The five major Madh'hab (schools of Islamic jurisprudence) agree that
a sane male apostate must be executed.[1] A female apostate may either
be put to death according to some schools, imprisoned according to
others, or exempt from punishment according to the Hanafi school.[2]
The Sharia laws governing apostasy are derived from the hadith
traditions. According to Wael Hallaq nothing of the apostasy law are
derived from the Qur'an, [3] although the jurist Al-Shafi'i
interpreted the Quranic verse [Qur'an 2:217] as providing the main
evidence for apostasy being a capital crime in Islam.[4]

mentioned before the Prophet (p.b.u.h) and he was told that he had kept on
sleeping till morning and had not got up for the prayer. The Prophet said,

"If anyone of you rouses from sleep and performs the ablution, he should
wash his nose by putting water in it and then blowing it out thrice,
because Satan has stayed in the upper part of his nose all the night."
SAHIH BUKHARI Volume 8, Number 188: During the pre-lslamic period of
ignorance I saw a she-monkey surrounded by a number of monkeys. They were
all stoning it, because it had committed illegal sexual intercourse. I too,
stoned it along with them.
SAHIH BUKHARI Volume 8, Number 242: Narrated Abu Huraira: The Prophet said,
"Allah likes sneezing and dislikes yawning, so if someone sneezes and then
praises Allah, then it is obligatory on every Muslim who heard him, to say:
May Allah be merciful to you (Yar-hamuka-l-lah). But as regards yawning, it
is from Satan, so one must try one's best to stop it, if one says 'Ha' when
yawning, Satan will laugh at him."
SAHIH BUKHARI Volume 4, Number 509: Narrated Abu Huraira: The Prophet said,
"Yawning is from Satan and if anyone of you yawns, he should check his
yawning as much as possible, for if anyone of you (during the act of
yawning) should say: 'Ha', Satan will laugh at him."
SAHIH BUKHARI Volume 7, Number 132: The Prophet said, "None of you should
flog his wife as he flogs a slave and then have sexual intercourse with her
in the last part of the day."
SAHIH BUKHARI Volume 7, Number 715: Aisha said that the lady (came),
wearing a green veil (and complained to her (Aisha) of her husband and
showed her a green spot on her skin caused by beating). It was the habit of
ladies to support each other, so when Allah's Apostle came, Aisha said, "I
have not seen any woman suffering as much as the believing women. Look! Her
skin is greener than her clothes!" (Mohammed then commends the husband).
SAHIH BUKHARI Volume 7, Number 125: The Prophet said "I saw the (Hell)
Fire, and I have never before, seen such a horrible sight as that, and I
saw that the majority of its dwellers were women." The people asked, "O
Allah's Apostle! What is the reason for that?" He replied, "Because of
their ungratefulness." It was said. "Do they disbelieve in Allah (are they
ungrateful to Allah)?" He replied, "They are not thankful to their husbands
and are ungrateful for the favors done to them."
SAHIH BUKHARI Volume 3, Number 826: The Prophet said, "Isn't the witness of
a woman equal to half of that of a man?" The women said, "Yes." He said,
"This is because of the deficiency of a woman's mind."
Malik's Muwatta, Book 30 2.13: A man came to Umar ibn al-Khattab and said,
"I have a slave-girl and I used to have intercourse with her. My wife went
to her and suckled her. When I went to the girl, my wife told me to watch
out, because she had suckled her!" Umar told him to beat his wife and to go
to his slave-girl because kinship by suckling was only by the suckling of
the young.
SAHIH BUKHARI Volume 7, Number 17: Narrated Jabir bin 'Abdullah: When I got
married, Allah's Apostle said to me, "What type of lady have you married?"
I replied, "I have married a matron' He said, "Why, don't you have a liking
for the virgins and for fondling them?" Jabir also said: Allah's Apostle
said, "Why didn't you marry a young girl so that you might play with her
and she with you?'
SAHIH BUKHARI Volume 8, Number 151: Narrated 'Aisha: I used to play with
the dolls in the presence of the Prophet, and my girl friends also used to
play with me. When Allah's Apostle used to enter they used to hide
themselves
SAHIH BUKHARI Volume 7, Number 18: Narrated 'Ursa: The Prophet asked Abu
Bakr for 'Aisha's hand in marriage. Abu Bakr said "But I am your brother."
The Prophet said, "You are my brother in Allah's religion and His Book, but
she (Aisha) is lawful for me to marry."
SAHIH BUKHARI Volume 7, Number 88: Narrated 'Ursa: Mohammed (p.b.u.h.) The
Prophet (when He was 53 years old) wrote the marriage contract with 'Aisha
while she was six years old and consummated his marriage with her while she
was nine years old and she remained with him for nine years (i.e. till his
death).
SAHIH MUSLIM Volume 9, Number 3901: There came a slave and pledged
allegiance to Allah's Apostle (PBUH), he did not know that he was a slave.
Then there came his master and demanded him back, whereupon Allah's Apostle
(PBUH) said: Sell him to me. And he bought him for two black slaves, and he
did not afterwards take allegiance from anyone until he had asked him
whether he was a slave (or a free man).
SAHIH BUKHARI Volume 9, Number 368: I came and behold, Allah's Apostle was
staying on a Mashroba (attic room) and a black slave of Allah's Apostle was
at the top if its stairs. I said to him, "(Tell the Prophet) that here is
'Umar bin Al-Khattab (asking for permission to enter)." Then he admitted
me.
SAHIH BUKHARI Volume 8, Number 182: Allah's Apostle was on a journey and he
had a black slave called Anjasha, and he was driving the camels (very fast,
and there were women riding on those camels). Allah's Apostle said,
"Waihaka (May Allah be merciful to you), O Anjasha! Drive slowly (the
camels) with the glass vessels (women)!"
SAHIH BUKHARI Volume 2, Number 103:Narrated 'Urwa on the authority of
'Aisha: Once the Prophet was screening me and I was watching the display of
black slaves in the Mosque and ('Umar) scolded them. The Prophet said,
'Leave them. O Bani Arfida! (carry on), you are safe (protected)'.
SAHIH MUSLIM Volume 019, Number 4345: ...we attacked from all sides... I
saw a group of persons that consisted of women and children... Among them
was a woman from Banu Fazara. With her was her daughter who was one of the
prettiest girls in Arabia. I brought them to Abu Bakr who bestowed that
girl upon me as a prize. I had not yet disrobed her when the Messenger of
Allah (may peace be upon him) met me in the street and said: Give me that
girl!
SAHIH MUSLIM Volume 019, Number 4364: Then he killed their men, and
distributed their women, children and properties among the Muslims, except
that some of them had joined the Messenger of Allah (may peace be upon him)
who granted them security. They embraced Islam.
SAHIH BUKHARI Volume 4, Number 276: Then the infidels were defeated. By
Allah, I saw the women fleeing lifting up their clothes revealing their
leg-bangles and their legs. So, the companions of 'Abdullah bin Jubair
said, "The booty! O people, the booty !
SAHIH BUKHARI 4:260 Narrated Ikrima: Ali burnt some people and this news

peace be upon him) stood up and said: By Him besides Whom there is no god
but He, the blood of a Muslim who bears the testimony that there is no god
but Allah, and I am His Messenger, may be lawfully shed only in case of
three persons: the one who abandons Islam
SUNAN ABU-DAWUD, Volume 14 (Jihad), Number 2756: Narrated Abdullah ibn
Mas'ud: I heard the Apostle of Allah (peace_be_upon_him) say: Were it not
that you were not a messenger, I would behead you. But today you are not a
messenger. He then ordered Qarazah ibn Ka'b (to kill him). He beheaded him
in the market. Anyone who wants to see Ibn an-Nawwahah slain in the market
(he may see him).

Muhayyisa b. Masud leapt upon Ibn Sunayna, a Jewish merchant with whom
they had social and business relations, and killed him. Huwayyisa was
not a Muslim at the time though he was the elder brother. When
Muhayyisa killed him Huwayyisa began to beat him, saying, 'You enemy
of God, did you kill him when much of the fat on your belly comes from
his wealth?' Muhayyisa answered, 'Had the one who ordered me to kill
him ordered me to kill you I would have cut your head off.'"

This story is also supported in the Sunan of Abu Dawud, Book 13,
Number 2996:
Narrated Muhayyisah: The Apostle of Allah said: If you gain a victory
over the men of Jews, kill them. So Muhayyisah jumped over Shubaybah,
a man of the Jewish merchants. He had close relations with them. He
then killed him. At that time Huwayyisah (brother of Muhayyisah) had
not embraced Islam. He was older than Muhayyisah. When he killed him,
Huwayyisah beat him and said: O enemy of Allah, I swear by Allah, you
have a good deal of fat in your belly from his property.
