SC bars property sales through power of attorney

In a verdict aimed at discouraging loss of revenue to the exchequer,
the Supreme Court on Wednesday ruled that no immovable property can be
legally transferred or conveyed through a general power of attorney,
sale agreement or will.

A three-judge bench headed by Justice RV
Raveendran said such transfers do no convey the title and do not
amount to transfer and cannot be recognised as a valid mode of
transfer of immovable property.

"It is time that an end is put to the pernicious practice of a sale
agreement through a general power of attorney or a will transaction -
known as GPA (general power of attorney) sales," the bench said.

It clarified that its judgment would be applicable prospectively.
Holding that immovable property can be legally transferred only
through a registered deed of conveyance, the bench advised state
governments to reduce their stamp duty rates. This, it said, should be
done to prevent undervaluation of property and stashing of black money
by vested interests.

The court observed that high stamp duty rates had led to rampant abuse
of the GPA, sale agreements and wills

सुप्रीम कोर्ट ने महत्वपूर्ण व्यवस्था देते हुए कहा है कि जनरल पॉवर ऑफ
अटॉर्नी के तहत अचल संपत्ति को बेचने के लेनदेन या हस्तांतरण की कोई
कानूनी वैधता नहीं है। अचल संपत्ति को सिर्फ रजिस्टर्ड डीड के जरिये ही
बेचा या हस्तांतरित किया जा सकता है।

सरकारी खजाने को काफी नुकसान हो रहा
जस्टिस आरवी रविंद्रन, जस्टिस एके पटनायक व जस्टिस एचएल गोखले की बेंच ने
राज्य सरकारों को स्टांप ड्यूटी की दरों को कम करने के लिए भी कहा है
ताकि संपत्ति की तय से कम कीमत पर खरीद-फरोख्त न की जाए और निजी हितों के
चलते काले धन के लेनदेन को बढ़ावा न मिले। सर्वोच्च अदालत ने कहा है कि
स्टांप की बढ़ी दरों के चलते सामान्य पॉवर ऑफ अटॉर्नी, सेल एग्रीमेंट और
वसीयत आदि का चलन बढ़ा है। इससे सरकारी खजाने को काफी नुकसान हो रहा है।

सामान्य पावर ऑफ अटार्नी, सेल एग्रीमेंट या वसीयत करार की ऐसी प्रकृति है
जिससे मालिकाना हक का दावा नहीं किया जा सकता। अचल संपत्ति के हस्तांतरण
में इस व्यवस्था को वैध नहीं माना जा सकता। ऐसे लेनदेन पर भरोसा नहीं
किया जा सकता। सुप्रीम कोर्ट ने यह फैसला सूरज लैंप एंड इंडस्ट्रीज की ओर
से दायर अपील पर दिया है जिसमें मालिकाना हक विवाद में हरियाणा सरकार की
ओर से उठाए गए कदमों को चुनौती दी गई थी।

Full coverage is there in the Hindu. The judgement has declared the
use of GPA/Sale agreement/Will to AVOID REGISTRATION of property as
ILLEGAL as it deprives the state its revenue and also leads to
distortion of price and generation of black money. GPA to blood
relations has been allowed in this land mark judgement. This judgement
is to be implemented PROSPECTIVELY.
