The new wiretapping agreement reached in Congress yesterday should alarm defenders of Liberty. While it contains some new window dressing checks on the Executive, like increased review by Inspectors General, my first read shows two glaring problems.
Telecom companies that illegally provided government agents with the personal information of their customers will receive immunity. These companies willfully violated contracts and privacy agreements, but are getting off scot free. Talk about a dangerous precedent!
More alarming is the new seven day period under which the government can undertake warrantless surveillance against American citizens in any case they deem an ?emergency.? But just who decides what an ?emergency? is? This provision opens the door for the CIA, FBI and NSA to spy on anyone they choose, anytime they want.
