Our board treasurer just resigned and I've learned that he never
properly filed a 990 during our existence (we got our status in 2009). Due to checking the wrong box when our co-founder did the 501c3 application, I
think we're considered a private foundation and not a public benefit
corp. The treasurer filed a 990 postcard at the beginning of 2011, it was
rejected due to our status, and rather than getting it fixed and
resubmitting, he just decided not to do anything about it.
I'm scared of being personally fined due to his negligence, and more importantly I don't want our theater to fold after 3 successful years of growth. We need to get our status fixed and our forms
for 2010 (and soon 2011) filed. Are there any resources to help
with this? We have a little money in the bank to pay for the work,
but I have no idea how much an accountant would cost.
Any advice or contact names you
could give would be hugely helpful. Do you think we'll need a lawyer
too, or can an accountant get us fixed up?
