सुप्रीम कोर्ट ने यमुना (ताज) ए1सप्रेस-वे के नाम पर प्राइवेट टाउनशिप के
लिए अधिग्रहीत अतिरि1त जमीन के मामले में सोमवार को यथास्थिति बनाए रखने
का आदेश दिया है। शीर्ष कोर्ट ने मामले में जेएस हॉर्टीकल्चर प्राइवेट
लिमिटेड, नंदकिशोर गुप्ता व अन्य किसानों की ओर से दाखिल याचिका पर राज्य
सरकार, यमुना ए1सप्रेस-वे प्राधिकरण, जेपी इंफ्राटै1ट लिमिटेड सहित अन्य
पक्षों को नोटिस जारी किया है। इससे पहले, इलाहाबाद हाईकोर्ट की लखनऊ
बेंच ने अधिग्रहण पर रोक लगाने की मांग वाली याचिकाओं को खारिज कर दिया
था।

जस्टिस अल्तमस कबीर नीत बेंच के समक्ष याचिकाकर्ता के वकील प्रशांत ने
तर्क दिया कि जनहित में सड़क बनाने के लिए राज्य सरकार ने भूमि अधिग्रहण
अधिनियम के अंतर्गत अधिसूचना जारी की। बाद में पता चला कि सड़क बनाने के
नाम पर यह जमीन टाउनशिप के लिए निजी कंपनी को दी जा रही है। उनके मुवç1कल
की 3.342 हे1टेयर भूमि इंटरचेंज लूप निर्माण के लिए अधिग्रहीत कर ली गई।
उन्होंने कहा कि सड़क और उससे संबंधित जरूरतों के लिए भूमि अधिग्रहीत करना
तो ठीक है, लेकिन किसानों से अतिरि1त जमीन अधिग्रहीत कर निजी कंपनी को
फायदा पहुंचाना गलत है। बेंच ने मामले में राज्य सरकार सहित तमाम पक्षों
से चार सप्ताह में जवाब मांगा है।

मामला 1या है ज् उप्र सरकार ने गौतमबुद्ध नगर से आगरा तक जाने वाले यमुना
ए1सप्रेस-वे पर पांच व्यावसायिक, औद्योगिक व रिहायशी टाउनशिप विकसित करने
का निर्णय लेते हुए इसके लिए 2003 में एक निजी कंपनी से अनुबंध किया था।
इसके बाद सड़क बनाने के नाम पर भूमि अधिग्रहण के लिए राज्य सरकार ने
अधिसूचनाएं जारी की थीं।

there is no need to discuss on this forum for payment plans , buy sell of plots, till the issue is resolved with farmers.
 
It may also this scheme may get cancelled.
 
If they have taken land from villagers only from maing YEW then this scheme may get cancelled.
 
So no need to pay the premiums at all and we all should go there and ask then clearly about the scheme going forward.
 
Any views...please add

From the news we have read so far, it appears to be directed at JP
Scheme and some Interchange Land near Mathura or Hatras.

And the nature of the dispute is not significant to raise alarm.

There's ambiguity in the interpretation of the SC Verdit... if you
read the news it talks about the Land allotment to private builders
for township. Someone from the group has checked with the authority
abt the news today and they have confirmed that SC Verdit refers to JP
only. The land alloted to us is by UP Govt. Authority.

Dear Means,
Your understanding is correct. Anyways, visiting YEA's Information
officer, just to ask this question about SC Verdict could be a futile
exercise because they bound by their own policies and procedures.

However news article, publishing clarification from CEO / Dy CEO YEA,
would be credible to us.

I still do not beleive ....till it is confirmed from YEIDA.
 
We have to ring them and have to ask such question before we deposit money that is due in JAN.
 
It have been named Yeida so housing scheme will also come into this...
 
Even most of the newspapaaer have published name "Yeida"
 
So its a suggestion that we clearly ask Yeida.

lane Yamuna Expressway Project connecting Noida to Mathura by
dismissing a bunch of writ petitions challenging acquisition of land
by the state government.

Reason for posting old news is that this talks abt the Land Acquistion
notice to YEIDA. Although Allahabad High Court has already approved
this project. And quite possible the same has been raised by
petitioners at SC also. I am not sure on this

Dear Means,
Allahabad High Court has already given approval on YEW (Just the
expressway). But this dispute in primarily directed towards Sector 25
JPSK.
To put things in perspective, this dispute involves J.S.HORTICULTURE
P.LTD and UP Govt. is over few HA of land out of a total of 1000 HA.
So it appears to be a private company against another private company
over land acquisition. J.S.HORTICULTURE P.LTD doesn't seem to be the
original farmer of that place.

- Is it the first time that Government has taken acquired land from
the Farmers and distributing for housing purpose on its own (Not
through any private organization).
This scheme (YEIDA) does not have any private player in it.
- JP is asking from 18000 sq yard for one of its scheme. Is it for a
disputed land?
So the conclusion is obvious: Yeida is much more authentic and cheap
and this will result in more increase in premium.
(I believe there is no scheme which will come in near future and in
such a cheap rate.) (WHere is GNIDA scheme ?)
Even in case of private players the solution might be adequate
compansation.)

Can you see that Yeida is also in the list.....
 
We do not know for which sectors Yeida is involved, i smell that all our sectorrs 18-20 are not affected by this notice.
 
We can clear with yeida before we make our payment.
 
Issue seems to be critial now

Dear Neeraj,
We all have the same information. YEIDA is a long term investment. So
put your money and forget about this place for many years.

As of now, lets hope YEW finishes or at least opens up by next year
end. That will open up lot of avenues in this virgin land.

There is news of Noida and farmers have making a big issue in this....Hope other villages will follow this soon and we will also might be affected by this..
 
 
Do not know the future of Yeida and also whether we would be having our houses in sec 18-20.

God knows what will happen to this scheme.
There is a lull in the market now.
I was irritated by the SMSs sent by Proporty dealers to sell it at a
high premium.
Now my mobile silent. Thats the best part.

If supreme court decision regarding ban on acquistion is true, best
you can do now is wait till 7th January & not deposit your money. The
next hearing is on 7th Jan 2010. Also I want to tell you that this is
not a single petition. There are near about 35 petitions against land
acquistions by YEA. Supreme Court has decided to hear all petitions
together.

Also one more point, supreme court has ordered of status quo as of
today. This is not final decision. This is just interim order by court
till next hearing.

Dear friiend don't try to overlook the things..what are the bases of
increasing the premium?once the things go to court everything comes to
stanstill and don't leave in the darkness face the truth....the
petitioners have a strong ground..so even if you are a allottee don't
overlook the facts.

i personally think that this is not a big issue as same problems were
faced in noida sector 105 and 108 allotments.The case lingered on for
few years and then was cleared by the court. We as yrida allottees
have plenty of time for these case. Any land accutitions case is
always solved in favour of majorityof peole affected by the decision.
And this is not a nandigram fight.to coclude ill only say "ALL IS
WELL".

Dadri fallout: protests against other projects could get louder

Lucknow: The Allahabad High Court’s order cancelling land allotment
for the 7,480-mw gas-based power project at Dadri in Ghaziabad
district of Uttar Pradesh is likely to give a fillip to other such
fledgling agitations against land acquisitions in the state.

Only last year in August, as many as five people were killed in the
police firing on farmers protesting against inadequate compensation
for land being acquired for various infrastructure projects in the
Greater Noida region bordering the national capital.

The Mayawati government has announced a slew of development projects
in the state, including the ambitious Ganga and Yamuna expressways,
international airports at Kushinagar and Meerut, power projects,
besides new townships spread across 1,000 acre on the peripheries of
major cities. More expressways have also been conceptualised along the
major rivers that cut across the state.

The Yamuna Expressway, for example, work on which is in full swing, is
expected to drastically reduce the travel time between the national
capital and Agra. Though land has been acquired for the expressway
itself, acquisition of an additional 2,500 hectare to build land
parcels alongside the expressway has been facing opposition from
villagers.

The 1,047-km Ganga Expressway too, which would pass through 18
districts from Ballia to Greater Noida, has been facing opposition
from farmers’ groups. While some of them are openly rebelling against
handing over the land, others are ready to come to the negotiation
table but want increased compensation.

In fact, the most sought-after place is western UP, where farmers are
sitting on the periphery of many development projects. The Ganga and
Yamuna expressways passes by the area. Aligarh, Bulandshahr, Hathras
and Gautam Buddha Nagar are the development nodes where many new
projects are being contemplated. Even the Eastern Railway Freight
Corridor and the Delhi-Moradabad National Highway cross these places,
therefore requiring huge tracts of land in these districts.

The Rs 560-crore Kushinagar airport project, bids for which will
shortly be invited, has also been facing protests from angry
villagers. The government has also faced a lot of resentment in
acquiring land for the 200-acre Lucknow Industrial development
Authority (LIDA), the industrial enclave along the Lucknow-Kanpur
Highway. Even four years after being mooted, the project is yet to see
any major breakthrough. The idea behind LIDA was to present industries
with an option other than Noida and Greater Noida.

Dear All,

Just now came from from authority office, spoke to one of their
officer, they have confirmed that SC ruling has nothing to do with
these allotments and is for JP project only. So we don't need to worry
on this ...

We all know it nothing to do with YEIDA allotments as of now
But the truth is land is yet to be acquired, and if one ruling goes
favorable to farmers protest, then we all can land in big trouble.
As It will become basis for other decisions to come.
I guess YEIDA has done its homework and filed for caveat in SC, to
excuse itself from further stay orders.
they are doing there best, we can't be sure of anything, but hope for
the best.

Deals have been happening, people are divided on opinion of path
ahead.but 90% views are YEIDA allotment wont get cancelled, it could
get delayed.

I guess tranfer opening will give a positive vibe
