BUILDER BUYER AGREEMENT SHOULD BE REGISTERED

I have booked a flat in noida sector 76, now i am in process of
agreement. Should agreement be registered paying stamp duty in sub
registrar office? Will it be more safer instead of agreement on Rs.
100/- stamp paper.

Dear Shiva,
as per "UP apartment act 2010" having a builder buyer agreement &
registering is mandatory, you are supposed to get the
agreement docuement, registered with authority within 4 months of
execution of BBA.& do ensure that builder buyer agreement mentions
"ALL" the details of l of Terms and conditions plus floor plan,
building plan, material to be used, specifications , amenities and
quality to be provided, common area and its use, built up area, carpet
area, date of completion, detail of handing over of completion
certificate, penalty in case of delay , etc....

  • agreement on Rs. 100/- stamp paper with builder is enough or 
  • shall I register the agreement in sub registrar office?
  • Is there any act similar to "UP apartment act 2010" for Gurgaon/HUDA.

Hi Gautam,
sorry for the late reply I was out on work.
agreement on Rs. 100/- stamp paper with builder is NOT enough, you
need register the agreement in sub registrar office as per
registration act 1908 , which is applicable to "all Indian states"
excluding J&K. you have to register the sale agreement within 4 Months
from date of execution of builder-buyer agreement/ sale agreement.

* WHAT IF YOU DON'T REGISTER IT / BUILDER REFUSES: At the first
place there is no option for not doing it with you or the builder as
per registration act Part-III Point 17. However if it happens then you
may have to pay ten times fee of registration subject to doing it in
within next 4 months after expiry of first 4 month period and provided
district registrar agrees to this 2nd extension period of 4 months.


* WHAT IF YOU STILL DON'T DO IT: A document / sale agreement which
is otherwise compulsory to be registered within 4 months from date of
execution, is not registered on payment of stamp duty, it can not be
taken as evidence in case of dispute of any kind and therefore
benefits of title and other interests will not pass on to proposed
purchaser. Which means you are bound to loose if this is not done.


* SO HERE THE CRUX IS . IF YOU DO ALL THIS , THEN YOU WILL NOT
have to SAY THAT WE CAN'T FIGHT THE BUILDER AND IN ANYCASE THINGS WILL
NOT BE IN OUR FAVOUR. I have spent my nights in digging out all this
info. I may be incomplete in it , if not fully right. But I am hopeful
that my inputs are true to the best of my knowledge.

Hi Ranjan

Thanks from the bottom of my heart for providing this useful information.
Today only, I got my Builder Buyer Agreement(BBA) done from a builder in Gurgaon.
In BBA there was no Stamp Paper but a Revenue Stamp of Rs 100 used (with stamp of Delhi Government on top of Revenue Stamp)

I have no idea of the registration process of BBA. I was thinking that registration would be done at the time of possession.

Would request you to please spare your precious time in answering the following questions:
  • Please let me know how to proceed further with registration of BBA in sub registrar office?
  • What documents and other formalities needed to completed from Builder side?
  • It may happen that builder refuses for same.What actions could I take to get the registration done.?
Documents I have with me as of today :
  • Allotment letter of the unit booked.
  • Original copy of BBA

Hi all,
can you please proveide link for that Builderbuyer aggrement in UP Appartment act 2010 as my builder saying that we can write only on that 100 Rs Stamp papaer so i have to provide a copy of that Building Law in support of that.

I had a talk with  builder regarding registration of Agreement.
He is asking for the source of information/link for the same.

Could you please provide the link for the below stated registration act Part-III Point 17.
