I am asking authorities to clarify the status on the under stay plots of sector 18.... We have been paying the instalments in time including the additional extra compensation charges. It was supposed to be sorted out in December 2016.....

I think that we will be more stupid to pass on the blame on judiciary for our agony. We applied for plots after the authority invited applications for them. Thereafter, successful applicants were asked to deposit money on periodical basis and we, save and except a few,  are doing that. Later on we came to know that a government agency called YEA have sold us plots which are not in their possession even. Not only that YEA has been charging hefty interest also. YEA now claiming "innocence" saying that there are "stays". Where there are stays, how can a seller demand installment that too with interest? After paying money with interest to a government agency like YEA for plots, why should we approach courts knowing fully well that each litigation is time-consuming and costly affair? I am sure that YEA will quote some fine prints in their brochure to defend their willful default.

Mr Basu,

You do not know the pathetic conditions of Indian Judiciary. While developed counties decide cases in 6 months time our so called hon'ble judges and so called learned lawyers can take 40 to 50 years in deciding the cases of murder of a minister. You may be well aware that there was a judge in Delhi High Court who was favoring a particular lawyer because of having sexual relations with her.

Today the image of Indian judiciary is that if anything to be spoiled take it to court. What Allahabad High Court Judges want to do with the development work.even after 8 years of allotment  there is no sign of development.  Do they want to return the land to farmers? Moreover next generation will not easily approach the courts because simple cases are taking years together in disposing or even for rejection.  It appears the judiciary is still fuctioning as if it was in British rule.

I have no respect for such judges and judiciary who has killed the development, job creation and became nuisance for 21000 people. Can these judges compensate losses to us. Had I got possession in 2013 I would have constructed the house but now banks will not give loan because of age bar.

But people like you appreciate lethargic and corrupt judicial system. Extreme cost  in terms of lawyers fee etc is another curse to the country that a poor man can not get justice. They can not approach High Courts and Supreme Court.

Thanks for your elaborate analysis. 

I too had dreamed of shifting to YEIDA house in 2020 when I sold my plot in Gurgaon for making payments to YEIDA. 

Judiciary has completely failed a common man. May be that is the reason, an average person suffers in silence but does not approach a court. Because, once you approach a court thro' a lawyer, you become the slave of the system and keep on shelling out money even though you get a feeling that the two lawyers are hand in glove and are interested in TAREEKH PE TAREEKH; TAREEKH PE TAREEKH ; ... ;.... ;....

                            I admit that I don't see only the darker side of our judicial system. I know that YEA shifted few pockets of Sectors 18 and 20 on their own. There are few plots which are not in stay and YEA never say anything about them. Any seller with character will offer alternative product when the seller is not in a position to deliver the promised stuff. YEA is floating schemes after schemes keeping us locked in our cells. The question is-who instigated even small farmers to bring stay? Who are financing their legal expenses? It is not difficult to understand that non-government realtors are the benificiaries of our present situation.     

You are at liberty to say that " people like you appreciate lethargic and corrupt judicial system", but I know that whatever ice has been broken is due to the judicial verdict favouring farmers with additional 64% additional compensation.

My concern is even after 8 years of allotment, why there is still stay on over plots. Who is responsible .Extra compensation is to be paid was decided long back. Why stay should not be cleared.

If these judges can not handle cases where such a large number of people have to suffer, why they should not resign or the Government should terminate their services. I feel time has come when these kind of judges should beaten in public. They should not have any regard.They should no more be called hon'ble.

उत्तर प्रदेश के मुख्य मंत्री श्री आदित्यनाथ योगी  जी,

यमुना एक्सप्रेसवे अथॉरिटी ने २००९ में २१००० लोगों को प्लाट अलॉट किये . अथॉरिटी ने ४७५० रुपये प्रिति वर्ग मीटर से रेट फिक्स करके उस पर १२ % ब्याज से किश्त बना कर पैसा वसूलना शुरू किया. इसके अलावा ६४ % अतिरिक्त  मुवावजे के लिए इन २१००० लोगों से पैसा लेना शुरू किया.

किसानों के न्ययालय जाने से इलाहाबाद उच्च न्ययालय ने लगभग सभी प्लूट्स पर स्टे लगा दिया. फिछले ८ वर्षो से अभी तक स्टे ख़तम होने का नाम ही नहीं ले रहा.

इस स्टे से विकास रुक गया है. लाखो लोगो को रोजगार मिलता वह ख़तम हो गया है. यह कैसे न्यायाधीश और कैसा न्याय है जिसमे न्यायधीश को २१००० लोगो को बहुत अधिक आर्थिक हानि पहुचाई और खुद आराम से बैठ कर ऐसे फैसले दे रहे है जिनसे विकास नष्ट हुआ, रोजगार नहीं बढ़ा, जिनोहोने भे पैसा लगाया वह फँस गया.

क्या इन न्यायाधीशों को यह सब दिखाई नहीं देता. क्या यह न्यायाधीश इन सब हानियों की भरपाई कर सकेंगे.

यमुना एक्सप्रेसवे अथॉरिटी के जमीन से जुड़े मामलों से सम्बंधित सभी न्याधीशों की सेवाएं समाप्त करके उन पर विशेष अदालतों में मुक़दमे चलाये जायें . उनकी सारी संपत्ति जब्त की जाए . ८ वर्षो तक स्टे लगा कर ये न्यायाधीश करना क्या चाहते है. इन्हें ना तो विकास से कोई लेना देना है और ना ही रोजगार आदि से.

ऐसा लगता है की ये न्यायाधीश किसानों से कमिशन ले कर फैसला दे रहे है.

कृपया इस मामले में दखल दे कर जल्दी से जल्दी इस जगह पर विकास कार्य शुरू कराएं.

Our AIM should be to achieve our objective rather than apportion blame on others that will be not only counter productive but has the potential to turn the direction of attention on issues that do not solve our problem. Dear Mr Vinod Chadha,

You put your views to achieve the objective,  if you can. YEIDA promised delivery in 4 years but after 8 year we find only stay on over plots, what a stupid system. YEIDA does not know when they will start development and deliver these plots.   In my opinion the Judiciary is inefficient, useless and blind on the interest of 21000 people.

I have written to the CM on his website. I have written to BBC, Supreme Court, Twitter, Facebook and the words used are "SHAME ON INDIAN JUDICIARY". But it appears all these are dead organizations as there is no reaction from anyone.

Further if you want you can worship this kind of judiciary, but I do not have any respect for them. I also say that they do not deserve to be called hon'able.

I suggest a team from YERWA should seek an appointment with Yogiji CM of UP. I am sure, he will ask YEIDA to explain the delay including lethargy of YEIDA. 

All the area is not under stay. YEIDA could develop the area under their control and hand over the plots to the allottees if it wanted.

We have already waited for more than seven years and it is too long a period to be condoned.

Totally Agree with you Mr Brij.

I suggest do not waste further time and file a case in consumer court (state or national commission). It will take time, but ultimately you will get a favourable decision compensating you. 

They have taken additional 4 lakh rupees still did nothing. I have not paid that additional payment. I have filed a case in Lucknow State Commission for compensation for the delay till the time possession is given. You too file a case. The more you get late, the more your verdict will get delayed.

Does this judge, who stayed the process of development, not know that YIEDA is has allotted plots to 21000 people. If he has been given powers it does not mean that he can play with the investment of  21000 people.   What that bastard wants to do. Can he return the land to the farmers? Or can he compensate  these 21000 people by paying interest on the  money we have deposited with the YEIDA? leave the rent of the land and the higher cost of construction. He can at the most give higher rate of compensation and take his commission. I  feel such judged should be terminated and prosecuted to recover the losses they have made to the public and to the nation. Even the capital punishment for such judges may not be sufficient.

I do not know why you are appreciating act of judges for the damages caused by the judiciary.  You may be well aware of Delhi High Court Judge Mr charrejee s case, who used to favor a female lawyer.   Please search "sex cd of abhishek manu singhvi" . You will come to know how judges are appointed and how much harm they can do for their personal benefits.

इस प्रणाली में कितना भ्रष्टाचार है वो हमने
अभिखेक मनु सिंघवी की सेक्स सीडी में देखी थी .. अभिखेक मनु सिंघवी सुप्रीमकोर्ट की कोलेजियम के सदस्य थे और उन्हें दिल्ली हाईकोर्ट के लिए जजों की नियुक्ति करने का अधिकार था... उस सेक्स सीडी में वो वरिष्ठ वकील अनुसुइया सालवान को जज बनाने का लालच देकर उसके साथ सेक्स करते है ... और उस सीडी में जैसे ही अभिसेख मनु कपड़ा उतारते है वैसे ही अनुसुइया पूछती है --"जज कब बना रहे हो?"

कलेजियम सिस्टम से कैसे लोगो को जज बनाया जाता है और उसके द्वारा राजनितिक साजिशे कैसे की जाती है उसका दो उदाहरण देखिये ..किसी भी राज्य के हाईकोर्ट में जज बनने की सिर्फ दो योग्यता होती है ..वो भारत का नागरिक हो और १० साल से किसी हाईकोर्ट में वकालत कर रहा हो या किसी राज्य का महाधिवक्ता हो ..

वीरभद्र सिंह जब हिमाचल में मुख्यमंत्री थे तब उन्होंने सारे नियम कायदे ताक पर रखकर अपनी बेटी अभिलाषा कुमारी को हिमाचल का महाधिवक्ता नियुक्त कर दिया फिर कुछ दिन बाद सुप्रीमकोर्ट के जजों के कोलेजियम में उन्हें हाईकोर्ट के जज की नियुक्ति कर दी और उन्हें गुजरात हाईकोर्ट में जज बनाकर भेज दिया गया ...क्योकि कांग्रेस गुजरात दंगो के बहाने मोदी को फसाना चाहती थी और अभिलाषा कुमारी के द्वारा दिए गये कई निर्णयों को सुप्रीमकोर्ट ने बदल दिया |

1990 में जब लालूप्रसाद बिहार के मुख्यमंत्री थे तब कट्टरपंथी मुस्लिम आफ़ताब आलम को हाईकोर्ट का जज बनाया गया .. बाद में उन्हे प्रोमोशन देकर सुप्रीमकोर्ट का जज बनाया गया ... उनकी नरेंद्र मोदी से इतनी दुश्मनी थी की तीस्ता, और मुकुल सिन्हा गुजरात के हर मामले को इनकी ही बेंच में अपील करते थे ... इन्होने नरेद्र मोदी को फसाने के लिए कैसे अपना एकमात्र मिशन बना लिया था ..

बाद में आठ रिटायर जजों ने जस्टिस एमबी सोनी की अध्यक्षता में सुप्रीमकोर्ट के चीफ जस्टिस से मिलकर आफ़ताब आलम को गुजरात दंगो के किसी भी मामलो की सुनवाई से दूर रखने की अपील की थी
..जस्टिस सोनी ने आफ़ताब आलम के दिए १२ फैसलों का डिटेल में अध्ययन करके उसे सुप्रीमकोर्ट के चीफ जस्टिस को दिया था और साबित किया था की आफ़ताब आलम चूँकि मुस्लिम है इसलिए उनके हर फैसले में भेदभाव स्पष्ट नजर आ रहा है..फिर सुप्रीमकोर्ट नेजस्टिस आफ़ताब आलम को गुजरात दंगो से किसीभी केस की सुनवाई से दूर कर दिया ..

सरकार क्यूँ हैरान है NJAC कानून रद्द होने पर --
ये तो होना ही था -
सरकार अब कॉलेजियम में सुधार पर SC का बहिष्कार करे --
सुप्रीम कोर्ट के NJAC कानून रद्द करने के फैसले पर सरकार को हैरान नही होना चाहिए था --मुझे तो इस फैसले की शुरू से ही उम्मीद थी जिसके लिए जस्टिस आर एम लोढ़ा बीज बो गए थे और एक तरह सुनिश्चित कर गए थे कि ऐसे किसी भी कानून को रद्द कर दिया जाये जो कॉलेजियम के खिलाफ हो --
सुप्रीम कोर्ट को इस फैसले पर लोगों की आलोचना झेलने के लिए तैयार रहना चाहिए --सुप्रीम कोर्ट ने कानून रद्द करके सरकार के साथ टकराव का रास्ता अपनाया है --इस कानून को रद्द करना देश के लोकतंत्र पर सुप्रीम कोर्ट का कुठाराघात है
क्यूंकि ये कानून संसद के दोनों सदनों ने सर्वसम्मति से पारित किया और 20 राज्यों की विधान सभाओं ने भी पारित किया-

सुप्रीम कोर्ट ये भी भूल गया कि इस कानून को ऐसी पार्टी की सरकार ने पारित किया जिसे 30 बरस बाद देश की जनता ने स्पष्ट बहुमत दिया --4 जज बैठ कर करोडो लोगों की इच्छाओं का दमन कर सकते हैं क्या, बस इसलिए क्यूंकि वो सुप्रीम कोर्ट हैं --
अगर NJAC असंवैधानिक है तो कॉलेजियम तो उससे भी ज्यादा
असंवैधानिक है क्यूंकि जिस तरह की खामियां सुप्रीम कोर्ट ने खुद गिनाई हैं कॉलेजियम में वो साबित करती हैं कि वो सबसे ज्यादा असंवैधानिक प्रणाली है जिसमे ना पार्दर्शिस्ता हैं और ना ईमानदारी है --भ्रष्टाचार है और जिसने न्याय व्यवस्था को सुधारने में कोई विशेष योगदान नही दिया-बस इतना जरूर है कॉलेजियम में कि इसमें सुप्रीम कोर्ट की चौधराहट है और कांग्रेस सरकार के साथ कंधे से कन्धा मिला कर काम हुआ है -

सुप्रीम कोर्ट का ये टकराव मेरे ख्याल से आगे भी जारी रहेगा सरकार के साथ क्यूंकि अदालत में मौजूदा 28 में से 20 जज कांग्रेस सरकार के समय में नियुक्त हुए हैं, वर्तमान सरकार ने अभी तक कुल 8 जज नियुक्त किये हैं --
सुप्रीम कोर्ट ने कॉलेजियम में सुधार के लिए सरकार से और अन्य सम्बद्ध पक्षों से सुझाव मांगे हैं --मेरे विचार से सरकार को कोई सुझाव नही देने चाहियें और 3 नवम्बर से होने वाली सुनवाई का बहिष्कार करना चाहिए -सरकार को अदालत को स्पष्ट कह देना चाहिए कि जो करना है खुद कीजिए, हम कुछ नही बोलेंगे -
सुप्रीम कोर्ट को कॉलेजियम में सुधार के लिए सरकार के या किसी के भी सुझावों की क्या जरूरत है-वो तो खुद ही सक्षम हैं सब कुछ करने के लिए --सरकार ने तो कॉलेजियम में सुधार के लिए ही तो NJAC कानून बनाया था जिसे आपने फाड़ के फेंक दिया --
अरे 23 साल से खामियों भरा कॉलेजियम चल रहा है जो फेल हो गया --अब कुछ दिन NJAC कानून भी चले देते --
इसमें कुछ खामियां देखते तो उसे दूर करने की कोशिश करते --मगर नहीं, लगता है अदालत भी मोदी को काम ना करने देने के लिए उतावली है --
जज खुद अपनी नियुक्ति करें ऐसा विश्व में कही नहीं होता सिवाय भारत के --

मुझे समझ में नही आता की जब कुछ सीनियर आईएएस मिलकर नये आईएएस की नियुक्ति नही कर सकते ..या कुछ प्रोफेसर मिलकर नये प्रोफेसर की नियुक्ति नही कर सकते ,... तब जजों को खुद ही जजों की नियुक्ति का अधिकार क्यों ?

There are many such instances of the likes of Abhishek Manu Singhvi. 

YEIDA is not alone. Look at the development of Dwarka Expressway since 2003; much older than Yamuna Expressway.The whole project is messed up because of stay orders of various courts.  Exit from Pankha Road flyover to Dwarka is messed up by courts. Billions and billions rupee projects where lakhs of people have invested in Navi mumbai are in doldrums. People are paying loan installments and waiting for their dream houses for the past more than 10 years. Many must have expired by now. WASTAGE OF NATIONAL RESOURCES. 

Many times I think. WE INDIANS ARE VERY RICH AS WE CAN WASTE SO MUCH OF OUR RESOURCES. 

I do not know if our views are construed as contempt of court.

You are correct on one fact and completely  wrong on other.

Yes, the decision to distribute extra compensation to the farmers was NOT decided by any court.

However, Shri. Santosh Yadav, then CEO of Yamuna Expressway Authority, in consultation with the farmers of the area and as a result to popular demand, proposed to offer additional competition to only those farmers who were willing to withdraw their court cases and sell directly to the authority. 

Thereby breaking a long drawn stalemate between the authority and farmers. (The development that you see today {possession of 55 plots and soon to be given possession of few thousand plots}, howsoever limited it maybe, is direct result of the efforts of Shri. Santosh Yadav).

Mr. Yadav then sent the said proposal to UP Government and it was the cabinet who decided the said policy via notified government order.

Please get your facts right. Better not to say anything if you don't know the actual facts.

Wrong information generally leads to misunderstandings that may result adversely to public interest.
