Motion:  Move that the LNC honor the status quo and continue to recognize Jay Sorensen and his cohort as the officers of the Libertarian Party of Idaho Until such time as the LNC receives and reviews a decision from the Idaho JC on this matter.

 

(Full text of request in request: It has come to my attention that there is a controversial situation unfolding in Idaho. There was an alleged improper mass removal of all board officers including the chair during a proceeding that allegedly lacked due process and proper notice.

As I understand it, this matter will be taken up by the Idaho Judicial Committee. Until such time as the LNC receives and reviews a decision from the Idaho JC on this matter, I move that the LNC honor the status quo and continue to recognize Jay Sorensen and his cohort as the officers of the Libertarian Party of Idaho.)

They represent the current understanding of the Idaho situation from the
Executive Board of the Libertarian Party of Idaho, as it was elected at
our most recent convention in March of 2024. I apologize for any typos,
this was compiled in haste to help give the LNC as much understanding as
we're able to provide. The Bylaws, Convention Rules, and Judicial
Committee Appellate procedure document is in Markdown format, and
represents the current state of the bylaws. They are different in only
one respect from the 2023 Bylaws that can be found at lpid.org; a clause
was moved in the discussion of email ballots to make it clearer that
they may be closed early when all LPID ExBoard members have voted.

Yes thank you Adam.  After their JC gives us their analysis, I maintain status quo is least disruptive and "dramatic" in an election year and is supported by both primary representatives in Idaho's region.

I spoke briefly with their Secretary, they are receiving professional advice and going with their Judicial Committee- these decisions and filings do not happen over night but we will have their analysis and can choose to have a meeting afterwards which is EXACTLY how this was handled last time- status quo-JC-followed JC determination after examination in meeting.

I am skimming through the documents provided; however, I still have a lot of questions and not enough information to move forward on a vote. 

This really should have been an emergency meeting or should have waited until the next meeting, at the very least an informal discussion before taking it to a vote.

Getting into the business of recognizing state affiliates boards is serious business. The only benefit of recognizing one board over another is to provide documents for the bank, state, or other body if their own corporate documents aren't sufficient. That is a serious decision if there is a schism obviously.

What is the region rep doing to monitor and assess the situation? Is there any room for rectification? Has the states JC or our JC met on this issue? What is the timeline for a JC decision? Has the board of either affiliate requested anything from us other than this motion or do they plan to? Is the state seeking ballot access funding and will this interfere with those efforts? I have questions as to the timeline of events.

I am sure I can think of more questions. 

As such I will be holding my vote until such a time that I can feel confident in casting it.

As tempted as I am to wade in here and start throwing my opinion around, I’m thinking waiting for the JC to issue an opinion would be preferable. 

I made the motion because I felt we needed a stop-gap action rather than a void in the interim. 

Naturally, we could also move to reverse course should that be warranted. 

But I doubt that we will. We’ve seen these kinds of “moves” often in the recent past. The status quo deserves our recognition, in my opinion.

The matter is being reviewed by their JC.    I don't have a timeline but the regional reps can inquire.  They are not seeking ballot access funding but not having stability can interfere with their current ballot access but has not so far.

Dear Colleagues,

After doing a deep dive into the situation here are my findings. Idaho has a highly unorthodox way of doing state board elections involving precinct committee members, these elections are held every two years and the elected get to decide the makeup of entire state boards. My understanding is that for decades the LPID had not used this system as a gentlemen's agreement and has instead opted to do things at convention, however, legally, anyone willing to take advantage of this system has the legal authority to designate the board. Typically, these precinct members numbers are very high (in other partys), but it only takes one person getting elected to decide the board, and they only need 5 votes within their precinct to be eligible.

My understanding is that two years ago this exact method was used to elect the board that has served the past two years. Furthermore, members of that same board have engaged in the precinct system this year but did not get the requisite 5 votes therefore were not represented. 

My understanding is that the election which took place this year at convention, just as it did two years ago, elected a board and the activation of the precinct system overruled those results. Keep in mind the precinct system is a state invention and has legal authority. There is precedent that this system was used previously and is now being used again.

As such, it is my opinion that the affiliate needs to reinforce its bylaws or change the law within Idaho to remove this system. Because precedent has already been established I do believe that the election was valid.

Therefore I will be voting NO on this motion.

I do invite my colleagues to find fault in my facts & reasoning, which is why this should have been a discussion before a vote.

The fault in the reasoning is that our precedent is to allow time for their JC to review which may come to the same conclusions as you did.  I believe in this tumultuous climate to allow them to do that, a process that the secretary of state agreed with.  Your vote, respectfully, interjects unneeded chaos.  I urge everyone to give their JC time to review.

Thank you.  And I believe Mr. Nekhaila is inadvertently misstating a bit of what happened two years ago which – at least in part – had to deal with reverting to an old board due to some alleged requirement to have a convention at a certain point in time, and certain bylaws changes took place in the meantime.  With all due respect, I spent about 80 hours sussing that out back then and find it difficult to believe that any of us,  can figure out what is going on in a few days.  I do think the Idaho JC in a much better position to determine that and then we can have a good summary by what they say – which by the way – may be in complete agreement with Mr. Nekhaila’s conclusions.  Its been a long time since I have reviewed Idaho.  I know that the current board controls all the assets and promptly notified the Secretary of State of the dispute and that they were internally handling.  It seems beyond reckless to me to not recognize and let that process play out.   The alleged one elected PCM is a friend of mine.  As is the current Chair Mr. Sorensen.  I have no dog in this fight except not to have drama.

 

And IF both WE and the ID JC make the wrong decision, there is recourse to the national JC (sorry guys).

Two pieces of information regarding the Idaho situation: 

  1. I also heard that their JC took up the case yesterday. The current chair said he thought their decision wasn't going to come super-quickly. Other than that, I have no clue about when to expect a decision.
  2. I received the following from LPID Secretary, Matt Loesby. The TL/DR version is he believes that Mr. Nekhaila got a couple things wrong in the analysis he provided with his "No" vote:

From Matt: "Reading this thread, I was saddened to see Mr. Nekhaila make a decision based on several mistakes of fact.

In 2022, the LPID held a state convention. Then, following the National Convention in Reno, two officers of the board, who had control of the party's assets, unilaterally removed 3 members of the board and replaced then with people who had held positions on the previous board, using reasoning which was absurd on its face.

At the time, the only way to elect members of the State Central Committee was to win the 5-vote minimum primary election for Precinct Committeeman. We were lucky that Todd Corsetti had done so. He was the first person ever to gain a position on the State Central Committee.

Since then, not only has Todd remained in his elected position as Bannock Central Committee Chair, keeping him on the State Central Committee, but we introduced into our bylaws another way (as allowed by statute) to fill the County Central Committee Chair position when vacant: an election by the party members in that county. This has been done in several counties. By my count as party secretary, which I expect the JC will confirm, there are 8 members of the State Central Committee, not counting Mr. or Ms. Luoma.

The State Central Committee can suspend officers by a 2/3 vote at a properly noticed meeting, under the standard RONR rules of due process (notifying the subject of the discipline, offering them a chance to answer complaints, etc). In 2022, this process was followed by the unfortunately small State Central Committee. In 2024, no notice has been given to any member or officer of the State Central Committee, to my knowledge as state party secretary.

The SCC doesn't get to decide who's on the board unilaterally, nor to override the results of our conventions. The SCC can suspend a misbehaving officer, who has the opportunity to appeal. The JC will not uphold a causeless suspension, if appealed.

I believe these details are what Mr. Nekhaila is missing or misunderstanding, that have led him to vote in a way that I think he will come to believe was incorrect."

I am going to remain very brief, and I hesitated to say anything more but I vividly remember the situation last time.  Idaho was region 0, and then Vice-Chair Smith kindly got a basic timeline together.  I saw this was complex, and like me doing math (inside joke that Mr. Redpath witnesssed live at a BAC meeting) that this was not an area most LNC members would be conversant in- the intersection of law and parliamentary procedure/bylaws.  While I'm not an attorney, I am a paralegal, and layman are allowed to read the law- I also know the latter.  With all due respect to any other LNC member, there is no way, none, that anyone could have taken a few hours to look at this and come away with ANY solid conclusion.  It took me over 80 hours several years ago, and I'm aware that they fixed several of those issues

In my opinion, and not meaning ANY disrespect, particularly toward persons I've worked with now for nearly a decade, status quo is, imho, the only responsible decision and it is supported by the regional representatives for Idaho (they are no longer region 0, and those events of 2022 are one reason why- they wanted dedicated representation - no shade on the former Vice Chair - that role has other responsibilities).

After we have documentation, and a JC opinion, we will have a meeting.  Of that I am sure.
