ग्रेटर नोएडा के नोएडा एक्‍सटेंशन में अपने घर का सपना देखने वाले लोगों को एक और झटका लगा है. इलाहाबाद हाईकोर्ट ने दो और गांवों के भूमि आवंटन को रद्द कर दिया है. कोर्ट ने पतवारी और देवला गांव के भूमि आवंटन को रद्द किया है.

इससे सात बिल्‍डरों के प्रोजेक्‍स प्रभावित होंगे. इससे सबसे ज्‍यादा असर सुपरटेक, आम्रपाली और अजनारा बिल्‍डरों को होगा. इसके अलावा पटेल बिल्‍डर के प्रोजेक्ट पर भी असर पड़ेगा. आम्रपाली ने इस बात की पुष्टि की है कि उसके निम्नलिखित तीन प्रोजेक्ट इस फैसले से आंशिक रूप से प्रभावित हुए हैं-
ला रेसिडेंशिया- आम्रपाली-पटवारी गांव
लिज़र पार्क- आम्रपाली- इसके 25 एकड़ पटवारी गांव में पड़ते हैं.
लिज़र वैली- आम्रपाली- इसके 65 एकड़ पटवारी गांव में पड़ते हैं.
सुपरटेक का इको विलेज 3 भी इससे प्रभावित होगा.

इससे पहले 6 जुलाई को सुप्रीम कोर्ट ने नोएडा एक्‍सटेंशन की जमीन आवंटन को रद्द कर दिया था. सु्प्रीम कोर्ट ने कड़े लहजे में बिल्‍डरों और ग्रेटर नोएडा अथॉरिटी को कहा था कि आप किसानों का दर्द नहीं समझ सकते, किसान के लिए जमीन उसकी मां के बराबर है. साथ ही सुप्रीम कोर्ट ने ग्रेटर नोएडा अथॉरिटी पर 10 लाख रुपये का जुर्माना भी लगाया था.

इलाहाबाद हाईकोर्ट द्वारा ग्रेटर नोएडा अथॉरिटी के नोएडा एक्‍सटेंशन में शाहबेरी गांव की जमीन के अधिग्रहण को रद्द करने के फैसले को भी सुप्रीम कोर्ट ने बरकरार रहने दिया था. इस फैसले से कुल सात बिल्‍डर प्रभावित हुए थे जिनमें अजनारा, आम्रपाली, सुपरटेक, महागुन, पंचशील और एसजीपी के नाम प्रमुख हैं. इस फैसले से छह गांवों के किसानों को उनकी जमीन वापस कर दी जाएगी. शाहबेरी, सूरजपुर, गुलिस्‍तापुर, बिसरख, जलाजपुर और देवरा गांव के किसानों को इस फैसले से लाभ होगा.

This is really bad for investors in that area. what is the destiny of
Noida Extension !

Land owners may be happy anyway.

ALLAHABAD: In yet another setback to the Mayawati government, the
Allahabad high court on Tuesday quashed acquisition of nearly 600
hectares of land in two villages in Greater Noida.

Acting on a batch of petitions by farmers, a division bench comprising
Justice Sunil Ambawani and Justice S S Tiwari set aside the
acquisition of 589.13 hectares of land in Patwari and Dewla villages,
falling under Dadri tehsil of Gautambuddh Nagar district.

The land was acquired by the state government through notifications in
March 2008 and May 2008 for building residential complexes in Greater
Noida area neighbouring Delhi.

The order came barely a fortnight after the Supreme Court had struck
down acquisition of 156 hectares of land by the state government in
village Shahberi in the area, saying the authorities were "subserving"
private builders in the name of public interest.

The apex court had on July 6 upheld the Allahabad high court order
which had quashed the land acquisition by the Greater Noida Industrial
Development Authority under the urgency clause of the Land Acquisition
Act and directed that the property be returned to the farmers.

The authority and builders had moved the apex court challenging the
high court decision.

Smell RAT, cause UP Elections time!

Wonder if, the Farmers turns to start Farming again!

There is easy way out for them. Sell the land to The Authority/Builder
again.

यूपी सरकार को ग्रेटर नोएडा में जमीन अधिग्रहण के मामले में एक और झटका
लगा है।
इलाहाबाद हाईकोर्ट ने ग्रेटर नोएडा में जमीन अधिग्रहण के मामले में
पतवाड़ी गांव के तहत 608 हेक्टेयर जमीन के अधिग्रहण को रद्द कर दिया है।
अदालत ने अधिग्रहित की गई जमीन को किसानों को वापस करने का आदेश दिया है।
अदालत के आदेश के चलते पटेल इंजीनियरिंग के नियो टाउन प्रोजेक्ट पर असर
पड़ने की संभावना है। इसके अलावा आम्रपाली के लीजर वैली, इरोस के संपूर्ण
प्रोजेक्ट, पैरामाउंट, अजनारा, स्टेलार के जीवन प्रोजेक्ट, अरिहंत,
निराला एस्टेट और सुपरटेक के इको विलेज जैसे प्रोजेक्टों पर भी असर
पड़ेगा। साथ ही अर्थकॉन और पंचशील के हाइनिश प्रोजेक्ट पर तलवार लटक रही
है।
माना जा रहा है कि पतवाड़ी गांव के मामले में इलाहाबाद हाईकोर्ट के फैसले
से सभी 9 बिल्डरों के प्रोजेक्ट अटक सकते हैं। नोएडा अथॉरिटी ने पतवाड़ी
में कुल 608 हेक्टेयर जमीन का अधिग्रहण किया था। कुल जमीन में से 572
हेक्टेयर जमीन बिल्डरों को दे दी गई। बाकी 36 हेक्टेयर जमीन नोएडा
अथॉरिटी के पास थी। साल 2008 में अधिग्रहण के खिलाफ होई कोर्ट में 50
याचिकाएं दर्ज हुई थी।

वहीं कल भी बिल्डरों पर गाज गिरने की संभावना है। इलाहाबाद हाईकोर्ट में
रौजा और याकूबपुर गांव के अधिग्रहण पर कल सुनवाई होने वाली है। इलाहाबाद
हाई कोर्ट में इन गांवों में अधिग्रहण को रद्द करने के लिए 50 याचिकाएं
दायर की गई हैं।

आज जमीन की कीमते इतनी उंची हो गयी हैं, की जिसका प्रभाव हाई कोर्ट और सुप्रीम कोर्ट तक जा पहुंचा हैं, और अब ये दोनो माननिये कोर्ट अधिग्रहण के मामलो को बडी पैनी नझर से देख रही हैं, क्योंकी ये जानते हैं, की जमीनो के मामलो को अब हलके तौर पर नही लिया जा सकता.

यह सब राजनीती का खेल भी हो सकता हैं, क्योकी केंद्र मे कांग्रेस सरकार हैं, और उत्तर प्रदेश मे मायावती सरकार हैं, दोनो के खेल का तरीका अलग अलग हैं. हो सकता हैं, कोर्ट ने जो भी फैसले दिये हो वोह भी राजनीती से प्रेरित हो. आज से पहले तो कही भी किसी कोर्ट ने किसी भी किसान की जमीन आसानी से अधिग्रहण से मुक्त नही कारवाई . यहा तक मुआव्जा भी पुरे ढंग से नही बढाया गया . क्योंकी उन पर सरकारी दबाव जो होता हैं. बेचारे किसान जिनकी जमीने आज से दस- बीस साल पहले अधिग्रहित की गयी थी, वे आज भी अपनी किस्मत का रोना रो रहे हैं.

पर यदि आज के फैसले कोर्ट के अपने मौलिक फैसले हैं, तो उन को साधू वाद देना पडेगा. कम से कम कोई तो हैं जो किसी की रोजी रोटी की तकलीफ को समझता हैं या किसी के अधिकारो और हक की पर्वाह करता हैं.

पर यह कैसे संभव हो सकता हैं, जहा सारे के सारे एक दुसरे की टांग खीचने मे लगे हैं, अपना उल्लू सीधा किया और दुसरा जाये भाड मे. ऐसी सोच वाले देश के लोगो से इस प्रकार की सहानुभूती की अपेक्षा नही की जा सकती. और यह भी संभव हैं, की इन मामलो के पीडित लोगो द्वारा उठाई गयी आवाज और आंदोलनो के प्रतिउत्तर मे ये फैसले दिये गये हो. सारा मामला आर्थिक लाभ और हानी का बनता हैं. किसानो को हानी हो रही थी इसलिये आवाज उठाई गयी . सरकार और कोर्ट दोनो सहम गये . बिल्डरो ने भी समझ लिया की अब पहले जैसी बात नही रह गयी. जहा आस पास के इलाको मे दिन दुनी रात चौगनी तरक्की हुई हैं, वहां उन्हे सस्ते दामो पर कैसे जमीन मिल सकती हैं. और यदि सस्ते दामो पर जमीन चाहिये सीधा जमीन के मालिक से बातचीत की जानी चाहिये .

मुझे तो इसमे राजनीती की बू साफ नजर आ रही हैं.

ये विचार मेरे हैं. जरुरी नही की आप लोग सहमत हो.

Modaji,

Now things have advanced in a certain direction and have gained their own momentum. So it might be possible that starting was inspired by politics but it does not seem to be limited to politics only. Now everything related to acquisition will have to change. I am sure if a case of congress ruled state comes to court, it will have same fate.
