Dear Neighbors,

 

I write to you all today with some very disturbing information.

 

On my HOA invoice from  Windemere CAP Management, I noticed a charge dated 09 Feb for $ 25.00 labeled Violation Fee : Maintain Lots. Not knowing what substantiated the charge, I figured I’d give them a call on Monday. However, yesterday (Saturday) I received a letter from CAP Management labeled SECOND NOTICE OF VIOLATION detailing that “Back Screen needs to be repaired. For the record we never received a FIRST NOTICE.

 

The only screen in the back yard that requires repair is the one that is in the Window Well for the basement. Just prior to the Christmas Holidays, we rescued a bunny rabbit that fell through the grate. In order to get to the rabbit I had to force the screen out of its slots. Knowing that I would have to repair it I decided to leave the screen in the window well till spring for the repair. It’s just too cold these days to hassle with it.

 

What’s interesting, I have notified the HOA numerous time in the past about repairing the damage done by the lawn mowing company to the edging around my back yard. It’s a hazardous situation for our pet Pebbles. Nothing has been done to date.

 

For someone to notice the damaged screen in the window well they would have had to go in my back yard and look over the landscaping. It’s not noticeable from just standing in the yard.

 

I’ve attached a copy of the letter from CAP Management which has no name of sender other than CAP Management. Very unprofessional.

 

My family has lived in this house for over 15 years. This has never happened before.

 

I am recovering from a heart attack and two strokes over the last couple years.

My doctor tells me that all the medications I now take are for the purpose of avoiding another stroke.

 

The aforementioned letter, definitely is not helping my stress levels with additional threatened fines.

If someone from CAP Management ( HOA Gestapo) had just knocked on my door and gotten a quick explanation, there would be no need for threatening letters!

 

Next I will be filing a complaint with DORA.

After that, my intent is to call Tony Kovaleski the investigative reporter for Channel 7 News.

 

Next time I spot a stranger in my back yard, I will be calling the police!

 

Finally, enough is enough, my wife and I are seriously considering relocating to get as far away from this HOA!

I have lived in a number of communities with HOAs, this one by far has been the worst!

Hi, Mark,

I too received a similar "Second Notice of Violation"  but never received a first one.  Such notice was not received timely either as the date of the letter was a few weeks ago and we didn't get it until this week.

We are sorry so many issues have been voiced regarding violation notices. Please note we are changing to a new property management company and anticipate more effective processes going forward. Sheryl

Mark   You’re a little late to this party. It was probably that so called compliance officer.... a disgraced ex aurora feminazi cop.of course Aurora. You’re lucky she didn’t  shoot you.
 I think she would have been with the Waffen SS. Looked like one anyway.

I agree with the comments here. I started a legal folder for the violations that I received from CAP and I met with the president about them. I believe that ex-cop's name is Tara?  I'd have to go back and look at my files. I threatened legal action as I had threatening emails from her about violations that simply did not exist. Things like not trimming my trees when I don't have any trees in my yard. Second violations for things that I never had a first violation for. Violations for things things that are not listed in the covenants. CAP is terrible, but they also receive direction from our board which they complained about. It is too bad to see what has happened to the neighborhood in the past few years. I have owned here for 7 years and the first 4 were wonderful and then it went downhill. I have lived in a covenant controlled neighborhood for close to 20 years and had never received a single violation in my life until the new Windemere board and Cap management stepped in. I sincerely hope that we get a new management company and that the board hears the people of the community.
