Filing of CHG-1

Whether Form CHG-1 is required to be filed relating to availment of car loan Where Charge is created by way of Hypothetication ..... Where no collateral security has been provided........

Please read Section 77 of the Companies Act, 2013. It refers to charge within or outside India on its property or assets or any of its undertakings, whether tangible or otherwise and situated in or outside India.

Section 77 says that charge on its property or assets or any of its undertaking 

but we are not providing any of company property or asset whether tangible or intangible.

The other party has no right on any of our asset and even if company make default then other party can only apply to court against us not prove its ownership on car or any of company asset.

Please guide and correct me if i am wrong.

if the lender insist for creation of charge then its required... if he is not asking for charge creation then not required..
