·         The requirement of filing declaration by a company before commencement of business or exercising its borrowing powers has been dispensed with under the Companies (Amendment) Act, 2015. Accordingly companies are no longer required to file e-form INC-21 with the Registrar through MCA portal.

Dear Nareshji,

That was the only ambiguity which has now been cleared by MCA Notice.

Entire Sec. 11 is deleted with effect from 29-May-15. You may please refer Sec. 4 of the Companies (Amendment) Act, 2015 and MCA Notification dt. 29-May-15.

But it says "it shall come into force from the date of publication in official gazette" and the heading also says "To be published in official gazette",so my question is as these are not published till now in official e-gazette,so whether these amendements are applicable or not? I have some confusion that's why I am asking.Please reply.
