I just wanted to share my experience with UPRERA for whomsoever may benefit from my experience.
1. I was allotted a 86 sqm flat by GNIDA under their BHS12 scheme in ETA-02 sector of Greater Noida.
2. The possession was to be allotted by year 2012 but due to various reasons like land acquisition etc the possession was not offered even in 2018.
3. After UP-RERA was formed in UP I consulted two advocated in Greater Noida to know if I can lodge complaint against GNIDA under UP-Rera.
4. Both advocates discouraged me and said GNIDA does not come under UPRERA and there is no use filing a complaint against GNIDA because they will go by the brochure terms and you can get refund with only 4% interest.
5. Still after deliberations I decided to file a complaint online in Feb 2018. The complaint filing process was very easy and completely online.
6. Later two or three hearing dates were postponed which discouraged me and I thought UPRERA is just like any other court and the will keep allotting dates and changing venues.
7. Finally in June the date was not postponed and I attended the Hearing at Rera office in Lucknow. I was ready with all supporting documents etc.
8. I did not hire any advocated and there were to advocated from GNIDA side.
9. Our case was heard and I never felt a need for any advocate.
10. Finally my case was disposed in my favour in July 2018.
11. The GNIDA was instructed to refund with 9.25 interest. But GNIDA did not respond.
12. I made several representations to GNIDA reminding them about UPRERA order and even made a visit to GNIDA office.
13. GNIDA officials tried to scare me and told that they will further fight the case.
14. Still I persisted and kept contacting UPRERA and GNIDA.
15. Finally the UPRERA issued a recovery order against GNIDA. My money was recovered and refunded to me in April 2019.
It took almost one year but dealing with UPRERA was easy even for a non legal person like me. Some would say that 9.25% simple interest is too low but I am satisfied that the fight has ended well for me. If you think you are being cheated by any govt real estate agency do not hesitate to approach UPRERA.
