Subject: We win! Court declares the Kenya-Mauritius Double taxation agreement unconstitutional

Tax Justice Champions,

Great news! TJNA challenged the constitutionality of the Kenya-Mauritius Double Tax Avoidance Agreement (DTAA) signed in May 11, 2012 and the Kenya High court today has declared void and unconstitutional the said DTAA between Kenya and Mauritius. In reading the Judgment, Justice W. Korir granted Tax Justice Network Africa’s (TJNA) submission by declaring void Legal Notice No. 59 of 2014 which renders the Kenya/Mauritius DTAA void and unconstitutional.  Read more on the grounds on which this long-awaited judgement was made in the attached press release and court ruling.

Let’s keep the ball rolling for improved policies and laws that enhance tax revenue mobilisation in Africa!

--

Champions de la justice fiscale,

Excellente nouvelle!

Well done TJN-A for this monumental victory!

It is our wish that this ruling sets a positive precedence in all other jurisdictions that have unfairly crafted DTAs.

Aluta Continua!

Best,

Fred
