Commonwealth Lawsuits

Lawsuits here, as everywhere, tend to be a little sticky. We are
inviting people to send in their particularly vexing lawsuit and invite
comments.

In the beginning you don't want to tell anyone, because you are afraid
for people to find out you are being sued. Nothing happens. Your
lawyer never calls, unless he needs more money. You wait a year, you
wait two. This lawsuit is not going anywhere, ever.

Finally, you tell a few people. They don't want to hear it. You need
to talk. Your lawyer is now on permanent vacation in the Bahamas, you
suspect on your funds. Now everyone avoids you, and you are compelled
to tell people in elevators, grocery store lines, and other places
where they are captive.

Now comes "Comments on Commonwealth Court Cases": You can air your
feelings, get commiseration from fellow suffers; and perhaps even your
lawyer will find out how you feel, if he ever googles his name! All
this for the price of an email stamp!

Send in your story folks. We may even have contests to see who has the
world's most incompetent lawyer, and such. Make suggestions for
contests, and donations for prizes. Perhaps we can solicit for
donations for particularly worthy cases. We can even run candidates
for judge, etc. Just think of the power we could generate if we all
stuck together against the system the opresses us. At least that smug
so-and-so, that thinks none of the neighbors know about that
reprehensible lawsuit they have initiated against, you will wake up in
a few mornings to find their name is at the top of the search engines,
and that the neighbors will soon be throwing all their garbage in their
backyards, etc.

Never say die! Something's gonna work!

Here is a case that is about as foolish as any I have seen lately. The

It reads in full:

Business owner Nancy Blackmore, proprietor of "Jane's Saddlebag" at Big
Bone, Ky., has filed a lawsuit in Boone County (KY) Circuit Court
against a neighbor, James Duvall. The suit alleges defamation of
character and interference with her ability to earn money.

James Duvall, M. A., the director of Big Bone University, has retained
as his attorney Marcus Carey, Esq., the eminent jurist now running for
Kentucky Supreme Court (http://careyforjustice.com/). Mr. Carey took
the case on a contingency basis, stating that there are a number of
aspects by which a countersuit can be mounted under the circumstances,
but that he would take the case on its first amendment issues, which he
regarded as particularly important and interesting.

Ms. Blackmore had first threatened to sue the Boone County (KY) Fiscal
Court because of the zone chance which was turned down unanimously, but
later decided to sue Mr. Duvall when her business, which is a week-end
drive-in motorcycle restaurant, began to fail. She could not be
reached for further comment.

Mr. Duvall stated that his first amendment rights have been violated by
Ms. Blackmore, who moved into the neighborhood only a few years ago,
when she began a long campaign against him, lasting nearly two years,
including harassment against his wife, his five small children, and
himself, because he had spoken against her zone change before the
Fiscal Court. She further violated his free speech rights in deleting,
or having deleted, his website and blogs in which he had discussed
these issues in a rational and objective manner.

"I have never said anything but the truth about Nancy Blackmore, or on
any issue relating to this case," stated Mr. Duvall from his studio at
Big Bone University. "Everything I have said was about the issues
involved. This zone change to get a motorcycle bar here, was a very
bad idea for the community. About eighty residents signed a petition
against it, which is very nearly a hundred percent of the population.
She alleges in her lawsuit that I said she was the neighborhood bully
(which I did not say), she has proved it by her actions in harassing my
family and bringing this punitive lawsuit. Her suit is going nowhere.
She cannot win; she doesn't have a case."

Ms. Blackmore's suit was filed by attorney Greg Voss of Union, KY, who
is representing her. Mr. Voss could not be reached for comment.

That's not too smart.
