Scarborough Fair - copyright issue

A few weeks ago there was a discussion about the copyright issue
of Scarborough Fair on this news group, on which I was too busy
to comment at that time.

The problem is that "the arrangement and original couter melody"
was credited to Paul Simon and Artheur Garfunkel,
though the arrangement is almost a dead copy of Martin Carthy's.

Really? Do you have ac opy of Carthy's arrangement? Does it have the
same instrumentation as S&G?

It's not a matter of instrumental arrangement.
Scarborough Fair is a traditional song, and there have been many version
of the crude song arranged by various folk singers for singing at the
present day
and sung by them. Martin Carthy's version is one of them, and S&G version
is, apart from the counter melody, similar to Martin Carthy's version.
