Dear YERWA members,
Based on the importance of the case and the land acquisition
notification, the legal team has shortlisted 23 cases at Sector 18 & Sector
20, for YERWA’s lawyers to file impleadment applications.
Both the lawyers hired by YERWA, have been assigned different
sets of cases to file impleadments. One of the lawyers, Mr. Tarun Varma, has
been provided a list of 7 important cases (covering 7 most important land
acquisition notifications at Sector 18 & 20) [Please See: Attached PDF
file titled “List of Cases for Mr. Tarun Varma”], and the other lawyer, Mr.
Sanjeev Singh, has been given the task to file impleadments in 16 cases
(covering all land acquisition notifications at Sector 18 & 20) [Please
See: Attached PDF file titled “List of Cases for Mr. Sanjeev Singh”].

short listed cases, is attached with this post. Kindly also find attached a list
of notifications detailing all 17 land acquisition notifications issued at

193 cases at Sector 18 & 20 [Please See: Attached PDF file titled “Vital
Statistics”].
Please Note: Master List of all cases (up
till 5th February, 2013), was provided by the legal department of Yamuna
Expressway Authority. Since, the list from YEA is our only source of
information, we are not aware of any other land acquisition notification (if
any) or a case (if any). Based on the said list, the legal team of YERWA
consulted lawyers at Delhi, shortlisted important cases and requested lawyers at
Allahabad to file impleadments in the said cases. If anyone is aware of any
other land acquisition notification or a case at Sector 18 & 20 (not
included in the list provided by YEA)... may kindly contact the legal team. We
are open to all information and eager to cover all land acquisition
notifications (and resulting cases), in order to safeguard the interest of all
our registered members.
So far, 1 impleadment application has been filed by Mr. Tarun
Varma and 11 impleadment applications have been filed by Mr. Sanjeev Singh. List
of registered members, was provided to respective lawyers a day before they
filed the said impleadments. Soon, 6 impleadment applications will be filed by
Mr. Tarun Varma and 5 impleadment applications will be filed by Mr. Sanjeev
Singh. A list of current registered members shall be provided to them at the
time of filing said impleadment applications. Those who could not send their
YERWA membership application in time while filing earlier impleadment
applications need not worry. The list of registered members shall be updated in
first or second week of March and names of current members (at that point of
time) will be provided to the lawyers, thereby, including the name of members
who missed out in the first list.
Kindly be informed that YERWA has negotiated to initially pay
Rs. 100,000/- to each lawyer (YERWA has already paid Rs. 50,000/- per lawyer and
shall pay Rs. 50,000/- per lawyer at a later date). In addition, Rs. 110,000/-
will be paid between both the lawyers towards case expenses (court fee,
stationary, printing, photocopying and other miscellaneous expenses), out of
which Rs. 50,000/- has already been paid to Mr. Tarun Varma and soon Rs.
40,000/- shall be paid to Mr. Sanjeev Singh. These are only initial expenses.
Further expenses shall depend on the intensity and duration of the cases. The
legal team will update the members as and when any development on this front
takes place.
Would also like to inform esteemed members that Mr. Nagin
Chand (President) has already visited Allahabad twice to discuss, prepare and
sign impleadment applications (both occasions, on extremely short notice) and
Mr. Anubhav Kapoor (General Secretary) has accompanied Mr. Nagin Chand once
(both had quite a tiring journey, spending the days at Allahabad and travelling
during the night).
Lastly, once all impleadment applications are filed AND
accepted by the court, thereby, confirming YERWA as third party, the Managing
Committee shall then call for a Special General Body Meeting, wherein, all
registered members shall be invited to attend, updates of court cases shall be
provided and future course of actions shall be discussed/decided. Those unable
to attend the meeting, can send their representatives. However, all attending
shall have to confirm their participation at least a week in advance, so that
the arrangements can be made accordingly.
