Dear All,
Dr. Yuan-tsong Chen, an Academia Sinica Fellow and the inventor of a cure for Pompe disease, a rare fatal neuromuscular disorder, was facing investigation Tuesday after being accused of breaking the law regulating government procurement. This is very similar to the case of Dr. Ching Jhy Shieh’s vibration reduction project of Taiwan High Speed Railroad in Tainan Science Park. We should watch out the development of this case.
Dr. Chen was released on bail of NT$600,000 (US$18,764) after being questioned by prosecutors yesterday. For more information regarding this case, Please read the following news.

I was shocked by this case because I heard last year that KMT has been planning to clean up the “Green camp” scientists from Academia Sinica. This definitely a double standards of Taiwan legal system. Dr. Chen owns patents and unique technology around the world in his field. Therefore, this is a sole source procurement. In the other hand, the 詹啟賢 and 台灣生技 during the swine H1N1 flue was a case of breaking the law regulating government procurement. The Taiwan Justice Department did not care about the contract between government and that company at the time. It looks like only KMT can do that. KMT always tricks us with the grey area.

有關生醫所陳垣崇所 長，涉嫌授權專利給自家公司一事，目前各新聞媒體報導的內容，與事實有許多出入。本人為中央研究院生醫所研究員，也曾經擔任行政副所 長一職，茲對該事件容 易衍生誤解之處，作一說明。本文目的非在為陳垣崇所長作辯護，只是希望藉由這些說明，還原事件真相。
首先，先針對這次事件，作一背景說明。據媒體報導，檢察官指控陳垣崇涉嫌違法授權兩項基因篩檢的專利，給自己投資的世基公司，並違法 決標，購入世基公司所 生產的產品。
首先要說明的是該項產品的用途，是用來檢測危險基因標記，現在已知使用某些抗癲癇藥物及血液栓塞藥物華法林，在極少數病人會產生藥物 不良反應，嚴重的甚至 會有生命危險。陳所長的研究證明這些藥物不良反應，和人類某些組織抗原基因有高度的相關性，如果在用藥前確定這些病人是擁有這些高風 險基因，醫師就可以使 用替代藥物，避免這些藥物不良反應。現在的醫院因為並沒有提供這些檢測試劑，所以病人必須要承擔引起藥物不良反應的風險。陳所長的研 究，提供了開發這些檢 驗試劑的基礎，如果能夠成功的推廣到包括台灣及全世界的醫院，將來這些病人在使用這些藥物的時候，可以先要求作基因檢測，降低罹患藥 物不良的風險。
茲針對本次事件外界可能的一些疑慮，說明如下：
1. 陳垣崇所長實驗室 是否必須採購這些試劑？—因為陳垣崇所長實驗室，目 前正在進行相關的人體臨床試驗，證明使用這些試劑，確實可以降低病人罹患藥物不良反應的風險。並證明試劑的準確度以及靈敏度，有了這 些數據，才能取信醫 界，順利的推廣到醫院。
2. 陳垣崇所長是否必須向世基公司採購這些試劑？這 樣的研究是由台灣陳垣 崇所長實驗室獨立研發出來，目前由世基公司生產該試劑，這些試劑希望能夠推廣到全世界的各醫院，但目前還在處於推廣階段，全世界並沒 有第二家公司生產該產 品，所以陳垣崇所長實驗室必須向該公司購買。這和購買一般電腦產品的採購案不一樣，如果是購買電腦產品等有其它替代公司生產類似產 品，依據採購法就必須迴 避向自己親人所開的公司採購，但陳所長目前的採購案並沒有替代品所以必須向世基公司採購。
3. 本次採購是否涉及貪瀆？根據採購法十五條，公 務人員必須迴避與自己職 務相關之採購事項。如果涉及本人、配偶、三親等以內血親或姻親，亦應行迴避。但本法條也有規定，若執行該法條，反不利於公平競爭或公 共利益時，得報請主管 機關核定後免除之。陳所長該項採購案，有其特殊性，除了世基公司外，全世界並沒有第二家公司生產該試劑，和採購一般常見、有替代性的 物品，例如電腦、冷氣 等，並不相同。不能據此推斷他有貪瀆行為。但依據該法條精神，該採購案是需要先報請主管機關核定，此點陳垣崇所長須負行政疏失之責。
4. 陳所長是否有利用職權變更生醫所的採購慣例圖利世基公司？生 醫所行政 採取分工授權，採購案由採購人員經手，最後由行政副所長核定，陳所長並未參與該世基公司的採購或生醫所其它的採購案。
陳所長在國外擁有龐 貝氏症多項專利，開發出治療龐貝氏症的藥物，但將大部分該項專利的獲利，捐給其回國前服務的美國杜克大學，可見其為人對錢看得很淡 泊，而且平常致力於照顧 國內罕見疾病的弱勢病人，常常自掏腰包照顧這些病人，並未有貪瀆事實。希望能藉此說明，還原事實真相，還給陳垣崇所長清白。

中國國民黨對這樣的指控總是 不理不睬 裝聾作啞 視若無睹.

不是說「偵查不公開」嗎？怎麼沸沸揚揚，鬧到全世界都知道了？
有一個法律上的問題請教一下。

中研院生醫所長陳垣崇遭檢方搜索約談，震驚學界。陳院士在研究領域內聲望崇隆，被譽為「每年救活上千新生兒」，同事都說不相信他會涉弊，且擔心國內法令不完備會影響科學發展。 一個人犯罪與否，要讓證據說話，不是過往學術聲譽如何、立功紀錄如何就能作為依據。所以學界「難以置信」亦不足以論斷，還是要待司法調查。 然而，此事令人不敢領教的，應是檢調未能維持「偵查不公開」。陳院士被檢察官帶往約談，已有大批媒體守候拍照，搜索地點大公開，所謂「涉案」情節亦鉅細靡遺地曝光。 「偵查不公開」，好像是隨便檢察官玩的名堂。刑事訴訟法不但有此原則，還明訂「搜索應保守秘密，並應注意受搜索人之名譽」。但至今的實務操作裡，從太極門事件的檢方被監察院糾正，到職棒涉賭事件中的檢察官公開稱「職棒玩完了」，乃至於企業被全程報導「搜索實況」以致市場動盪，法務部何曾對於檢方濫權違法有所約束懲處？ 陳垣崇是重量級人物，多少還得到學界同情聲援，一般民眾受到的待遇更不堪言。對於檢察官辦案程序瑕疵，感受點滴心頭的正包括了馬英九，他為了自己的案子狀告檢察官時，輿論曾提醒毋寧關注整體司法正義。卻不知總統是否有此「高度」關心制度改革？ 【2010/06/24 聯合報】 |

決標，購入世基公司所 生產的產品。
首先要說明的是該項產品的用途，是用來檢測危險基因標記，現在已知使用某些抗癲癇藥物及血液栓塞藥物華法林，在極少數病人會產生藥物
不良反應，嚴重的甚至 會有生命危險。陳所長的研究證明這些藥物不良反應，和人類某些組織抗原基因有高度的相關性，如果在用藥前確定這些病人是擁有這些高風 險基因，醫師就可以使
用替代藥物，避免這些藥物不良反應。現在的醫院因為並沒有提供這些檢測試劑，所以病人必須要承擔引起藥物不良反應的風險。陳所長的研 究，提供了開發這些檢 驗試劑的基礎，如果能夠成功的推廣到包括台灣及全世界的醫院，將來這些病人在使用這些藥物的時候，可以先要求作基因檢測，降低罹患藥
物不良的風險。
茲針對本次事件外界可能的一些疑慮，說明如下：

陳垣崇所長實驗室 是否必須採購這些試劑？—因為陳垣崇所長實驗室，目
前正在進行相關的人體臨床試驗，證明使用這些試劑，確實可以降低病人罹患藥物不良反應的風險。並證明試劑的準確度以及靈敏度，有了這 些數據，才能取信醫 界，順利的推廣到醫院。
2.
陳垣崇所長是否必須向世基公司採購這些試劑？這
樣的研究是由台灣陳垣 崇所長實驗室獨立研發出來，目前由世基公司生產該試劑，這些試劑希望能夠推廣到全世界的各醫院，但目前還在處於推廣階段，全世界並沒 有第二家公司生產該產 品，所以陳垣崇所長實驗室必須向該公司購買。這和購買一般電腦產品的採購案不一樣，如果是購買電腦產品等有其它替代公司生產類似產 品，依據採購法就必須迴 避向自己親人所開的公司採購，但陳所長目前的採購案並沒有替代品所以必須向世基公司採購。

本次採購是否涉及貪瀆？根據採購法十五條，公
務人員必須迴避與自己職 務相關之採購事項。如果涉及本人、配偶、三親等以內血親或姻親，亦應行迴避。但本法條也有規定，若執行該法條，反不利於公平競爭或公 共利益時，得報請主管 機關核定後免除之。陳所長該項採購案，有其特殊性，除了世基公司外，全世界並沒有第二家公司生產該試劑，和採購一般常見、有替代性的 物品，例如電腦、冷氣 等，並不相同。不能據此推斷他有貪瀆行為。但依據該法條精神，該採購案是需要先報請主管機關核定，此點陳垣崇所長須負行政疏失之責。
4.
陳所長是否有利用職權變更生醫所的採購慣例圖利世基公司？生
醫所行政
採取分工授權，採購案由採購人員經手，最後由行政副所長核定，陳所長並未參與該世基公司的採購或生醫所其它的採購案。
陳所長在國外擁有龐 貝氏症多項專利，開發出治療龐貝氏症的藥物，但將大部分該項專利的獲利，捐給其回國前服務的美國杜克大學，可見其為人對錢看得很淡
泊，而且平常致力於照顧 國內罕見疾病的弱勢病人，常常自掏腰包照顧這些病人，並未有貪瀆事實。希望能藉此說明，還原事實真相，還給陳垣崇所長清白。

It is too technical for me to follow. But just because it is technical, I don’t think the prosecutor will know anything about the things, this means that it must be that somebody inside the institute who are familiar with the matter or procurement procedure, told the prosecutor. Shouldn’t we find out who is this guy? May be a secretary of the institute, or a member or the research team? Or some competitive drug firms? Couldn’t we learn from Ching Chi Hsieh’s experience? Who accused Hsieh? What happened to the accuser(s)? Why they did? This may prevent future recurrences. My two pennies.

I was among 3 academy scientists who interviewed Dr. Chen and very highly recommended him for the position. He went back to Taiwan to take the job for Taiwan. Like European countries, Taiwan really need Biotech to survive and develop. After >30 years under KMT control and US $ Billion, (pocketed!), Taiwan and Dev. Cent of Biotech (headed by KMT chairman, Chiang Yen-Su), never had developed own medicine, not even one. I pursued CSB to appoint SM Wu and Min-Chi Wu (Former FAPA head) to take over. I also transfered many of my own patents to DCB trying to help them to develop new drugs in Taiwan.
Unfortunately, Ma took over and there were some informations about that KMT court might sue both Wu. Three news articles also wrongly accused my involvement. I, therefore, withdrew all of my patents and decided to develop medicines in my own Lab at Univ. of Chicago. It was a very fortunate decision, otherwise I am sure I will be one of those "for green scientists" KMT loves to clean up. So far, our patent work appears to lead to development of novel medicines for many catastrophic diseases that are difficult to deal with, such as atherosclerosis, inflammation (cancer, asthma, skin problems) or neurodegenerative diseases, I really wished that Taiwan could develop these drugs in Taiwan. I do not think it is possible under KMT.
[BTW, most investors in our company are 'Love Taiwan Taiwanese'. Also, I will not be in Taiwan Academy's meeting, as long as Ma is there. The Academy is a part of Presidential office controlled.]

I was shocked by this case because I heard last year that KMT has been planning to clean up the Green camp scientists from Academia Sinica. This definitely a double standards of Taiwan legal system. Dr. Chen owns patents and unique technology around the world in his field. Therefore, this is a sole source procurement. In the other hand, the ⱒ弯font> and xƗͧ/font> during the swine H1N1 flue was a case of breaking the law regulating government procurement. The Taiwan Justice Department did not care about the contract between government and that company at the time. It looks like only KMT can do that. KMT always tricks us with the grey area.
