So we have an updated resolution from Evergreen that specifically says that the $20,000 is simply turning the backpay into upfront pay that was already part of the existing $120,000 salary. That makes a lot more sense than the Bonus which would be much more problematic.

I also mentioned that we would want to simply amend the resolution to say “backpay turned into upfront pay” instead of bonus. As it is not technically a bonus on-top of your salary, it is your actually pre-agreed upon salary.

It seems to me that the current Sallary agreed upon is $120,000/yr.  So as long as everyone is in agreement on that, then there is no bonus, nor is there a change in the total salary.

What I need is confirmation and verification in writing that your total salary compensation is correct and we have agreement in relation to what has been approved in the budget and by the Leadership Committee and/or Board.

If this is correct please respond with a Yes this is the correct amount agreed upon by myself and the Leadership Committee and in the Budget. Or something that contains yes and or I agree. 

This is a legal decision so it is important to have explicit clarity on the agreement and pay so there is not problems in the future.

As soon as I have written confirmation and verification of the agreement, then I will run the April Bonus Pay.

I was incorrect on the calculations related to the Monthly Payroll. With you getting paid $20k more, the % taxes increases to like 28% from 23%.

Therefore the breakdown is that you end up with a little less than $5,000… Here are the details…

$6,666 (monthly pay before taxes)
$1, 814 (taxes deducted from employee pay)
——————
$4,814 (take home pay after taxes - direct deposit)

I also have included the screen shot breakdown which includes the business costs as the total to pay you $6,666 is $7,403. Hope that it all makes sense.

Hi Heather and Mel,


So after review of the previous agreements, it seems like it is clear that the previous agreement was $120,000/yr. That means that Joel’s Pay was $8,333/mo plus benefits, and that $1,666 was backpay each month.  So we can pay him $1,666/mo times 12 months of backpay = $20,000 for his current salary.

       - $10,000 Benefits

Because there is no change to his salary, it seems to me that the proposal and update budget is 100% legal as this would NOT be a bonus or change in the salary itself.  

Overall I am personally not happy about it, because it is a lot of money and there are people like me not even getting minimum wage, but as far as the proposal itself being legal, I do NOT think we have anything to worry about at this point.

Since there is NO change to the Salary, there really is Nothing to vote on, since nothing is actually changing. SO as long as we review the budget, under our policies if it looks ok then we automatically approve it.

So please let me know if there are any other concerns or issues, otherwise if I don’t hear anything I will be planning on processing the $20,000 of backpay for the next payroll cycle.
