При этом нами не были получены доказательства правомерности использования товарных знаков Компании на Вашем сайте (лицензионный договор).
Уведомляем Вас, что в условиях непредоставления указанных документов, Правообладатель вынужден правомерно и добросовестно исходить из того, что использование его интеллектуальной собственности на Вашем сайте является незаконным.

Напоминаем Вам, что в соответствии со ст. 1515 Гражданского Кодекса Российской Федерации Правообладатель вправе требовать по своему выбору от нарушителя возмещения причиненных убытков или выплаты компенсации:
1) в размере от десяти тысяч до пяти миллионов рублей, определяемом по усмотрению суда исходя из характера нарушения;
2) в двукратном размере стоимости товаров, на которых незаконно размещен товарный знак, или в двукратном размере стоимости права использования товарного знака, определяемой исходя из цены, которая при сравнимых обстоятельствах обычно взимается за правомерное использование товарного знака.
На основании вышеизложенного повторно просим предоставить доказательства законности использования интеллектуальной собственности Компании на Вашем сайте либо незамедлительно удалить материалы, размещаемые на вышеперечисленных страницах и прекратить иное использование интеллектуальной собственности Компании.

That said, to this day we have not yet received confirmation of legality of the Trademarks use on your website (licensing agreement).
We thereby notify you that in the absence of such confirmation the rightholder is bound to lawfully and in good faith presume that use of their intellectual property on your website is indeed illegal.
Consequently, please note that the following actions aimed at restraint of infringements may be undertaken in regard to your website:
1) removal from Google search results;
2) removal from Yandex.Market;
3) blocking of contextual advertising on Yandex.Direct and Google AdWords;
4) blocking of communities on vk.com;
5) notification of your hosting provider with subsequent blocking of your website.
Please be notified that the Company reserves its right for initiation of legal action in court and/or law enforcement agencies for protection of infringed rights.
Please also be reminded, that under Article 1515 of the Civil Code of the Russian Federation the rightholder is entitled to claim for damages or compensation in the amount of, at his discretion:
1) from 10 000 to 5 000 000 rubles, or
2) double price of the products, on which the trademark was unlawfully placed, or double price, paid for the right to use the trademark in comparable conditions.
