Dear Mr. Chairman:

 

As a Co-founder of RIGCAA and Chair of the last Revised Constitution of Association, I wish to remind your office of the need to keep an eye on the National Leadership of RIGCAA headed by Mr. Charles Quitee as President on the ongoing dispute in one of RIGCAA’s Chapters, i.e the Pennsylvania Chapter headed by Mr. George Nagbe.

 

I have read exchanges among Messrs Kear and the National President and Mr. Freeman Chea, Chairman of the Elections Commission of the PA Chapter. Other exchanges include the attack on Mr. Freeman Chea and Gbeapo people by Mr. Noring of the PA Chapter.

 

I was taken by surprise, given the intervention of the National President of RIGCAA, Mr. Charles Quitee based on letter sent to him by Mr. Freeman . It is reported that Mr. Quitee is also taking a delegation or set to meet with the RIGCAA PA Chapter.  I see Mr. Quitee’s intervention as ultra vires with consequences pursuant to the following constitutional provisions infra:

 

Section 5.3: Duties and responsibilities of the Board of Directors   ( meaning the national Board. italic mine).

 

 

I)        The Board shall intervene in the event of a conflict between two elected officers, chapters and individual members that may undermine the unity and smooth operations of the association.

 

 

ARTICLE 15: Conflict Resolution

 

1)      Should any conflict arise between members of the Association in two different chapters and members of the National Executive Committee, the Board of Directors shall set up a committee of inquiry.  All findings by the inquiry committee shall be reported to the Board which shall act on the reports or recommendations;

 

 

1)         Should there be any conflict between individual members of the National Board of Directors; the Board shall set up an Ad Hoc Committee to investigate the conflict. Such committee shall exclude both parties;

 

 

2)       Should there by any conflict between the Executive Committee and the Board of Directors, the case shall be investigated and resolve by the Elders Council.

 

 

5)    All evidentiary documents (written complaints) may be requested from all

        parties to help speed up the investigation.

 

 

Mr. Chairman, I will be much obliged for the intervention of the Board should it receive complaint from either party of the PA election dispute to draw your power and reason for intervention against a constitution provision which underscores “The Board shall intervene in the event of a conflict between individual members that may undermine the unity and smooth operations of the association.”

 

There is an undeniable dispute between Mr. Freeman Chea and Mr. Kear on Kear’s usurpation of his position as Board Chea to appoint a new Elections Commission. Such conflict if not abated, shall “ Undermine the unity and smoth operations of the Association” in general.

 

I also think that the PA  Election Commission Chairman’s letter to the national President of RIGCAA  is misdirected. Mr. Quitee, pursuant to the constitution must reply to Mr. Freeman, advise him to  direct his letter to the National Board of Directors pursuant to the constitutional provisions suppra. The President of the PA Chapter position on the dispute must form a pivotal document for the Board.  Thereafter, the Board shall intervene.
