searchd not starting

What happens if you start Sphinx manually by running the following within your project's directory:

searchd --config config/production.sphinx.conf

I have this

I do not have the root password and I do not see the process running but it seems to be up, I think they error means that the socket is already in use

You're right about that - there's definitely something already using the socket.

What's the output of the following in your shell:
ps aux | grep searchd

yes I run that command and it is running as root:

root      2001  0.1  0.1  15332  2960 ?        Ssl  May25 133:44 /usr/bin/searchd --nodetach

Okay, well you probably want to kill that process. It doesn't look like it was started by Thinking Sphinx (as it doesn't reference the production.sphinx.conf file).

Once that's no longer running, try the rake task again.
