Eligibility for Greater Noida scheme(BHS-15/2012)

Dear Members
I had purchased a plot in Greater Noida from open market in 2005. I have subsequently got in transfered and registered in my name. Thorugh this forum I would like to know if I am eligible to apply for built up house/flat in the latest scheme launched by Greater Noida Authority (BHS-15/2012).
 
A doubt has crept into my mind beacuse of the following clause given in the eligibility criterion (general categary) 

 

QUOTE

(ii) He/she should not earlier been allotted any residential plot or flat or house, in full or in part, on lease hold or free hold basis or under HPTA (Hire Purchase Tenancy Agreement), License Agreement by the Greater Noida Industrial Development Authority either in his/her name or his/her spouse name or in the name of his/her minor or dependent children, under this category."

UNQUOTE

The questions are

1. Will the purchase from the open market be treated as an allotment by the Authority and thus rendering the purchaser ineligible to apply in any subsequent schemes launched by the Authority?

2. Will such a scenario emerge in subsequent schemes of YEIDA also?

Dear Anil,
 
All 3 authorities in Gautam Budh Nagar district, namely Noida Authority, Greater Noida Authority and Yamuna Expressway Authority, have similar policies.
 
Once a member of a family owns a property (either by draw of lots or purchase from open market) in a certain authority, he/she and his/her dependents, cannot apply for draw of lots, whenever a scheme is launched in the said authority. Please remember, a member of a family is anyone who constitute a family, including dependent children and elderlies. However, every individual is free to purchase as many properties as he/she desires from open market.
 
Therefore, now that you have a property in Greater Noida, technically you and your family members are ineligible to apply in draw of lots.

Another small clarification- does that also make me ineligible to own any builder flat in Greater Noida? And does that also imply that if an individual has a builder flat, even he is ineligible to apply in authority residential schemes?

Dear Safal Ji,

Please confirm if the rule is a standalone rule for each of the three authorities in the region i.e. if i hold a plot in YEA can I still apply for a plot in GNIDA?

Yes ..if area comes under different authority then you can apply for the same. Does not matter if you are having n numbers of property elsewhere.

Yes, the rule is standalone rule for each authority. If you have a property in one authority, you can still apply in a scheme announced by another authority if you don’t have a property under jurisdiction of the said authority.
