Yeida allottees threaten stir against additional demand

GREATER NOIDA: Nearly four years after the land acquisition row broke out in Greater Noida (west), the aftershocks continue to be felt. Almost 21,000 individual allottees of Yamuna Expressway Industrial Development Authority (Yeida) land have threatened to launch a stir and move court against the Authority's decision to pay enhanced compensation to farmers and passing on the burden to them.

On Wednesday, a group of affected residential allottees also wrote to UP chief minister Akhilesh Yadav, seeking relief from the additional burden.

Ordered by the Allahabad high court in October 2011 to pay enhanced compensation to farmers whose land had been acquired in the area, the Authority has decided that 30,000 individual allottees will have to cough up anything between Rs 550 to Rs 1,770 per sq m to share its burden. Allottees have to pay the extra burden in four installments, once every six months. The first installment is due on October 30, 2015.

According to Yeida officials, all plot owners, who have been allotted land in Yeida, will have to pay this extra amount. Requisite notices have already been sent to them, officials said. "The allottees will have to clear the 'dues' within two years in four installments," said Arunveer Singh, additional CEO of Yeida.

"While allottees owning residential land will have to pay an additional Rs 1,330/sq m, owners of group housing flats will pay Rs 1,770/sq m. Allottees of other categories of land use like institutional and built-up houses will pay Rs 1,770/sq m, while industrial land allottees will be charged an extra Rs 550/sq m. After the court's order, we are required to compensate the farmers with about Rs 6,500 crore. Considering the financial status of the Authority, we have no choice but to pass it on to allottees," he added.

Meanwhile, under the banner of Yamuna Authority Plot Allottees Association, plot owners said they are not willing to shell out extra amount for distribution among farmers as hiked cash relief. "Yeida's sudden demand for extra money from the Yeida after six years of allotment has shocked us. We have written to the CM that this is unethical and illogical, and should be withdrawn," said Sanjeev Kumar, who owns a plot in Sector 20.

"We are middle-class people. From where will we be able to bear this burden," said another allottee, Rajeev Nagar.

"This is totally unfair as despite being promised possession in 2014, we are yet to get our property from Yeida. And now they want extra money to compensate famers," said Yogesh Tiwari, who has a plot in Sector 18.

Angered by Yeida's decision, allottees claimed they are being wrongly burdened. Owners of sectors 18, 20 besides a host of others, will have to shell out anything between Rs 4 and 53 lakh as plot sizes range from 300 to 4,000 sq m.

Dear Arnab Mukherji & Friends,

The news refers to "Allahabad High Court order of 2011" for farmers of
the region! This is quite misleading. We are not aware of any court
order to this effect for the land falling under Yamuna Expressway
Authority. Let us not confuse with it.

Rather the Authority (YEA) is saying that on the lines of the court
orders for the Greater Noida West, where additional 64.7% compensation
has been ordered to be given to the farmers whos land has been
acquired, they decided to pay an extra 64.7% to the farmers whose land
is acquired for sectors 18, sector 20 and others with the condition
that the farmers give sworn undertaking that they will withdraw the
petitions filed against YEA and that they will not file any other
petition against YEA for this land in any court in future.

This extra amount that they have proposed to be paid to the farmers,
after it has been cleared by the UP Govt and ordered to do so by the
UP Govt, will be collected from the allottees of various schemes over
the years, staring with the residential plots scheme of 2009 and
others. The 2009 residential plot scheme has been the largest so far
anywhere, where 21000 plots of size from 300 to 4000 sq.m. were
allotted to general public through fair means, including some to the
farmers whose land has been acquired.

The authority has raised additional demand for Rs 1,330 per sq.m. from
the allottees of residential plots of sector 18 and sector 20 payable
in 4 half-yearly installments starting october 2015.

There are different takes on the issue by various people as everyone
is free to act as they wish and willing to accept the end-result of
their chose option.

We need to act in a manner that we get possession of developed plots
at an early date.

Dear all, I too have analysed the situation and searched the judgments of Supreme Courts. Law is very clear on contracts and any ambiguity in the terms of any documents cannot be used by the authority in their benefits. Unlike the brochure of Sector 22 Scheme, in our case their was no condition which could be used for revival of allotment price. So we are bound by the agreement entered between us. if we analyse the terms and conditions of sector 22 allotment, we find that specific clause was given for enhancement of price of plot in case of enhancement of compensation to farmers.

This post is a true example of what I stated in my previous post.
 
This gentleman... sandeep...@gmail.com... registered on YEIDA Google Group at 12.52 PM and wrote this post at 15.46 PM... exactly 3 hours and 6 minutes after registering himself.
 
And once again, the effort is to mislead the members... by claiming to have searched the judgement of “Supreme Courts”. What this character has done is clearly ignored... Clause No. 18 (v) “If due to any “force majeure” or any circumstances beyond the control of the Authority, the Authority is unable to make allotment or hand over the possession of the allotted plot, the entire deposit amount will be refunded along with simple interest at the rate of 4% per annum from the date of deposit till the date of payment. It is clarified that the month of deposit and the month of refund shall not be counted for the purposes of calculation of interest”.
 
Clearly the intent is to somehow provoke others to create as much as litigation as possible (in doing so benefit oneself by avoiding payment of regular installments on time).
 
Please be aware and warned of such characters and please do not get misguided by such people.

Dear Mr. Safal Suri,

1. I apperciate the level of concern you show to each and every post and the quantity of quality time you spend in reading and analyzing each post.

2. Wheneever we get our plots, your contribution will be a major fator for this to happen.

3. Your involvement keeps the motivation of members high, even in this gloomy environment.

4. At the same time , I afraid you may exaust yourself by venting your energy on each ripple created by a person who has his onw malafied intentions.


5. People now in this group are wise enough and in general people are always wise , when it comes to theire personal finances. so such type of miscreants would not be successful, even if you ignore some posts of them. As you had already scene that 98.5 % of our members are willing to pay additional compensation, but with some certain riders.

6. So my suggesstion is that seldom we can ignore such mails, that clearly are driven out of vested interests of selected few.

Dear Mr. Sharma,
 
Everyday increasing number of allottees/owners are joining YEIDA Google Group. They are most prone to such malafied attempts and can easily get misguided. Such attempts also tend to confuse some existing members.
 
(1) It is for this reason that I take such attempts very seriously and often express my opinions/rebuttal strongly.
 
(2) If not stopped early, such characters tend to get encouraged and make larger efforts to distract the healthy debates taking place in YEIDA Google Group.
 
Mr. Sharma, no one will be more happier than me... if other senior and learned members of YEIDA Google Group... were to assume the responsibility to ensure that nothing distracts and deviates the forums from debating real issues seriously and systematically. The day that happens... I’ll the happiest person and love to retire from the responsibility of moderating the group :)
