Thought you all might like to see a letter that I sent earlier today
to Susan Clark, the president of the Virginia Council of
Administrators of Special Education, to take issue with a sentence in
the "talking points" that VCASE has used to push for VDOE's revisions
in the state's special-ed regulations.

The offending sentence: “VDOE currently recruits, selects, trains,
evaluates and disqualifies a hearing officer (HO), not the Supreme
Court [sic] who only appoints the HO."

Almost everything in this sentence is wrong. I've also urged VDOE,
given its special relationship with VCASE, to urge the organization to
correct its materials on this point.

The letter is posted as a PDF in the "Files" section below.

Can you share with us what VDOE's response was? Will VDOE take the
initiative and pressure VCASE to correct their materials? I doubt that they
will do anything. VDOE wouldn't want to do anything that might strain the
relationship it has with VCASE.

Good news to report . . . a small victory

As a result of our letter, the Virginia Council of Administrators of
Special Education (VCASE) has corrected the completely erroneous
description of the due process system--along, incidentally, with a
major error of grammar--in the "talking points" it has been using in
the debate over revisions in Virginia's special-education regulations.

In an e-mail response last night, Susan Clark wrote: "Thank you for
bringing this to my attention. The corrections have been made to our
VCASE website."

Maybe we should take a closer look at VCASE's nine other "talking
points."
