Retaining or selling off is owners' choice. However, such people who plan to sell, better not propose or support the "taking over" option while talking to the developer. Such owners sell off and go away, leaving the others to take trouble.

Plans, numbers and calculations will look nice on paper. Reality will be quite different.

Maintaining ourselves or letting out the entire plot for lease are not practical ideas and very risky too. Who has the band-width to manage? Even if we employ some clerks/sub-contractors, these people again need close monitoring. Those who are proposing that solution, will they shoulder the responsibility? Just close your eyes and imagine what are all the things that need regular maintenance. The list will be quite long.

Or you prefer to pay and let the developer manage with no hassles for us? That is the choice we should make.

So, what I suggest, even those people like Maurya who are planning to sell their sites please support the original arrangement. They can pay the maintenance fee that is due and after they sell, that responsibility comes to the new owner.

All the above is with the expectation that the developer will agree. If he is adamant on leaving the management, we will have a problem in convincing him to continue. We should realize this.

The 4 lane work is in progress. The value appreciation will be high in the coming 5 years as the Malur-Hoskote road will be an important road. Other developers/builders are already on this area. So, flats are likely to come up soon. Who knows, building a house in our own sites might become attractive in a couple of years.

This is not practically not workable procedure.
It is better to pay maintenance charges to the builder and ask him to maintain only. I think we all purchased the sites by seeing his maintenance work only. Why can't we go with him only. We will not have any headache for next 3 years. P
As I said earlier I am also a owner of 1200 sft site.

Regarding  "Handing over Maintenance Authority"


I have few suggestions 
1- we should  form association and  take handover .
As Bulder dont have any plots to sell we wont be see any progress on upkeeping of windsor plots .
His interest would be only in getting maintenance which would be 
for 3 years estimate
25K * 250 plots =  52.5 lakhs  or more 
Plus 10 to 14% PA  interesest if invested properly.

2- Rather lease out for 3 years our plots as group to someone if they want to put small scale factory .
Like RO water botteling plant or cattle farming 

Idea is to generate revenue out of these 

3-  
a) my above suggestion is based on guess that people wont use these plots for another 5 years for residential purpose 
b) Property rates are still at the 3 year old price

4- Hire Another contractor for Upkeeping .
5- pay maintenance  after 3 months for every quarter .after review of township
    Puts funds in association and to be released  to builder only after review  (fprm association for that)

Note that Other builders were charging Rs15 per sqft  for 3 years and also were providing better infrastructure ( under groud cabeling, Cement road, canals etc) check with SLV builder and Confident group

It may not be as simple as we tell him and then he agrees automatically.
As such there are 275 plot owners and only about 80 are in this mail list. What about the rest? Are all owners getting informed some how? Is the developer keeping in touch with every owner?
We have to hear the developer tell about this.

Also, the developer complains that, last year hardly 5 people paid the money. I think, it happened due to the talk of forming association but it did not happen then, nor we all paid him. So, he is angry. I guess that is the reason he now insists on the meeting so that the matter will be settled once for all.

Finally, here are my views -
1. forming association and maintaining is a big job, none of us have the skills, experience and time to do this.
2. If we engage some one else - 
A) there is no guarantee that it will work out cheaper or the same
B) there is no guarantee that he will do at least as much maintenance as this developer is doing.
4. The developer is in this business, he knows the area, the people, the workers. We will have to start from scratch.
5. I once spoke to him, the list of tasks for regular maintenance is very long indeed. We do not have the ability to manage the contractors, we will get fleeced if we engage another contractor.
6. Letting out to some organic farm or other may not work out. There are many practical & legal hassles in that.
7. In my assessment, best if we convince him to continue and promptly pay up. At least he is somebody that knows his job and who has some interest in doing so. He will be the single point contact for all of us.

I am bit hesitant to give it to external guys for lease or some business. May be we can do one thing, we can hire a Organic farming agency and interested plot members go for organic farming in respective plots, agency guy will maintain it and whenever vegetables are ready he will inform respective plot members and we can go and collect vegetables or if in bulk he can deliver door to door also. but we may need one auditing guy also for this.

I agree with the idea to pay builder for next 3 years and keep a tab on that. May be we can push builder to give maintenances in phases [2 or 3 phases] rather than in one shot if builder convinced.
We need to monitor if builder is keenly taking care of the layout as it was earlier. For that ppl can volunteer based on availbaility every fortnight and update on the overall layout maintenance in a round robin fashion.

Forming the association has its own challenges and keeping in view the past meetings and availability of folks, it will be tough for the association to take prompt decision and any initiatives.

Are we planning to meet at any place during the weekend and some ppl can represent the entire group when they talk to builder so that it sounds like a plan.

As most of the members in this group, will not have time Or expertise in managing the layout and not a good idea, infact risk loaded ideal of handover our plots to external people, atleast we know, this builder, though the maintenance is on higher end, that can be negotiated and have a peace of mind for next 3 years, post which we can take a call on next course of action ..

Finally we need to go as per majority vote .. Why don;t we set up google voting on all members before going to 24 th meeting  whether go with developers or alternative solutions suggested by Anil , Vemula , Deven or  Pankaj ? 

As no one is ready to take responsibility that should not become a primary reason to opt developers again. They are expensive  and also not sure whether they would agree legally about they would take care all issues related to plots. 

If  at least 50% of 275 plot owners participate in discussion definitely it won;t be so difficult to come up with viable alternative solutions.

The way right now Windsor management guys collected maintenance fees, its not advisable to go with them again I believe, we unnecessarily we burn our pockets.

As per my experiences of another similar layout which had even more charm than Windsor - Horse Statues

From builder perspective, I believe he is charging high because he is aware that not all Plot owners
will pay. Considering even this email group has only 84 members (less than 50%) - I anticipate builder
to use the same excuse that may be less than 50% will pay - thus effectively bringing the cost to Rs.
10 per sqft (instead of Rs. 20).

My recommendation : Engage as many owners as possible, negotiate hard with Builder. However, keeping in
mind that unless he makes something out of the entire engagement - he wont be interested in
maintaining.

If everyone in this group agrees, I am happy to be part of the group that is planing to visit the
builder office on 25th for negotiations.

Also, need to understand who will be visiting and who cannot. People who can - can they please respond
to this email group with - Yes I will be visiting on 25th along with their contact #. It is better to
discuss and plan for negotiations over phone rather than emails.

Unfortunately I am currently outside the country I will not be able to physically join the meeting with
Windsor. This is also why I was hesitating to jump into this discussion till now. I sincerely hope that
all those who are present on the ground  can come to a good understanding and represent all of the
owners at the meeting. Thanks very much for those who are taking up the initiative.

he is no longer a builder. Because he no longer has any plots. So he is a vendor now.  Paying a
maintenance charge for 3 years would be foolish.  As Praveen Vemula pointed out Rs. 2000/- per year
should be enough.  If this builder agrees for this pay, we can consider him for the services.  Else we
should look for other service providers.  We should only agree to pay quarterly and continue with him

All

Some information that is contradicting to whether Builder still has interest in the township or not:
  1. Builder is not willing to share the owners details (email/contact number) in order to really enable us to form RWA
  2. Builder still has unsold plots in the Township

Suggestion :-

  • During 25th Feb meeting - We should push the builder to share contact details of all Owners
  • Ask him to share Maintenance Amount Records - Who paid what, till which date and the expense sheets
  • Make it clear to him that Rs. 20 is not acceptable and let him come back with the amount. We should not disclose the target price that we are looking at. Let us assess the finance statements once he shares.

Additionally, I have only received confirmation from 3 people for Meeting on 25th

  2. Mr. Peyush Gupta
  3. Mr. Mehaboob Pasha

   Great to see members taking this initiative! Could you please confirm the venue for the 25th Feb meeting? I have a prior appointment and will do my best to make it. We've had multiple discussions with the builder on the highly inflated maintenance fees in the past, and after the initial discussions we finally got the following details from them in May 2013: 

"At least 9 laborers’ work in the site every month, and one of the site supervisor reside in the township. On an average our Maintenance bill will be Rs.45,000/- to Rs.60,000/- per month".

Based on the above and we did a detailed calculation and came up with the value of Rs.4 psqft. We had even asked him why he needs 9 people (majority to maintain the gardens) while we could use sprinklers for the gardens and reduce the maintenance by half and also save/use water more effectively, he had no proper answer.

Here is our response, for which we never got any reply till date from the builder. If people are still being quoted Rs.20 psqft in 2017 then it reconfirms that the numbers were heavily inflated way back in 2013 :)!

Dear Mr. Prasad,

Thank you for the details. We have gone through your mail and here is our calculation

Phase I
30x40: 26 sites = 31,200sq ft
40x60: 27 sites = 64,800 sq ft
odd ~30x40: 18 sites = 21,600 sq ft

Phase II
30x40: 93 sites = 1,11,600 sq ft
40x60: 83 sites = 1,99,200 sq ft
odd ~30x40: 20 sites = 24,000 sq ft

Total area in Phase I + Phase II = 31,200 + 64,800 + 21,600 + 1,11,600 + 1,99,200 + 24,000 = 4,52,400 sq ft

Monthly expenses of 50,000 with 10 workers. For 3 years total expense is 50,000 * 12 * 3 = 18,00,000

Cost per sq. ft = 18,00,000 / 4,52,400 = ~ Rs. 4 per sq ft

Based on the above calculation the reasonable charge should be Rs. 4 per sq ft. Your quote of Rs. 20 per sq ft is 5 times the amount and is too high. At the rate of Rs. 20 per sq ft the charges collected will be Rs. 90,48,000 (~90.5 Lakhs) which is a huge amount and is very unrealistic to maintain an empty layout.

Thanks for sharing those excellent inputs. I have the following points to make based on your email. This is purely based on my experience while being part of building management committees in the past.

The calculation of Rs 4 / sq ft  assumes that 100% of the site owners will pay. Even in small apartments getting everyone to pay on time is a struggle so you can imagine the difficulty when we talk about 250 to 300 sites with none of us staying at the property. Even if we formed our own association or took ownership of the maintenance we will face the same problem. The unfortunate reality is that some of us have to bear the burden of those who won't pay for various reasons. If we don't, then all of us stand to lose. I am not saying that we should allow the non-payers to go scot free. We should try all means possible to get them pay their full dues. But this will take time and during this process our property should not be impacted.

The calculation also seems to take into account only the salary costs of the maintenance people (correct me if I am wrong). We should also consider costs required for purchase of new equipment, repairing existing ones, cost for material etc which will be needed from time to time. There will be costs towards common water / electricity etc as well. 

Finally, thinking from Windsor's perspective, I don't see any reason why they would be interested in continuing the maintenance of the property if they can't make anything from it. I think it is in our interest that we should let them make a reasonable profit and keep them interested until we are able to takeover the maintenance.

Considering all this, my humble opinion is that even if we are able to get him to reduce the charges to anywhere close to Rs 10 then it is win-win situation for all of us. Pls let me know what you think.

Request others not in station / abroad can send their friends / relatives for participation on 25th feb.
 
This is an open meeting with builder only 7 of them attending and addressing the common issues will not come to conclusion, either side problems will not resolve. The builder will insist to pay maintenance @ 20/- per sq. ft.
 
It is an opportunity where we have to negotiate with builder and set right the things.

Guess we should limit this to the minimum common infra only and skip all plot specific maintenance for folks who don't pay. Maintenance for the landscaping would be a big cost and we can reduce the area covered as mostly there would be no one living at the site in 2017. There was only one house under construction last year.

  When I visited the site last time there was a board on the water tank gate mentioning that there were sites available for sale.(pic attached). Also for folks who have bought a plot recently they have already paid 3 years maintenance in advance, which should be honored by the builder.

 We can optimize the cost once we have the latest estimates from the builder. We should not end up in a situation where folks who are ready to pay X back-off due to 2.5X which further increases the delta, resulting in a downward spiral.
