Hi Team

I have booked yamuna vihar plot in Jyapee sports city in 2012 at 50:50 plan. Now they are offering possession and demanding rest 50% payment.

I have visited the site and seen no roads, gates, club house & market were there. I approached to Jaypee office regarding this and asked about roads and club house in which they responded that

1. As no one is living over there yet so club house will be constructed once people construct there house over there.

2 We have not constructed roads because it will be broken with trucks when people start construction.

They have charged for club house and internal development of society now they are asking we take money today and will develop later when someone will start living over there.

Please advise the way forward so they develop the necessary things overs there and I should be have time to pay the 50% payment.

Dear Shubham,

kindly go through the agreement and read carefully what had written on payment terms and club house , roads. if it is mentioned that payment will be after construction of roads & club, then you should not pay as per agreement. in that case, Builder can not force for the payment and can not charge intrest also.

Hi Vaibhav

Thanks for reply, I have paid 1.5 Lakh for club house, and also paid for Internal & External development separately.

I approached builder and they said as no one is living over there yet so club house will be constructed once people living over there.

My point is they charged me for club today and will deliver it in 4-5 years or may be more then that.

So how to take it forward legally ?

I have also booked plot in Yamuna Vihar and have received demand notice for balance payment.
 
I had also visited the site and no works has been done on the site as yet.
 
Saw this group today and just joined. Any further updates or action plan friends.

We bought a flat in BPTP in 2010. Got possession few months back and had the same answer. So its nothing different. I think its normal developer's answer.

I am also a buyer in Yamuna Vihar and a retired DGM from a Public Sector bank.
I have filed a complaint with NCDRC taking up all these issues. You can also implead yourself in this complaint to get the benefit of judgement to be delivered by NCDRC.

Dear Friend,

I am a retired DGM from a leading Public Sector bank and own a plot in jaypee Yamuna Vihar. Like you I am also aggrieved at being offered a plot without promised developments by jaypee. I have made a complaint to NCDRC in this regard and it has been admitted by NCDRC. The complaint no is 1100/17. We cannot fight the might of Jaypee individually and in order to make the case stronger all plot buyers must join together. I know that some buyers have joined together with Country Home Buyers to lodge their complaint. I must clarify to them that NCDRC does not allow clubbing together of buyers in different projects to join together and it will be in their own interest to implead themselves in this complaint. My earnest request to all plot buyers is to come together to seek their rights. You can engage an advocate of your choice for this purpose or engage the advocate already engaged by me.
