I have filed name reservation application using RUN service and the same has been rejected on an illogical ground that proposed name resemble to an existing company. can any one pls share his/her experience of raising ticket against that name rejection. whether it really works or we have to apply with new name.

I have talked to MCA helpdesk.. they said whether u apply through RUN or SPICE route all applications relating to name approval and Incorporation will be dealt by CRC only.. respective ROC has no role in this.. and they said only thing u can do against rejection is raise ticket on MCA.

Correct. RUN and spice handled by CRC only. We got incorporation certificate for direct filing of Spice, Singed by CRC official on behalf of respective roc.

So there is no truth in rumor that power has been vested in respective roc for incorporation of the company.

I faced same issue regarding RUN.It was name approval for forming subsidiary of holding foreign company.I had attached notarised noc as we wanted same name as holding company ,also there is a rule that foreign companies forming subsidiary in India can be given same name.still the application was rejected stating proposed name resemble to existing company

I called call centre they said to raise ticket,am awaiting their revert.

Raising ticket will also not work as they will give Diplomatic Answer that “The Form was process in accordance with the applicable Rules and provisions of the Companies Act.”

 

Further, I’ve also faced rejection of name which is 100% available by mentioning the reason that ‘Name is too general”.

 

Friends, we have to appraise this issue to MCA officials and to our institute to take appropriate action on this burning issue……

We have Apply for Company name with search and check on both portal it is available for formation and we search name under class 7 of trade mark that is our company business activates

 

But we have rejection on the ground such name register under class 12 of trademark we don’t understand our company business activates in class-7 then how could reject

 

It is such hopeless system design my MCA and waste of promoter money and Our time.

Agree with all. This is the way of CRC to adjust money against  incorporation fee exempted. Last three days I applied three name and it was rejected showing prefix name registered with trademark...Wah Wah CRC..That means we can not use the prefix also. Met DROC and explained everything, they are also clueless.

Very difficult to incorporate a foreign company as the time also very less to get apostile documents.

If your name application is rejected on illogical grounds and you have a valid reason to prove, then I would suggest raise a ticket, write to CRC at their email crc.esc...@mca.gov.in and also write at email at MCA marking all KVR murti, Shashi Raj Dara, amarjit Singh Bhatia, concerned RoC giving details of your application. Mine was also rejected on baseless grounds and after a bit of running around over email,  reopening of tickets etc. I finally received approval. However, this entire exercise took around one month.

I have applied two name and both are rejected by CRC without any valid ground, unreasonably extended resembleness to reject the proposed names.

CRC is still in 20th century. Bandar ke haath me Talwar de diya.

System need improvement as it is partly online.

It must be made completely online to avoid arbitrary action of CRC . i.e. Automatic online name check by MCA.

I applied three times and name was rejected on the different ground. when they asked for declaration I attach declaration for the same though they rejected on the other ground. after CRC again rejected on the Other Baseless grounds.

They have to mention all reason of rejections at a time as there is no resubmission allowed.

it seems that the Company is incorporated ​on 05.02.2018 as per the Master date of MCA,  I have called CRC people, they are saying that they have technical problem with PAN and TAN,  We have received PAN card also but we have not yet received Certificate of Incorporation.  I am trying to reach the following mail ids also CRC.IN....@mca.gov.in and  crc.esc...@mca.gov.in which were not delivered.

We got Section-8 company name approval on 31st Jan and on 05th Feb we filed INC-12 for License still the form is pending for approval and Today is the last date to file incorporation forms.

I dont know why this Rules framed when they are not approve the forms within the time frame or is RD expecting some thing??

Today I visit ROC Delhi. and to my surprise...My INC-12 is still in QUEUE. it has not been allotted to any person in ROC. Then I contacted ROC, he told me give your SRN to my PA, I will see.

I did the same...
