Committee hearing will discuss presidential limits

WASHINGTON -- The House Judiciary Committee is underway today with a hearing on the presidency and executive authority. Whether it's an impeachment hearing or not depends on who you ask.

"To the regret of many, this is not an impeachment hearing," said John Conyers, the Detroit Democrat who chairs the committee. He was responding to Iowa Republican Steve King's claim that the committee was talking of impeaching the president, whether it wanted to say it outright or not.

What was clear was that Democratic leadership wanted to allow a hearing that would discuss whether President Bush has overstepped his authority while at the same time making it clear that impeachment is off the table.

That is certainly not the feeling of some Democrats, however. Florida's Robert Wexler called for impeachment hearings outright and Ohio's Dennis Kucinich has introduced a resolution that Bush be impeached under accusations he misled the nation in the walkup to the Iraq War.

Conyers said Congress has the responsibility to examine the presidency -- even if impeachment is apparently off the table. Today's hearing then appeared to be more of an examination of the president's record and whether it has overstepped his authority.

Ranking Republican Lamar Smith said it was more like "an anger management class."

"Nothing is going to come out of this hearing with regard to impeachment of the president. ... The Democratic leadership has said time and again that they have no intention of bringing any impeachment resolution," Smith said.

"Why is that? Because they know it wouldn't pass."
