photo of guns: felony?

Sean Carasov was participating in online planning sessions to
coordinate
an UNARMED peaceful picket of the human rights abuses, fraud, and
other ongoing crimes of the Corporation of Scientology. The
Corporation's
private espionage department known as OSA, along with outside Private
Investigators identified Mr Carasov and other potential picketers, and
posted
their names, photos, addresses and other information on YouTube, and
tampered
with at least one of their cars. They also poisoned one of Mr
Carasov's cats.

A photo appeared on the internet with a March 13 LA Times, a
revolver,
a semi-automatic pistol, and a caption beneath the picture reading
"Come in my house and you'll have a warm welcome"

Mr Carasov was later arrested for Republic of Kalifornia 422PC.
Bail was set at $50,000 Mr Carasov did not picket on March 15.
Several hundred people did, including one Gareth Cales and
here are his notes:

422 PC appears to be a law that was written to harass a single person
that was annoying a politician.

422 pc will not stand up to a constitutional test. Without having the
seen the actual photo, I can only assume then that it was intended as
a warning, not a threat. Then just how do you prosecute events which
have not yet happened? As the wording of 422 PC apparently is based
upon events that have not yet, may have, or might possibly occur in
the future.

Since when does one post bail for such a minor infraction of the law?

Oh yeah. Since it's in california.

I've copied/pasted the code below....it seem that there are four or five
criteria contained therein that have to be satisfied in order to be charged
under this penal code. If that's true, then there is no case against him.

imprisonment in the state prison.
For the purposes of this section, "immediate family" means any
spouse, whether by marriage or not, parent, child, any person related
by consanguinity or affinity within the second degree, or any other
person who regularly resides in the household, or who, within the
prior six months, regularly resided in the household.
"Electronic communication device" includes, but is not limited to,
telephones, cellular telephones, computers, video recorders, fax
machines, or pagers. "Electronic communication" has the same meaning
as the term defined in Subsection 12 of Section 2510 of Title 18 of
the United States Code.

I could have no idea what I am talking about, but if there's a problem
its probably the "Cmon' a my house CO$." Because the other says come
in my house, and in the USA there should be no problem with that.
Correct me if I am wrong, he did this 'after' someone killed his cat.

Thanks for the photo. Does not appear to meet the requirements of 422
PC at all. As I said, this is a warning, not a threat. It also appears
that the two weapons shown are in dire need of maintenance and
probably wouldn't fire at all.

That falls into the same frame as posting a sign, "protected by
trained attack dogs". The thing is, the CO$ is the one who has been
"threatened". Even though they themselves have never been charged with
any crimes of violence even though every cop around knows they have
done so.

I would fight it all the way to the Supreme Court. Violation of 1st
amendment rights.

The charges are based upon this photo that was posted. As the "perp"
was arraigned THIS year, shortly after the demonstration, then there
may be other factors not known involved. You don't get arraigned a
year after the event took place.

A $50,000 bail for a comment on photo? Bullshit.

I hope he limits himself to clearly marked imitation or replica
words. Henson's sign had real words made from real letters, and he
did not have a carry permit for them. He got 6 months in jail and 3
years probation for that.

Obviously this has nothing to do with guns and threats. It's all about
a political hassle between the CoS and one of their critics. My guess
is that the church has more members working in the Kalifornia
"justice" system than he does. But hey, what can you expect? A place
that teaches kids about the "crimes" of pointing a finger and saying
"bang" which results in handcuffs and a trip to jail for some grade
school kid (to make a "zero tolerance" point, natch) will have little
reluctance to totally abuse the criminal systems for other political
purposes.

IF ONLY that place would hurry up and slide into the Pacific!

the cos files the lamest of charges all the time, it knows most cannot
be won, the intent is to run up legal expenses and stress on the
person targeted,...ruin them with their employers etc. ... thats why
you have to be careful to word what you say carefully.

for instance we say the cult will *implode.. so there is no way our
intent can be twisted.etc.,,then go on to cover the bases more
completely by asserting our stance against violence, and pointing out
as I am here that the cult has been exceedingly violent, been
convicted of felonies and fraud world wide, and that its behavior is
self destructive causing it to implode......taken togheter as it must
be in a single sentence ones arse is covered..and if read in court
demonstrates the issues. it cant be taken out of context.. and puts
the other issues into the court record, the cults dirty hands and long
standing history of attacking critics, and doing frame ups etc.

its a long sentence using elipses (...) instead of periods for that
reason.

we dont do or say or allow ourselves to be taunted into agreeing with
anything that can be spun as a chargeable offense no matter how
ludicrous the attempt..... this cult has a long record of paying off
officals, police and judges... so the fact that what you said or
whatever is legal, is not the issue.... the issue is can what you said
be spun to indict you. thats the issue.

i also like to frame my remarks so that other issues are on the table,
cut financial crimes for example, that way they know if they sue, that
i can depose anyone I want on *those issues...no way in hell does scn
want its members deposed on such topics.

The question isn't whether laws criminalizing threats are
constitutional. It's whether merely saying that if anyone breaks into
one's home, they'll be "met with a warm welcome" is a constitutionally
prosecutable as a threat (as opposed to an instance of protected speech)
since

(1) it's general in the extreme,

(2) it can be interpreted several ways ("warm welcome" could mean
anything-- from deadly force to calling the cops)

(3) even if it can be deemed a threat, at most it's a threat to do a
legal act: protecting one's home from criminal intrusion.

If, under the law, I have the right to defend my home with deadly force
against intruders, how can it be a criminal act to announce to the world
that I'm prepared to do just that?

Scientology's recent aggressiveness surprised even me, and yeah, I
know how vicious those OSA fuckers are. Apparently even large numbers
of protesters don't slow them down in their main stomping grounds --
LA and Clearwater.

But you need to chill out a bit. Even if they did poison the cat food,
posting pix of your guns was not a good idea. Some of the statements
you made gave them an opening to whine and carry on about how you
scared them shitless, and there are plenty of loyal robots who will
lie and say you did.

At this point, the best service you could do for other Anons is
educate them about the somewhat dumb moves you made. You sure didn't

Every time I came into my Grandmother's house
(may she rest in peace) I got "a warm welcome"
usually involving moist delicious cake. Then we
went into the back 40 for some target practice.

I guess the "crime" here is that Mr Carsov is not

Not to make light of this, but I never noticed the spot of 'rust' (?)
on the Colt. It actually doesn't look as bad IRL and it's only on the
starboard side; the pic was *very* unflattering. However, now it's
annoying me so, what would I use to get rid of that save gun oil and
elbow grease?

I'm an unemployed music biz exec so good luck with that. I wasn't
kidding when I said "the porn industry is less sleazy". If anyone
*was* hiring any more ("The Biz" is all but over) they wouldn't care
less. I actually used to get looked at funny if I turned up at 10am
since they suspected I hadn't been out all night looking for The Next
Big Thing.

Mind you, I'm going to have a tough time getting a 'regular' job since
teh google hits on my name aren't exactly flattering. Anyone hiring
"domestic terrorists"? (Funny how Anon went from "a bunch of computer
geeks" to Al Qaeda in CO$ lingo in a week and a half).

I did but sometimes we humans don't act rationally or as emotionless
as the CO$fags when confronted with a dead cat (or the perception that
Mudkips had been poisoned). He was a feral but he was still one of
'mine'. I love all animals (OSA excepted) but have a special place in
my heart for teh kittehs. He never came back so I'll never really know
but he'd been coming around for over a year. Someone in the Old Guard
told me not to think that all CO$fags hate animals and even though
they were undoubtedly baiting me for trolling at the protest, (which
I did attend and *without* a sign) they might have taken him to a
shelter.

I simply can't relate to someone who could kill anything, pet or
human. Although I can relate slightly better to the human bit...lol

Good luck on the job situation. Perhaps after this blows over you'll
find yourself a hero (not AN HERO...lol) and in demand once the
public is completely educated on the CoS matter. I have my fingers
crossed for you, honey.

So you'd stand by and let someone else kill you or a member of your
family if you had the ability to stop it, if that meant killing your
attacker?

I don't know what I'd do. I'm sure I'd put up as much of a fight as
possible, but not having been in that situation as of yet, there's
simply know way of knowing for certain.

Oh, so we never found a body? I was under the impression that there
had been one.

So basically, Mudkips is a Schroedinger's cat. I hope that when we

My dogs are all bred for honest and legitimate purposes. It's an
excellent idea to purchase one at the same time you secure your

yep, what he said, and keep them guns loaded and at the ready...
scienos quit messing with me after they met my dogs a few times... and
my dogs don't take food from strangers so they can't poison em
either...
