D70 bug with time lapse

When I connect my D70 and try to use the Time Lapse function the application takes 100% CPU usage.
The first picture is and the application cycles through the shot count but no further images are taken.

I am using Window 7 64 Bit and have also tried it on a Win 7 32 bit PC

This feature is quite important to me as i plan to use the software in astro-photography.

Nothing relevant in log file, you can try to capture photo using capture button and send/post the logfile again.

ok done a bit of playing found  a couple of scenarios

1 when battery issue occurs all the time

2 setting to jpegs rather that raw seems to cause part solve issue.
could the fact the the D70 doesn't have a fast ccd be relevant?
the other thing is i don't really need the pictures to be brought to the pc at that point can I just have the pictures taken then brought to the PC at a later Stage?

If you edit the current session you have a option "Don't download photos to PC" if you check it, no photos will be transferred, i don't think the ccd speed is relevant

it seems to take the pictures OK with the don't downloads selected, now all i need is a cold cloudless :) 

still see these errors though.
