** Removal of Cond. PR with Divorce - Question**

I wonder if anyone has some quality feedback for my situation.

I married a US citizen in July 1999, after having an F-1 Visa to attend
school doing a Computer Science Bachelors. The interview for conditional
status was for July 12th, 2001. Ten days before our two year
anniversary, so I only got the conditional status approved.

It has certainly been an honest marriage, but after being married for 2
years she decided that she wanted to divorce on grounds of irrepairable
differences. We seperated in September 2001 (27 months of marriage) and
we will be divorced by April 2002 (33 months of marriage).

I am wondering how my filing my petition for removal of conditional
status when my conditional PR card expires will go. Will I be denied PR
because we are divored?
My wife has said that she will help where ever she can in the process,
but will probably remarry later this year, as she is already in another
serious relationship.

Will I get Permanent Residence still? At that stage I would be filling
out the petition based on 'Entering into a marriage in good faith, but
divorced', but it would certainly cause severe economic hardship if I
had to leave.

Is this I should consult an attorney about, or work on filing on my own?

You file for the removal of conditions NOW. Do not wait until 90 days
before the expiration of the green card. As long as your divorce is
final you are free to remove conditions immediately.

The instructions on the I-751 indicate what you need to send. You still
have to prove the validity of the marriage so I hope you have
documentation to back it up.

Also do a google search for 2001/2002. Someone posted not all that long
ago (late fall I believe) that they filed after divorced and removal of
was approved.

Hi Paul

I was sucessful in getting conditions removed after divorce of a relatively
short marriage. I was married in 1997 and got conditional status in 1999.
Separated in 1999 and divorced in 2000. It took me about 11 months from
application for removal with a waiver until my interview. I did all the
paper work myself.

You are so right Shelley. That's what I get for scanning and not reading
thoroughly.

My apologies Paul. Wait until the divorce is final and file for your
removal via I-751.

Nonsense... Nothing in his post indicated he was abused.
And...It's not even needed....
Adjustment of status can be done after divorced. It only requires the
original marriage be
validated as not fraudulent.

Judging by your other post, I can see you have an agenda.
If you have CPR status, you don't need abuse to stay in the US.
