Hi Mike, 

Thanks for reaching out. I might be able to make the call today, but if not I will definitely be on another one in the next few days. I learned yesterday that in 2012 the General Assembly passed a resolution calling for the federal government to propose an amendment that addresses Citizens United/campaign finance reform. One of my good progressive friends believes that an Article 5 constitutional convention that circumvents Congress would open the door for a balanced budget amendment, and so he opposes that strategy. But he also seemed to concede the point that Congress itself would never propose an amendment with any real teeth. What is your take on that issue?

To assuage any fears of a "runaway convention" I have in the past petitioned the General Assembly to include the following language in a resolution calling for an Article V convention:

Resolved, that the delegates sent to such convention shall be under oath to consider and vote on only those proposed amendments relevant to the subject matters enumerated above, and that the State of Rhode Island and Providence Plantations considers the requirements of Article V to have been met when, within ten years, two-thirds of the state legislatures shall have passed a resolution calling for a convention exclusively for the same or similar purposes, and whose resolutions also bind their delegates to the subject matter for which we call this convention.

The idea of a "Runaway Convention"  is a myth put forward by people who are super happy with the status quo and don't want change.  In Article V. of our Constitution it's very clear that a convention of the states would only be a place to propose ideas or amendments, and then anything proposed would still need to be ratified by 75% of our State Governments.  That super high threshold nullifies any chance of anything radical becoming part of our Constitution.  So the only question is, do you want Congress proposing ideas about how to fix money in our political process, or a different avenue through a a convention?  For Wolf PAC the answer is extremely clear since Congress is currently broken beyond all hope.  If we organize at the state level around this issue we can do this folks.  

Rhode Island is a state we know we can get on the board, and we can certainly find someone to introduce our Resolution, so if you want to get involved reply to this email or call me anytime and I'll get you up to speed on how you can get started.

I agree it's a myth, but it is nonetheless a fear that Wolf-PAC must overcome. If you only dismiss it as unreasonable, it's not going to go away. Remember, what you are asking to do is entirely without precedent. In the history of our country, at no point has this clause of the Constitution ever been invoked.

It would be very easy to include my above language in any draft resolution. It eliminates the issue entirely. When the convention is called, all of the states who called it have bound their delegates to only that specific subject. Any vote on anything else would legally have taken place outside the participants' legal role as convention delegate, and thus be null and void.

It might be a good idea for Wolf-PAC to also start the ball rolling in terms of the other argument: "How would a convention operate?" The U.S. Senate passed a bill, back in the 70s, that would outline exactly how a convention would operate (using their power under the Necessary and Proper Clause). Perhaps get in touch with Congressmen who agree with Wolf-PAC to start introducing this bill again.

William, I think the language you suggest for the resolution should resolve any issues that folks might have about the "runaway convention". The second issue you raise has also been on my mind. Who funds the conference, for instance? Could we really get Congress to pass a bill that outlines how this kind of convention would operate? That seems like a difficult objective to achieve. That's why we want the Article V convention -- to circumvent Congress right? 

What would happen if 34 states passed resolutions to hold the convention, but there is not operation manual or rule book for organizing it? That seems like it could get chaotic pretty fast.

If the delegates are paid for their services, then Congress would have to appropriate any money for that purpose. Having Congress pass a law outlining how an Article V convention would function wouldn't defeat our purpose of circumventing Congress when it comes to actually proposing the amendment.

Congress needs to outline how a convention would function because the Constitution itself doesn't say anything about it. How many delegates would each state send? How long are they allowed to convene? All of these issues would have to be settled via law before the convention could begin.

But doesn't that get us back to the original problem? What incentive would Congress have for passing a law to govern these conventions? If you could get Congress to do that, then we would be able pass an amendment, no?

There are actually people working on the specifics now.  A convention is definitely happening and we just need to make sure there are as many states as possible with Resolutions calling for a Convention of the States to deal with the influence of money in our political process.

Hi everyone,

Along with Mary and Jake Redway, I just finished the NH Rebellion walk. I figure I did somewhere between 90-120 miles, and especially thankful for our 4 or so folks that did the whole thing.

I am quite certain it would be possible to expedite getting Article V pushed in our legislature, but the question is first getting the legislation written that meets RI requirements. Anyone feel like they could take point on that part?

Regarding legislators that would put it in motion and push for it, that is remarkably do-able.

By the way, our Democratic gubernatorial candidates are pushing for the People's Pledge... not exactly certain they're going to do a remarkable job of settling on terms, but we'll see.

Hello fellow Rhode Islanders ! I'm Lorraine Farrell, a life long Rhode Island resident, living in East Greenwich, who would love to see America's democracy restored while I am still alive . It's hard to see my country in this shape and knowing there are a growing number of citizens who haven't really lived in a country with anything close to a democracy-it's not the legacy I want left to them when I pass.

Hello all. I'm Frank from Woonsocket. Genuinely excited about the effort, been considering joining it for awhile. Cenk talking about our duty to posterity and his example about universal suffrage got me riled up. What if I had sat out that fight!
I'm in Senate district 24, Marc A.Cote and Stephen M. Casey is my Representative, district 50.
I've never participated in politics beyond debate and exercising my franchise. I'll need to get up to speed on what we need to do. Phone calls and letters to the editor I can do no problem. I don't work on many Fridays so am available if need be (to crank the handle on the Xerox machine).
I'm 54, used to be a Republican but voted Nader in 2000 and disaffiliated in 2001, when Jim Jefford did. Independent now who rarely votes GOP in any race. I blame it all on Howard Zinn, 'A People's History of the United States' made me fundamentally rethink my politics. Skeptic, atheist, progressive.
Enough about me, let's get to work.

Hello my name is Bob Raphael and I live in Scituate.  I am 67 years old and fear for the future of this country.  While I perceive many problems needing to be resolved, the core issue is the obscene impact of money on politics, which has only been exacerbated by the Citizens United decision. Proud to join this group.

Hi my name is Janelle. My primary address is in Rhode Island. I can definitely get a few signatures from friends and family in the state. I'd love to get involved in anyway possible. I'm tired of politicians passing legislation benefitting the enormously wealthy and no president will ever be able to do great things again until this decision is overturned. I'm especially interested in getting involved since Bernie Sanders is running and if he wins he'll get extreme opposition from all sides.
