Any suggestions on a property issue?

My house..and the empty lot next door.

I am in negotiations with the owner to purchase the empty lot.

However...it would appear that in 2011 I pissed off a fellow down the
street over a dog issue..that my dog wasnt even involved in. So he
made a complaint with the county. I was notified by the inspector of
it in 2011..and told to keep it cleaned up etc and nothing more was
said.

Suddenly..on May 10..I get a 7 day warning from the county. New lady
inspector..who has little empathy. She claims that cargo containers
are a "no no" here in the unencorporated part of the county (dispite
them being all over the place) . So I had 7 days to pull it out. So I
mowed, cleaned the lot again, removed a boat and a trailer and put it
as the photos show.

She said I was "illegally dumping"..despite having the owners
permission. So this morning..she shows up with 2 deputies and advises
me that I have until 2pm Wed afternoon (24 hrs) to clean the lot off
else Id be cited for "illegally dumping" and the county would clean
off the lot.

Im scrambling to find a place to put the cargo container...but the
forklift is still down, Ive got ZERO money to move it or to fix the
forklift.

I called and left a message with the supervisor and one with her that
Im working on it..but need 30 days.

Now what are my options?

In a dying area where there are more empty lots with for sale then
Carter has pills. The last photo is of a typical lot in the area.

When you talk to the supervisor, if they aren't agreeable to 30 days,
request they cite the section of the municipal code you are supposedly
violating. Actually, ask they cite it anyway, so that you can make sure you
don't violate it again.

In reality, if they can't cite it, they can't enforce it.

Also, see if there's a way you can get a permit for it.

If none of that works, you may be able to file a complaint for selective
enforcement. You can take snapshots of the neighborhood, as well as
printouts of Google Maps, to support your claim.

You really don't want to go to war with the county. You will lose.
However, government worker types tend to be a bit paranoid about their jobs,
and if their boss gets annoyed over their actions, those actions will stop.
After all, they're pretty much just there for a paycheck, and don't care one
wit about your container. The last thing they want to do is more work.

Last resort, go to court and file a request for a stay of action. It
shouldn't be too much trouble requesting a fee waiver.

Second last resort, cover it with tarps and call it an RV. If they come on
to your property and look under the tarps without your permission, you'll
have cause for a civil rights lawsuit, after which you can buy half the
county.

The code they gave me was "dumping trash"..and its obviously not
trash. They use it evidently as a catch all.

I may have to do that. She (inspector) claims to have 300+ issues for
those around the area...backlogged and trying to look good for her
boss. Ive tried to work nicely with her and have been eversohelpful.

It isn't. I've driven by it. It really is a shithole - dead vehicles

The cracks in the street are not his doing or his problem. That's
just Taft. And I'll bet from the far side of the continent, there are
not many better maintained homes/buildings on the block, or for
several blocks in either direction. It IS Taft. Could likely buy half

In a way, they are. The fact that the entire block is full of dole

Don’t do the selective enforcement deal.
All that will accomplish is getting a bunch of people that weren’t
dicks into the same bind that gunner got into by being a dick.

I’m surprised that they didn’t just take the entire place over back
taxes.

As to moving stuff out of a conex with a back hoe, it is the only way
we did it on a job.
We had back hoes and didn’t rent a fork lift for just one day to pull
pallets.
Hook a chain to the pallet, threw the holes and onto a bar, pipe, or
bean running across the back of the pallet so that you pull the beam
with the chain and the pallet slides along the floor down the ramp you
build out of the crap you have and out the door.

As to buying when broke, that is just standard thinking with gunner.
Don’t pay your bills, just buy more stuff that you don’t need.

As far as the leans on the property being more then they are worth,
they already are with the back taxes.
This will likely end in jail time if he doesn’t pay or play right.
And being broke we know that pay and play right are both out of reach.

As far as getting the news involved, that will likely back fire
considering the way the place looks and the reputation that he has.
It will likely make the LEO pissed off at him for trying a end run
around and the news guys will likely report it as him cleaning up his
meth house is a good thing.

As far as the taxes being paid now, it doesn’t put one in good
standing when the refuse to pay any property taxes at all until they
put a lean on the place.
Any future involvement will be tainted by the previous total lack of
cooperation without being forced.

This sort of thing isn’t typically from a professional developer.
It is over some dick that has 0 respect for the rights of his
neighbors.
They build a fence on their opinion of the property line and act like
they have no reason to even consult you as to your opinion of the
unmarked property line.
They drop a conex on your property without asking and tell others that
it is their land.
They remove property markers so that you have to pay to have it
surveyed so that you can take them to court.
They let biting dogs run free and then bitch if you defend yourself
against the attacking dog and it dies.
They put their septic tank on the neighbors land that is not watched
enough to catch them in the act.
They let their raw sewage run off their land and onto the neighbors
land.

I’ve ran into some of it personally.
There is no limit as to how low some people will go in attempting to
take what is not there’s and even act as if they deserve it somehow.

No one goes to jail for delinquent property taxes. The property might
be seized and sold at auction, though.

Someday, some way, gummer will end up in jail, but it will have to be
for something else.

What about unpaid fines due to failing to clean up his place?
Won’t that eventually put one in jail for failing to pay a ticket?

Not legally.
But the problem with septic tanks is that once it is under ground for
a few months in the summer, it is nearly impossible to find by eye.
You have to use equipment to find it.

One trouble that I have found is that due to the way the land perks,
you don’t have enough land to put your septic system on and no
adjoining land for sale.

Another trick is land locked land.
It takes quite a fight to force a land owner to let you cross his land
to get to your land and even if you win you don’t get to pick where
you are allowed to build your road at your expense.

Both of the above is a way to sell your land without losing the use of
it or risking having new neighbors.

Yup. And he's making another shitty choice right now. Instead of
scrapping his hoard of crap as Ig advised, Gunner will probably keep
procrastinating. First there will be fines at a per day rate. Then the
county will haul the container to an impound yard, and the rent clock
will start running. Gunner will whine up a pity storm, swear he's
working on raising bail, but in the end the county will liquidate the
crap and send Gunner a huge bill for fines, fees, hauling and storage.
Basically a replay of the unpaid taxes scenario from '94 onward - very
small bills that cost less than smoking, yet Gunner made the shitty
decision not to pay. Instead he now owes an average of a grand per
year, which keeps rising.

Which is why I work in LA. Did some trading today at the local
Goodyear tire dealer. Traded some electrical work for a pair of new
tires (5.70x8) to put on the Hobi Cat. At the end ot the day..he had
brought in $87.13 net.

Some days he makes more..but thats been the low average for about the
last yr. I dont know how he can stay open, frankly. He has to pay
the utilities and expenses out of that $87.13

He sells far more used tires than new ones these days.

So I do 3 hours work, get 2 new tires..and Im giving them away along
with the boat. Something wrong with that......

Sell him the container for a nominal sum but NOT the contents. Arrange a
rental/lease to own type deal where you pay him monthly for "storage
fees" that go toward the purchase of the property.

If the problem is the container itself ask them for a description of
EXACTLY what is wrong and see if you could do something like cut a hole
in the side for a door or something else that changes the problem. I
know around here they don't like containers IF they are just dropped in
place, but if you add a lean-to or something where it looks different
then it's OK. Why ?????? Bureaucratic thinking I guess.

Read the damn zoning code, it's online.

Cargo containers are permitted "by right" as an accessory structure in the
A, A-1, NR, M-1,
M-2, and M-3 Districts. Cargo containers require approval of a conditional
use permit in the
E, R-1, C-2 and RF Districts. Cargo containers, where permitted, shall not
be used for human
occupancy. Signs shall not be permitted on, or attached to, cargo

Cargo containers,
where permitted, shall not be stacked. Cargo containers shall also be
permitted in any zone
district in conjunction with an authorized construction project. Except for

Cargo containers are not allowed in an R-1 except with approval of a
conditional use permit.

You can try to get a conditional use permit, but I think the ship has
already sailed on this one.
You can try to get rezoned to manufacturing or ag. Good luck.
You can move it to some farm or factory.
or you can keep stacking up fines.

He sure didn’t spend it on his house or transportation.

He sold his motor home, or rather let it go because he was too lazy to
move it from the storage that he wouldn’t pay rent on.
He could have used that to move any time he wanted.

I personally have repeatedly offered to hook him up with the local
machine shops to get him work if he would bring his lazy ass here.
He said that the humidity was the problem with working in Oklahoma,
but all the rest of us work here and the shops are air conditioned so
I don’t see how that would be justification for staying unemployed.

We aren’t talking about someone that was a burger flipper for most of
their lives.
Then again, with his constant lying, maybe we are.

When you can’t pay your own bills, it would be more productive to have
sold the boat and tires for anything more than $0.

Are you saying that you own a boat that is worthless?
I thought that you said that it was aluminum?
Isn’t that going for around $1.50 a pound now days?
So, a 2 hundred pound boat would net you around $200 after gas and
such provided that you drag it to the scrap yard yourself.
Fill it up with more of the metallic trash in your yard and you do
even better.

You have tires under it now, and apparently it is on a trailer so only
laziness and stupidity stops you from selling it for more than $0.

Crags list is even a better choice for selling a running boat and
motor, provide that you weren’t lying about it being usable.

litle small person crewed boat..or a single adult. I picked it up at
the Goodwill vehicle sale yard about 6 yrs ago for hmmmm $150 and have
sailed it rather extensivly in the local lakes. Fun little boat. When
I get the FJ that is mine..I traded for it...Ill put the AMF up for
sale for a couple hundred and use the 15' Flying Junior as my play
boat. Its a hottie when single handed.

I dont recall the last time I owned an aluminum boat..sometime in the
80s as I recall. 16' fishing boat with a 50 hp Evinrude on it, that
Id extensively rigged up for tournement fishing. Sold it to a
friend..who never paid me for it..and I got a notice 3 yrs later that
it was found in a commerical parking lot somewhere. Couldnt find the
guy, got the boat back and promptly sold it for a few hundred just to
be done with it. He had blown the engine and ripped out all the bass
fishing mods including the electroncs..the bastard.

Cant remember the name of it..I know I chatted about it before, here.

What is the survival issue? One way to put it is Relying on friends,
neighbors, relatives. We do this and feel a warm spot about trust and
depending on people's goodness, maybe like the idea that it's only
money and material things are not important in the general scheme of
things. But come survival time, where are your resources? What kind
of responsible use of resources are we working with here?

Typically, a neighbor borrows something, again and again, then you get
used to it being in his garage. You loan someone your car, and
something bad happens. You loan something to someone, that person
then thinks it's okay to loan it to someone. "Nice guys come in
last."

Maybe I'm off base about this kind of thing--burned me up when I had a
bicycle that I let a friend use one summer while she rented my
cottage, then found that she would leave it at a boyfriends place,
where he and his friends used it. She then came to me to ask where it
was so she could use it again.

Of course, I'm thinking of survival as a life-style, where you try to
manage everything in a consistent way, so as to allow you control of
your resources and build networks. I bet those religious communities,
like the Mormans and Amish, Jewish Kibbutz, and communes are not all
about indiscriminate loaning and sharing.

In a SHTF situation, I assume you are either 1) on your own, or 2)
with a group, or maybe at least communicating with a network. But do
you have a firm policy about sharing your resources? Is it a matter
of To each according to his need, from each according to his ability?
Trading, where you go quid pro quo?

Truth is, I get a warm feeling about giving people what they NEED.
Bought a set of drawers at the thrift shop for $0.50 (unbelievable)
and was cleaning it outdoors, when a gal came up and said, "I need
that." Sold it to her for $0.50 and loaded it into the back of her
station wagon and felt good--until she threw the amount of change I
gave her from $1 on the ground. I don't know, some kind of psychology

I've had poor results with loaning things out.
I'm to the point of loaning only if I can afford
to have the item disappear, or not be returned
at all. As one person wrote (probably on this
list), don't loan stuff out. Give it away, and
be pleasantly surprised if it comes back.

When I moved fom NH I pared down my possessions to what could fit into a
pickup truck. I noticed a certain degree of suspicion when I tried to give
something like a microwave to an aquaintance. "What's the catch?" I finally
gave up and just put the stuff on the sidewalk, or in the case of my boat,
on the beach above the high tide line. People seem to be more willing to
cart off 'free' stuff where there's no face to face interaction.

I was on the local list but they changed the format and I didn't follow it.
My one interaction was with a woman asking for a Gameboy for her son. I
