MESSAGE FROM THE SECRETARIAT
 
A very happy 2014 to all our members and I hope it is a good year for you all. A number of you have been asking about the 2014 ANCL conference. As you may know, the funding situation globally is bad and in South Africa especially, donor funding has been reduced by around 60% in the sector. Fundraising for conferences thus has become really hard. We are doing our best to raise money for a confernece and will let you know if we are successsful.
 
You may remember that we were commissioned to do some research on the Rule of Law and Constitutionalism for presentation to the AU last year. A team of ANCL researchers from around Africa worked on the report which was presented in Dakar in November 2013. We are now working on some revisions , and the papers will be made available as soon as it is complete.
 
We were recently awarded a contract by OSIWA to do a project on Access to Justice in Senegal, and will keep you informed to the progess of the project as soon as it starts.
 
Please remember to encourage colleaugues and friends to become members and to SEND NEWS FOR THE NEWSLETTERS!! Especially French news.

Nous vous souhaitons une excellente année 2014 ! J'espère que ce sera une bonne année pour vous tous. Un certain nombre d'entre vous ont demandé des renseignements sur la conférence 2014 du RADC. Comme vous le savez, la situation financière est globalement mauvaise et l’est particulièrement en Afrique du Sud, où le financement par les bailleurs de fonds a été réduit d'environ 60 % dans le secteur. Dès lors, la collecte de fonds pour des conférences est devenue vraiment difficile. Nous faisons de notre mieux pour réunir les fonds nécessaires pour l’organisation d’une conférence et vous informerons si nous y parvenons.

Vous vous rappelez également que nous avons été chargés l'année dernière de faire un travail de recherches sur l'état de droit et le constitutionnalisme, à être présenté à l'UA. Une équipe de chargés de recherches du RADC de toute l'Afrique a travaillé sur le rapport qui a été présenté à Dakar en Novembre 2013. Nous travaillons actuellement sur les révisions finales, et les documents seront disponibles dès cette dernière étape terminée.

Nous avons récemment obtenu un contrat d’OSIWA pour un projet de recherches sur l'accès à la justice au Sénégal, et nous vous tiendrons informés de l'avancement du projet dès que celui-ci sera mis en route.

Africa Regional International Staff/ Student Exchange Programme

Africa Regional International Staff/Student Exchange: Food Security and Sustainable Human Wellbeing (ARISE)
 
The University of Cape Town not only explores bilateral relationships with institutions on the continent, but also seek triangular partnerships with strategic partners in the global North and on the continent. In 2012, the University of Cape Town was awarded funding by the European Union under the Mwalimu Nyerere / Intra-ACP academic mobility scheme to partner with other institutions on the continent in a collaborative programme called the Africa Regional International Staff/Student Exchange: Food Security and Sustainable Human Wellbeing (ARISE). The objectives of ARISE are (i) to increase the number of qualified postgraduates in the selected fields of Agriculture, Medical Sciences, Engineering and Energy, (ii) to combat brain drain and (iii) to create mechanisms for knowledge and skills circulation on the continent, amongst others.

ARISE will provide a total of 100 opportunities for masters and doctoral studies as well as for shorter research and administrative visits for student and staff mobility between the partner institutions. The ARISE partner institutions are the University of Cape Town, (South Africa - Co-ordinating institution), Addis Ababa University (Ethiopia), Makerere University (Uganda), University of Nairobi (Kenya), University of Rwanda (Rwanda – previous NUR) and the University of Ghana – Legon (Ghana). ARISE’s technical partner is the University of Leuven and the International Education Association of South Africa serves as associate partner.

The call for applications is currently open and closes on 28 February 2014.

The African Court on Human and Peoples' Rights was created to protect the rights of the estimated billion citizens of Africa, The ACtHPR Monitor will be a forum for news, comment and debate on the court. The website features as its first article an in-depth interview with the court's Registrar, Dr. Robert Eno and also contains an introduction to the court and the Country Tracker, designed to give prospective applicants and other interested parties a quick reference on the court's jurisdiction.
 
 


 
  
Constitution-building in Africa



 
The summer course on Constitution Building in Africa Organized by CEU held last year, will continue this year as well in cooperation with International IDEA.
 
The two-week research course intends to tackle complex societal, political and legal problems in constitution-building from an interdisciplinary perspective, informed by field experience. We seek to combine different disciplines (mostly comparative law and political science) and perspectives (comparative governmental systems; electoral systems; decentralization; human rights; comparative constitutional law; good governance; etc) to offer new insights on a classic subject of the highest academic and practical relevance.

Database on constitutions of Sub-Saharan Africa goes online

 
 
The Database of the Constitutions of Sub-Saharan Africa offering constitutional documents for 52 Sub-Saharan countries since their independence is now available online.
 
The collection contains constitutions, as well as amendments and constitutional bills. The documents are provided in their original language, and, if available, in their English translation.
It provides a collection of web links to online resources and publicly available PDF-files for individual use. At present, several constitutional documents are still missing from the database, but teh team continue working to complete the constitutional chronology for all countries. You are encouraged to share any online resources or documents so far missing from the database.

African experts in federalism, wealth-sharing and inter-governmental relations

 
The UN mission in Somalia (UNSOM) is urgently seeking African experts in federalism, fiscal federalism, wealth-sharing and inter-governmental relations. The experts will provide the Federal Government of Somalia (FGS) with technical advice on the development of a federal system of government in Somalia including evolution of fiscal federalism, wealth-sharing and inter-governmental relations. The experts will also facilitate briefings, workshops and seminars on key principles of federalism and inter-governmental relations for senior Somali political leaders and public officials. Short assignments of between 1-3 weeks are envisaged in the first instance. This assignment may require travel to Mogadishu (AMISOM protected areas). WOMEN IN WAR AND AT WAR: Recent Developments

Call for papers

Women’s roles in war are complex and varied and are not limited to that of victims. During the Arab Spring, women took to the streets protesting against oppressive regimes in North Africa and the Middle East. We are also witnessing a significant rise in female political activism during conflict: many women increasingly find Internet, blogs and social media a useful tool to fight oppression, advocate change but also to report from war zones. Many women actively participate in combat, in regular armed forces but also as guerillas and, freedom fighters. They are also compelled to fight as girl child soldiers. Sexual violence against women remains an alarming and disturbing feature of modern armed conflicts. This is despite the fact that International Humanitarian Law (IHL) prohibits rape and other forms of sexual violence in war and despite the major advances in International Criminal Law (ICL) in the punishment of gender crimes. Over the past two years, some further steps and initiatives have been taken at national and international level to address this problem. For instance, in June 2013 the United Nations Security Council issued Resolution 2106 on sexual violence in conflict, calling (once again) for the prevention of sexual violence during conflicts. In April 2012, the UK Foreign Secretary, William Hague, launched the Preventing Sexual Violence in Conflict Initiative, which resulted in adopting a G8 Declaration on Preventing Sexual Violence in Conflict and endorsing the Declaration of Commitment to End Sexual Violence in Conflict, which has been signed by 70% of UN Member States.
