Finally! A three foot passing law...almost.

Do what you can to support this (spreading the word is a start). Three feet is much better than the current law. Five feet would be that much better.

If we get a three foot law, we can all buy this jersey (I recently acquired the one that does not say "It's the law" on the front).

AN ACT concerning the operation of motor vehicles in certain cases and supplementing Title 39 of the Revised Statutes.

 

Requires motorists operating vehicles to maintain minimum three foot safety distance when overtaking bicycles.

 

AN ACT concerning the operation of motor vehicles in certain cases and supplementing Title 39 of the Revised Statutes.

BE IT ENACTED by the Senate and General Assembly of the State of New Jersey:

    1.  The driver of a vehicle overtaking a bicycle proceeding in the same direction shall leave a safe distance between the motor vehicle and the bicycle of not less than three feet until the motor vehicle has safely passed the bicycle.  Any person violating the provisions of this section shall be subject to a fine of $100.

    2.  This act shall take effect immediately.

 

STATEMENT

This bill would require motorists to maintain a distance of at least three feet when overtaking a bicycle that is travelling in the same direction.  The bill provides for a fine of $100 for violating the three foot minimum distance requirement while overtaking cyclists.

    Two weeks ago we met in New Brunwswick with the NJ Bpac (bicycle and pedestrian advisory council), and we were formulating plans for one half a lane passing distance, and this three foot measure came sort of out of no where, and not in coordination with the Bpac. The BPAC has important people from the NJ DOT as members, so they are involved in the process of getting laws changed. I just wish the legislators had contacted them first to see what people were working on.
    I am communicating with the BPAC to see if we can go back and forth with the legislators...we’ll see.
    We need a more coordinated policy formulation process in NJ, especially with all these people getting killed now (See my blog for the last death, a hit and run, in Sparta, NJ, on March 1,  http://benepesbikeblog.blogspot.com)
