Dagestan: Makhmud
Akhmedov Waiting for the Verdict to His Offender
The
hearing of the case of the beating of a juvenile resident of
Hebda
village of Shamilskiy district of Dagestan Makhmud Akhmedov by
police, scheduled for June 5, was not held due to the illness of
the
defendant, Magomed Magomedovich Magomedov. It was
planned that this
hearing the last word of the defendant will be heard and the
court
will pass the verdict. Magomedov is charged under subsection "a"
of Part 3 of Article 286 (abuse of power) of the Criminal Code
of the Russian Federation.
The
previous hearing was held on June 1. It began with a petition of
the
lawyer of the accused Magomed Kamilovich Magomedov to question
two
witnesses, one of which - the nephew of the defendant whose last
name
is Murtazaliev. The judge granted it, but the witnesses came to
the
court without passports and were not interrogated. The judge
went on
to pleadings.
The prosecutor
Zapir Magomedov in his accusatory speech said that
the defendant, police
officer Magomed Magomedov, "committed a crime, which discredits
the state power." "It leads to distrust and even hatred
of
the population to the local authorities. In return, many young
people
go to "woods" and wage armed struggle with the authorities,"
- the public prosecutor said. He asked the court to sentence the
policeman to four years imprisonment.
Lawyer of the injured Aziz
Kurbanov agreed with the prosecution, noting that the
defendant's
guilt has been completely proved. In his speech he referred to
the medical
records (inspection certificate, forensic medical examination)
which confirm the receipt of brain injury and hearing loss in
one ear as the result of beatings. Lawyer reminded of the

Defendant's lawyer, M.K. Magomedov said that the investigation
did not
have official documents proving that M. Akhmedov was taken to
Shamilskiy
police department (there is no record of it in the log book). He
also noted that the case got resonance due to the activity of
the
public and the media.
According to him, "accusations of Magomedov
are unsubstantiated and based on conjecture, and his actions
were
within the law." In response, the judge Israpil
Magomedrasulovich Magomedov said that the defendant's
lawyer knew the case files badly.
On July 18, 2010 Makhmud Akhmedov was
detained by three officers of the department of MIA of
Shamilskiy district and severely beaten in the department.
Makhmud
got a bruise of the brain and lost the hearing in one ear. On
May 20,
2011 police officers were found guilty of abuse of power, they
were
assigned the conditional sentence from 2,6 to 4 years of
imprisonment
and disqualification to hold positions in the MIA for a year.
However, the family of Akhmedov found the punishment
not stringent enough and appealed to the Supreme Court of
Dagestan.
The court found serious violations of procedural rules, and the
case
was returned to the prosecutor on October 18, 2011. In January
2012
the criminal case against two police officers, Sh. Magomedaliev
and G.
Nurudinov, was allocated to another production.
