Dear President,

It is very clear from the mail that, the Apartment handover has not happened till Feb 2011 and but 3 committee members took the handover of documents after the committee got dissolved.

As a member of the association, I have some more questions in my mind:-

1) Why did the dissolved committee took the handover??
2) Why all the members were not involved in this important topic and taken into consideration?
3) Why did the 3 committee members created the documents as if the handover was completed in November 2010??
4) As per my discussion with Venkatesh few months back, I discovered that, he has put a case against the builder in 2011. So to support the builder, did these 3 committee members created the documents as if the handover completed in November 2010??
5) There was no AGM or SGM resolution was passed to take the documents handover from builder to Association, then why did these 3 committee members, out of which one committee member was Vice-President and he can exercise his duties in the absence of President, but signed the document handover. The other committee members (Treasurer, Joint-Secretary and other members) were not communicated about this proceedings. Why??6) What date this process was being done?
7) If it has been done after new committee was being formed in March 2011, is the new committee members of 2011-12 were informed about this process?? 
8) They have used the association seal which was supposed to be with authorized signatory bodies of the association. Why did the committee members of 2011-12 given association seal to them?. Did few committee members of 2011-12 are also involved in this scam??

This is not at all acceptable to any member of the association that, the Apartment handover has been done without notifying any members and few members created the documents with 3 months earlier date and we don't know why it has been done. In the interest of whom?? what was the agreement between builder and these 3 committee members by favoring the builder? 

Request current president to investigate on this and as the matter of the subject was revolving around the Lift controller which is costing all of us approximately 6 Lakh rupees and more. I am sure many of the members do also have this questions which needs to be answered by the committee. 

I think, association management MUST call for a debate/discussion on this topic in SGM or upcoming AGM and clarify these questions arising in all members mind.

Apartment Documents Handover Scam @ V S Cozy
Dear President of V S Cozy Apartment Owners Welfare Association,

As a member of the association, I have right to ask the association president about our apartment handover scam happened in V S Cozy. Please find below sequence of events happened in V S Cozy in 2010-2011 which arises a question about there is something terrible went wrong when it comes to apartment documents handing over process:

1) V S Cozy Apartment Owners Welfare Association was registered in first quarter of 2010
2) We had first AGM in August and nominated committee was dissolved and a fresh committee was elected and started working
3) The President of the association resigned on 29th Sept 2010 due to personal reasons, there was no formal acceptance or rejection of the resignation and President continued to hold the position.
4) The discussion on Apartment documents handover started in the month of January 2011 (Find the attached reference file - Gmail - Meeting with Rammohan_Committee Discussion_January 2011.pdf)
5) There was lot of discussion around LIFT problems faced by the residents and one of the reasons for the LIFT problem was the Controller of the Lift and the technician also confirmed the same. Few committee members were arguing that unless the Lift controller gets replaced by builder, we will not take the handover of the documents from builder.
6) The handover discussion gone to such an extent that, the committee members opted to dissolve the committee as there was lot of difference of opinion among the committee members
7) The Handover discussion e-mail thread started in 28th Jan 2011 and most of the committee members decided to dissolve the committee on 9th Feb 2011 and a notice was being issued for Extra Ordinary meeting for 27th February 2011
8) A new committee has been formed and till today there was no further communication on Apartment Documents handover from the managing committee.
9) But I discovered a document in the apartment document list which I shared in Whatsapp sometime back that the Lift Related documents have been handed over to the Association committee on 4th November 2010 !! How is this possible? Till 9th February 2011, there was a discussion was going on and because of that the committee got dissolved and how can Handover be completed 3 months before the discussion!!!

If the committee had not taken handover of Lift, we may not have to spend approximately Rupees 3 Lakh rupees for replacing the controller now for one lift. Because the issue with Lift was identified during 2010 only that, the controller is creating problem and few committee members were arguing that builder has to replace the controller. Considering we have two lifts, we would have effectively saved Rs 6 Lakh rupees for association if we would have taken a stand which was favoring all the residents and members of association. For replacing the controller, now association has taken money from all flat owners. This we could have avoided if we all taken a decision on apartment handover by calling SGM in 2010/2011.

Most importantly, most of the people who were stuck in the Lift so many times in VS Cozy, didn't have to undergo this pain.

There is something really fishy and document manipulation by few committee members who signed the Apartment Handover document confirmation. Why the committee members who signed the handover not informed all the members of the association about the handover? When the handover completed? Please find the attached file for your reference on Confirmation given to builder by 3 committee members (President, Secretary and Vice-President) - Lift Documents Handover_November 2010.pdf.

Request the current president to look into this matter and refer to the documents attached and do investigation and update all the members of the association about this "Apartment Document Handover Scam" happened in VS Cozy. This scam is worth Rs 6 Lakh and above and because of few members all of us are paying the Penalty by sharing the Controller replacement cost.

Dear President,

Few more documents/information on the Apartment Documents Handover Scam.......

1) The dissolved committee members met the newly elected committee members on 6th March 2011, please find the meeting minutes document scan copy (There are two meeting minutes document by the same set of people)
2) One version says, the builder is ready to handover the documents and facilities documents to association (Page 3, point no 4 of the document "Meeting Minutes_6th March_Committee Transition Meeting_Version 1.pdf"
3) Another version says, the builder has handed over the documents and association received the same and acknowledged!! (Page 3, Point 4 in the meeting minutes document "Meeting Minutes_6th March_Committee Transition Meeting_Version 2.pdf")

Both the meeting minutes document in the records of the association. 

Too many people are involved in the scam and all the members interest has been overridden by few members of the association.  

Request association president to call for a SGM on this topic and have a free discussion/debate on this why this has been done without taking all members opinion. Why there was no SGM or AGM on this important matter which involves all our property, common area facilities??
