Mr. Malagon is not challenging a state delegation. He has challenged one delegate and any credentials committee member may do so, in fact, when credentialling in making a determination that someone is not eligible, that is what is being done. This was done before any determination was made.
I can imagine what it is but one motion can be dependent on another. If the earlier does not pass, this one becomes moot by nature. It is not out of order. You can have two motions at the same time, one to accept a resignation, and one to appoint someone to a position. If the resignation is not accepted, the other motion becomes impossible and is simply moot.
Additionally, even if one were to say that were not the case, it is easily cured by simply starting a new ballot on the fully sponsored motion to expire one day later.
I look forward to the ruling of the Chair.

I will note this. I would ask the chair to not entertain the appeal as dilatory. Why? Let’s say Mr. Tuniewicz got three co-sponsors by tomorrow. Even today. With a seven day email ballot it would expire after the last credentials committee meeting. It is futile and dilatory. And I request the Chair to not entertain it. But even if she does, it in reality makes no difference. The motion is ruled in order and will take effect or not effect when it ends depending on the votes.

Of course. But if the motion passes, the positions change, the appeal cannot be heard in time to overturn. An in-order motion comes into effect upon passage. Presently the motion is in order. If the motion does not pass, the appeal is moot in practice.
Now on to a more esoteric note. Of course it doesn’t stop work from being done on the Committee. But a good chunk of us on the LNC are in fact stopped from doing other work by attending to a futile motion, particularly the Party Secretary.

I believe this motion is out of order after re-reading associated bylaws and policy in spite of chairs rulings. In addition, Mr. Malagon left a committee for being unable to attend, so he is unable to perform duties in the upcoming week.
