Hello All.

Seems I'm getting no response on my VIACOM post but maybe you will see
this one hitting closer to home... Just ran accross this link which
sheds some disturbing light on the agreements made with YouTube and
the major recording studios. Sadly these agreements DO NOT COVER OUR
TAILS!!!!

The agreements are made about people putting the original music as a
background tracks to their vids. (This is a distribution right known
as synchronization) So basically any YouTuber can make a video that
has background music from these labels. (See list below...)

What this apparently doesn't cover is what we the musicians want:
performance rights. These are the rights that allow us to do a
performance of the song. It is much more complicated to get these
rights since it has to do with who actually owns the song whereas the
sync rights have to do with who owns the recording. So we are stuck
hoping that we will be okay performing versions of the songs we like
to sing without getting a DMCA strike against us! DOH!!!

While the DMCA does allow YouTube leeway as long as they take down
videos on request it doesn't protect us. We are liable for any covers
we do without clearing them from the original authors. While this
doesn't affect me since I am out of jurisdiction of these things in
India. It does affect most of you who are in western countries that
have copyright laws that allow absorbent lawsuits. While we probably
won't see many of these lawsuits (the can't make much money off them
since we have nothing to give) it is a threat that we need to be aware
of.

Perhaps some of you who are a bit more nimble with time and contacts
could track down an aswer from Google/YouTube about these things. I've
been scouring the net for months and this is the best I've found on
the subject...

PLEASE HELP FIGHT FOR MUSICIANS RIGHTS!!!
