Sub: Obstruction on footpath & at coach entry gates. 

 

We, sensing that DMRC is neither able to enforce its own rules nor is following law of land had sought following information under RTI from DMRC wide letter no. SKG/DMRC/013:

 

(A)   Recently it has been observed that DMRC is on a drive to install sign boards on footpaths across Delhi to indicate nearest metro train station. There are rules & guidelines which regulate fixing such boards on footpaths so as to protect the rights of pedestrians. However, fixation of some such boards hints that the officer who is supervising the job may not be aware of all the guidelines/laws which regulate such fixation. In this back ground please inform listing of all laws and guidelines were referred to before fixing such boards on footpaths which?

(B)   It has been a common scene on metro station to find people jostling with the door of train and trying to prevent its closure. This act is not only a punishable offense but also delays journey having a whirling impact. Such incidences are in rise. In this back ground please inform

(i)             Besides informing people what else has been done to enforce this regulation? and

(ii)            How many people have been prosecuted for this offense during last 2 months.

 

In response for first query DMRC wide letter no. DMRC/WORKS-.O&M/RTI/2015-16 dated 05 May 2015 has informed that “Boards have been fixed taking in consideration guidelines of IRC and site conditions. However, necessary suggestions a specific locations may please be given as these are informative signages only.”

 

The above reply is a confirmation to the fact that concerned officer is not aware of the rules governing fixation of signages on footpaths. Even as per IRC guidelines the height of signage must leave a clear area of 6 feet from ground level. But at several points you may observe that full footpaths have been blocked. There are following laws relating to erection of a board on footpath, these are:

 

(i)                    section 283 of IPC

(ii)                   section 83 of Delhi Police Act.

(iii)                  Section 320 of DMC Act and

(iv)                  violation of UTTIPEC guidelines.

 

Under no circumstances a board can be fixed on any footpath blocking the way. In any case at least 180 centimeter clear width must be left open and obstruction free while fixing any kind of signage. You can undertake a survey of all your boards to find out many such boards fixed by DMRC are violating norms. DMRC is in good corporate citizen and we expect you to regard the right of pedestrians to walk over footpath. It is requested that all such boards which are hindering pedestrians’ movement may please be removed/relocated at the earliest.

 

 

In response to query (B) DMRC wide letter no. 2015/DMRC/O&M/RTI/5897 dated 30 April 2015 has informed that only 2 people have been punished for such offense in the month of Feb 2015. It is surprising that while the incidents of obstructing metro doors are on rise there is no enforcement to curb this. You can witness people blocking the closing door with use of hand, leg & bag in full public view, their behavior confirms that there is no fear of any punishment.  It is requested that degree of vigilance to catch hold of people committing this offense be increased.
