures",
just whose definition of "unreasonable" should we adopt? I'm sure each
of the two thousand or so folks involved in adding that phraseology to
the constitution had their own idiosyncratic views on just what is or is
not "unreasonable".

What guidance does "original meaning" provide there?

*I believe only the 21st amendment was ratified by state conventions
rather than by state legislatures.

Not each person, but each generation. Again "reasonable" is an important
concept.

There is no way to tell what people were really thinking in 1787. Our
brains have shrunk too much in the intervening years to be able to grasp
the complex issues.

Seldom a problem. There is lots of documentation about what legal
words meant at that time. We're not talking about what Madison or
Franklin thought the words meant but about their generally accepted
meaning in 1787. For example, clearly public use did not mean
whatever public purpose some official decided he wanted to meet.

English common law at the time would define the term since that is
what they were basing it on. In addition the forth amendment

Balderdash! Do you want a contract you signed to change with time,
without your approval? The constitution is effectively a contract and
contracts must mean what they meant at the time of acceptance unless
all parties thereto agree to the changes.

Well, no. The Federalist papers are the thoughts of only two of the
fifty some convention delegates (Jay wasn't even at Philadelphis)

And ignoring the fact that the authors of the Federalist Papers left
many meanings unaddressed, they are no help at all on any of the
subsequent amendments.

Yeah, truth can be stranger than fiction. When Hawaii became a state,
laws concerning birth certificates became VERY lax (well, they were lax
to begin with, to be truthful.) The most important goal were as many
citizens of Hawaii as possible ... influence with house and senate
representatives, population numbers which qualified for various forms of
"federal aid" and assistance, etc. were STRONG motivators ... those
unfamiliar with Hawaiis' history would/will need some time to review it
all ...
